U.S. Court Quashes All Subpoenas in So-Called “Corruption Discovery” Matter

– Ruling fully vindicates Prime Minister Browne, his family, and Government officials –

The Government of Antigua and Barbuda welcomes today’s decision of the United States District Court for the Southern District of New York, which quashed every subpoena issued at the request of Yulia Guryeva-Motlokhov—daughter of the sanctioned Russian national who owned the super-yacht Alfa Nero—against Prime Minister Gaston Browne, members of his family, senior Government officers, and several private companies.

In a detailed Memorandum Opinion and Order, Judge Jesse M. Furman held that the applicant “failed to meet the statutory requirements for relief” under 28 U.S.C. § 1782. As a result, the Court:

  • Quashed the subpoenas in their entirety;
  • Vacated its earlier ex parte order that had authorised the subpoenas; and
  • Directed the applicant’s counsel to arrange the prompt destruction of any material already produced.

This ruling confirms what the Government has said from the outset: the application had no merit, no legal foundation, and no legitimate purpose. It was a fishing expedition aimed at harassing the Government of Antigua and Barbuda, its Prime Minister, and others through false and malicious allegations.

Prime Minister Gaston Browne stated: “Today’s decision is complete vindication. The Court has confirmed that these subpoenas were never justified. We will always defend the integrity of our institutions and the good name of those who serve them.”

Attorney-General Sir Steadroy Benjamin added: “The Court’s order speaks for itself: the applicant could not satisfy even the basic legal threshold. We trust this outcome will deter any future attempts to weaponise foreign court processes against Antigua and Barbuda.”

The Government of Antigua and Barbuda remains firmly committed to transparency, the rule of law, and the highest standards of public accountability. At the same time, it will vigorously oppose any effort—domestic or foreign—to tarnish the reputations of its officials or to coerce the nation into abandoning decisions made in the best interests of the people of Antigua and Barbuda.

    But I really hope the Prime Minister has enough evidence against those in Antigua and Barbuda, whom he accused are the UPP member, to sue them untill they broke. Because we have to draw the line somewhere. We cannot try to tarnish a person’s character so much, all because of political expedience. is power we hungry for so. Why not come up with a better economic plan or what that people can see that you are a better party to run the affairs of the country. But NO, all they do is to tear down the other person. Make all sorts of baseless and unsubstantiated allegations. And like they did with Lester Bird tarnish his character to the point where many believed them.     Brix I guess you like your tax dollars to pay for a Electricity Plant that cost us US$50Million that never worked. You like for your tax dollar to go pay for a mile of Road that cost $10Million around the stadium. Or you like for your tax dollars to pay for Jelly Beans Sidewalks costing us $900million. I mean you don’t mind your tax dollars paying for a Romantic Rhythm show costing us $7million and never have been accounted for. I mean we have so many wastage under the UPP that it will be years before we can earn back these monies. Weston used to say, “every deal was a steal”, under their governance. When will you stop the hatred and speak without bile in your heart. It will kill you.

No matter what side of the political divide you are on, when it comes to the reputation of Antigua & Barbuda, it is not just Gaston Brown or his family or Cabinet members who has to suffer the consequences of a bad reputation. Even our students abroad must feel a kind of way when we hear of unbecoming behavior of our leaders. When we travel and ask where we are from, it is with great pride we answer and not with what a government is doing, good or bad. This is because people know all governments have citizens that they might not favor those in power; so that might be the least of someone’s reasons for asking. Instead, it is the other things that make us proud and more so the reason we have a top notch brand of tourism because of ‘the people’. The government is the facilitator and the ‘people’ the executors.

    It is no coincidence that ‘it is everybody’s business’. Instead we are letting something that should have been resolved nationally became ‘everybody else’s business’ outside of our borders; and that is a disgrace.

    I am for true democracy and a viable opposition party but they must be guided by integrity, honesty and respect, even if they abhor their opponents. We the citizens as well are embarrassed and it is unfair to us to pay for something that was uncalled for. We have a very literate population and highly trained legal minds that could have requested the information needed from the ‘Freedom of Information Act’ and in a public forum, discussed this and banter about it rather than the course of action taken. I would have much rather pay even some of the legal minds that were calling for the PM’s head on a platter (The Thurd) to have gotten some of this legal fees to just really commentate over this issue and give the public a chance to understand. Not a chance to cuss and make defamatory comments, even personal attack even about the children of the PM. (The Thurd calling them his grandchildren).

    If the Opposition would have taken a more serious approach, they might have even helped their self-image evolve to involve the people in a meaningful way rather than disgraceful back and forth that is tantamount to unintelligent rhetoric.

    If the Opposition wants to hammer the ABLP or the PM, fear game! However, giving white multimillionaires ammunition against the country and disguising it as going after the PM is fools gold. The Caucasian people involved here could care less about our wellbeing or our reputation. When it comes to corruption, they themselves cannot even call the kettle black, allegedly. This is most certainly an Uncle Tom response by the UPP Leadership. This is like the house niggars in colonial times. Ready to have a field negro embarrassed or even die.
