
The Eastern Caribbean Court of Appeal has refused permission for two Barbudans – activist John Mussington and Chair of the Barbuda Council Jacklyn Frank – to take a case to the Judicial Committee of the Privy Council, this country’s highest appeal court.
The decision was handed down on Tuesday, October 19.
The duo was seeking conditional leave to appeal to the Privy Council, after the Court of Appeal upheld a High Court judgment that removed an injunction against the construction of an airport on Barbuda.
Barbudans are opposed to the project, because they allege that it was undertaken through an unlawful process on July 18, 2018.
A number of Barbudans alleged that the Environmental Impact Assessment (EIA) submitted by the developers in November 2017 was seriously inadequate, according to Department of the Environment documents.
Additionally, Mussington has claimed that the lands on which the airport is being constructed were traditionally used by the island’s people for hunting, farming, and grazing, and were the habitat of the rare red-footed tortoise and the feeding grounds of the Barbudan fallow deer.
In August 2018 the pair were granted an injunction and leave to pursue a judicial-review case against the parties for breaching the Physical Planning Act, 2003. (REAL NEWS)

You are right, Barbuda is controlled by a few rich families and they don’t want anyone to do better than them. They think Barbuda belongs to them and don’t want any of the other Barbuda people to do better. The want them to continue to live in poverty while the likes of Trevor Walker. Frank and Mussington live high on the hog controlling everything from fuel sales to food supply. Trevor Walker was in government for 10 years what did he do for Barbuda other than enrich himself and set up himself to control the supply of fuel in Barbuda. Wake up people of Barbuda see these people for who they are….modern day oppressors!
I say to the people of Barbuda, don’t worry nature will take its course and give you justice. Those underground crevices that the runway is built on will prove you right.
Denied the right to due process is a better way of phrasing it. This is why the Privy Council is still needed. But if we deny people access to it, what value is it?
The government done spend $60million just to fly in some white people for the 600 homes being built. They are going to need another $60million as the runway go collapse..
