PM Browne adds MP Kelvin Shugy Simon to defamation lawsuit

Dr. David Dorsette, the lawyer representing Prime Minister Gaston Browne in a defamation suit, revealed that Member of Parliament Kelvin Shugy Simon and the Observer Media Group are the latest targets in the escalating legal battle.

The defamation allegations stem from material published online, which was initially featured on the online version of a local newspaper.

Dr. Dorsette expressed his astonishment at the lack of caution exercised by those involved, emphasizing that these are serious times requiring mature discussions, not loose lips.

According to Dr. Dorsette, Kelvin Shugy Simon, the Member of Parliament for St Mary’s South, broadcasted similar defamatory statements via social media, challenging the Prime Minister by throwing down “The Gauntlet.”

Dr. Dorsette stated that a pre-action letter is imminent for Mr. Simon, expected to be delivered by tomorrow.

“The Gauntlet” thrown by Simon prompted Dr. Dorsette to outline the seriousness of the situation, emphasizing the need for responsible journalism and adherence to defamation laws.

He criticized the Observer Media Group for republishing the material, stating that they are now also in the firing line for their alleged recklessness.

  4. I have noticed that since the opposition has gained a few seats, their rhetoric has been irresponsibly slanderous when I listen from time to time. I used to enjoy listening to the shows, even with a little political banter, but during the last year or more, the conversations have become vitriolic and low grade. Even the Saturday show has sunken to the pit. It’s no longer about educating or informing its audience. It’s more so about casting aspersions on people’s characters, acusing their political rivals of alleged misappropriation in many areas without proof. Lots of guess work and assumptions.

    Every citizen has a democratic right to view current administration from their own lens, albeit the facts or misinformation.

    Disinformation however, ought not be harnessed or encouraged as it lessens the integrity and value of your capacity to serve your constituents, followers and the public as a whole.

    My hope that these lawsuits will help to curb the thuggish behavior of the defendants and many like them.
    Criticize, disagree, rebut, counteract without being irresponsible about what you choose to say publicly.

    The courts will now have to decide if the Intimations have reached the level of defamation. I trust that subsequent to this, we will experience more discourse on air and in public. Stop being a group of unruly and insolent children who get pleasure from creating mayhem in the schoolyard!!!

        • After all the hullabaloo about defamation by (Ms) Quinn-Williams I decided to check the offending placard. There it was, laid bare before my eyes to see and read and I could not and still cannot believe what the fuss is all about. Maybe I’m looking at the wrong placard, I don’t know, but as night follows day if this is what the Prime Minister has taken umbrage to then sorry, there must be a serious flaw in his charater which needs attending to. Are you saying the Prime Minister is so offended by this piece of political knockabout that he is taking legal action against the lady? Pull the other one, he’s having a laugh at the public’s expense. Maybe the PM likes a bit of levity now and then, that’s good to help relieve the burden of office; if not then there is little left to say except our ‘Marvelous’ Visionary leader is a bit thin skinned, tetchy, humourless and lacking in a bit of class.   6. Looks like Gaston Browne is trying to singlehandedly destroy the democratic process in Antigua & Barbuda.

    He’s on a path to silence and dismantle anyone who opposes him, and their right to debate and challenge him on his wayward policies and broken manifesto promises.

    And remember, whilst Gaston Browne pushes on with his excuses for Litigious behaviour, our economy suffers; the people are suffering; and Antigua & Barbuda continues to spiral out of control.

    The Prime Minister is only doing this to hide his obvious shortcomings. This litigated “dead cat” narrative is a sure fire way of deflecting from the mess he has caused to date.

    • Pay your damn taxes and stop complaining. People need higher wages, then the money must come from somewhere. If people on the opposition side choose to be irresponsible in their critiquing of the administration’s policies, then the judicial pathway is only other option. Step up your game and not go so low.   9. Political figures/public figures have a higher standard to prove defamation. They must prove that the person harbor feelings that what they are saying is not true. Defamation for regular folks does not require this, it just requires the information to be defamatory, untrue, and that special damages occurred.

    While for public figures, an additional element of malice (word of art), that means a reckless disregard for the truth occurred.

    Did these people believed what they were saying to be untrue? Plaintiff has the burden of proof for this section.

    I would be available as legal advisor, only because of my interest in law. Not about support.

Question: if today you were Prime Minister Dave Ray of Antigua and Barbuda and your name was shown on that placard, would you have taken or threatened to take legal proceedings against the lady who is your political opponent? A simple yes or no will suffice with your reason why or not.

  11. Soon from now everybody would be afraid toeven open their mouth to and talk. Freedom of expression is now under seige and it really marks a sad day for openness and candor in this country of ours. The political directorate is now literally driving fear into the minds and lives of the citizenry about speaking openly and frankly about any situation in the country. When citizens are fearful of speaking freely, we would have reduced our democracy and built an authoritarian regime similar to what we see in Iran, North Korea and Russia.
    I urge the Prime Minister, let us not trod down these parts and let us all work together in the spirit of true democracy.
    These frivolous lawsuits will shake the foundations of our democracy and only create more fiction and chaos in the country.
    Please Mr Prime Minister, lead by example. Sometimes it is necessary to walk away from a fight and walking away doesn’t make you a coward.

On the other hand, not one time have you come out and said that you think that the government approach on any issue is wrong. You literally follow blindly. Did he not say that he is the cleanest politician in the Caribbean? A man who had nothing prior to 2014 as per Asot Michael? He lies with impunity in parliament, offended by questions and goes on personal attacks instead of answering. Some of the most degrading, abusive words have come from him, but he cowers and plays victim when called out.

  20. Listen to Gaston on his radio station on Saturday how he cuss plenty of people, especially some white Antiguans because they don’t support him. He appears to begrudge one white family because he said they owned 600 acres of land. I guess no Antiguan should own more lands than him.
    If his intention is to instill fear in the opposition, then it is not going to work. Antiguans have to stand up against dictatorship and for freedom of speech.
    Now he is using a law firm that is affiliated with the Speaker of the House. After listening to Dorsett at the Privy Counsel recently, I would not hire him to represent my dog. I hope Gaston is using his own money to pay his legal costs, and this is not just a means to enrich his friends.
    We will never allow you to destroy the opposition in Antigua. All sensible Antiguans will contribute to a legal fund to defend them. If there is something call impartiality of the Justice System in Antigua, you will never win your case. You said you did not see the poster, you should read it now. What has Kelvin Simon done?
    When you lose the cases, you should be made to pay legal costs and damages.

      If you look at the bigger picture, Gaston Browne is witnessing the growth of the UPP (especially after the last General Election).

      He’s creating a dangerous precedence by threatening legal action against two opposition members in recent times.

      The Prime Minister wants to halt UPP’s political march any which he can, because he wants a ONE party state – at any costs!

      I’ve said before, and I’ll say it again this UNGODLY man wants to destabilise Antigua & Barbuda’s democracy.

      The DNA party have virtually disappeared without trace (although sadly, they helped the ABLP over the winning line at the last GE), and Gaston Browne has the UPP in his sights with litigation, delaying opposition debates in Goverment House; and if he had his way, the next step is more than likely to PROROGUE Parliament.
