CABINET NOTES: The Cabinet has authorized the Attorney General and the Ministry of Legal Affairs to draft legislation for presentation at the next sitting of Parliament, aimed at expunging the criminal records of individuals convicted for possession of small quantities of cannabis (less than 15 grams) and granting them official pardons. 

The proposed legislation will also apply to individuals convicted under the Public Health Amendment Act during the COVID-19 pandemic, with a view to clearing their records as well.

Additionally, the Cabinet has agreed that the Honourable Prime Minister will advise the Governor General to exercise his constitutional authority under Section 84(1) of the Constitution of Antigua and Barbuda to pardon individuals currently serving sentences at His Majesty’s Prison, who are actively engaged in the HAPPI Programme and have demonstrated genuine rehabilitation.

Cabinet emphasized that the criminal records of these individuals will be expunged, allowing them a fresh start and an opportunity to continue contributing positively to society.

This action aligns with the Antigua and Barbuda Labour Party government’s commitment to rehabilitation and reintegration. Upon receiving their pardons, these individuals will be immediately offered full-time employment within the HAPPI Programme. 

Cabinet also approved the granting of Half a Million Dollars ($500, 000) to the HAPPI Programme for the continued building and reconstruction of homes for the less fortunate.

  1. There actually are people still in prison for violation of covid regulations??? That’s almost three years!!! Failure of the legal system. Also, the small consumers and possession of cannabis should be eased. Anything less than a 8 ounces and still in prison needs to be freed. Yes, people actually carry around that amount to distribute to friends!!!

  2. A prominent member of the HAPPI programme is a convicted murderer.
    He had gone to immigration shortly before he murdered the All Saints resident and asked to be sent home to his native land.
    Immigration refused.
    Nine years I to his sentence he impregnated a young fool in the comminuity.
    Please clarify the pardon for persons working with the HAPPI programme
    Hopefully his pardon will be an early trip to his homeland.
    However not reintegration into the community.
    I wonder if the itchy cat woman who bore him the child whike he is in prison is getting any assistance from the state.
    That would be criminal!!!!!°

    A Pardon can also we given to a deceased person. This is to clear your name for the record books. Marcos Garvy was pardoned by Biden before he left office. If you are in prison while being pardoned your sentence will be commuted. So those who have been convicted during Covid 19 for violations of the law then should not be in prison but have a criminal record. And with a pardon this will be cleaned. So when they apply let say for a job or a visa they can say they have a clean police record.

Those who genuinely participate in the program, being pardoned, and display rehabilitation, should be placed in a work program for construction so they can go straight into a job, rather than being released with no options. There should be a 90 day program to prepare those individuals to reacclimate into society and the construction job force to make sure they are successful. As well as providing individual mental health counseling and family counseling. Family counseling if these men have children so they could be a better role model for their children and be better fathers and husbands. All of this is punitive to make sure these men have a successful out come and never return to prison.
