Murder charge dismissed against Jamaican

A magistrate on Monday dismissed charges against Jamaican national, Ari Vassell who was accused of killing Pigotts resident, Sean Joseph in 2017.

After considering evidence presented by the prosecution, Magistrate Ngaio Emanuel-Edwards ruled there was not a prima facie case.

This means there was insufficient evidence to merit committing the case for trial in the High Court.

When police launched their investigation in Joseph’s murder, Vassell was initially charged with perverting the course of justice, a charge which was dismissed by another Magistrate.

The Jamaican man was subsequently charged with murder months after Joseph was found shot dead on a road in Piggots.

  1. A better them tap lock up people because in recent times all them cases a dismiss for want of prosecution, smdh. The entire Police Force want to scrap.

    • Things like these should not happen, some one is dropping the ball, it’s unheard of for the state to present it case only to find out that things are missing that cause the case(s) to be thrown out and hereby releasing these hardened criminals to roam our streets again. Things like these our esteemed A. G. need to be looking into.
      This has to stop things like these will cause folks not to have any confidence in the system. So Mr. A.G. get your house in order.

  2. The police need to do their investigation properly before bringing a charge against anyone and taking them before the court. It seem that they can only investigate small crimes like one to 100 grams of marijuana found in someone possession. Please investigator officers take your time and investigate the crimes properly. For this year 2019, two big drugs cases and one murder case have been thrown out of the nation court system.
    If I was the Jamaican national, I would take the next plane back a yard.

      Neither with investigation, arrest or prosecution.

      But they do with the ‘…Murder Case.’ Embarrassing yes.

      They Could not make out a ‘…prima facie case.’

      In the first place, they had no’…prima facie evidence.’

  3. PROFESSIONALLY AND PROSECUTORIALLY – MAGISTRATE CORRECT

    More seriously, just to provide some enlightenment, ‘…Professionally and Prosecutorially.’

    The Defence and Magistrate are Correct.

    A Committing Magistrate shall not commit an accused person to stand trial, neither would the Director of Public Prosecutions (DPP), indicts an accused person for Jury trial, where he was satisfied that ‘…there was no reasonable prospect of conviction.’

    There has to be more than at least a ‘…Scintilla of Evidence.’

    The prosecution shall first establish a ‘…prima facie case.’

    This is based upon credible and irrefutable evidence.

    Investigators know or would have been reckless not to know or grossly negligent not to remember the evidential basics.

    They ought to know that; ‘…Evidence’ is;

    (a) ‘…That which makes a fact evident.’
    For example, if a person is accused of murdering another; the ‘…Fact in issue is that a person is dead.’

    What is not a ‘…Fact,’ is that the accused had killed him. This is merely an allegation or accusation.

    Thus, the prosecution shall adduce evidence of;

    (b) ‘…That which supplies proof.’

    Not only these, the prosecution shall also produce;

    (c) ‘…The means by which a fact may be proved or disproved.’

    These are usually given by eyewitnesses.

    Additionally, the case for the prosecution is supported by what are called called ‘…Exhibits’ – physical- weapons, documentary and experts- medical, pathology, scientific et al.’

    The prosecution had no eyewitnesses, let alone any exhibits.

    That which was never totally and professionally relied upon, were ‘…Telephone Recorded Conversations’ particularly those that revealed ‘…no evidence of a conspiratorial or pre-meditated attack’ upon the deceased.

    Such information may identify a ‘…Cell Site’ through which the communication had passed, but could ‘…never place an accused person on the crime scene or with a weapon in his hands.’

    This is often referred to as ‘…Circumstantial Evidence,’ which, though opinionated or from which ‘…reasonable inferences might be drawn by a Jury,’ has to be extremely strong.

    Without more, the prosecution is going nowhere.

    Without fear of contradictions, from his;

    (i) ‘…Professional training;

    (ii) …Learning; and

    (iii) ‘…Practical experience in;

    (a) …Law enforcement;

    (b) …Criminal investigation; and

    (c) …Court prosecution,’ tell them that ‘…Rawlston Pompey’ has said so.

  8. Check the narrative the jamaicans coming to antigua and killing off the antiguans unbelievable.
    They have illiterate blood that will take generations to be come civilized. Am just tired of hearing only if this was jamaica. Antigua in problems thank alp / upp
