Former MP Kelvin Simon Challenges Speaker’s Decision, Asserts Lawful Resignation

Kelvin C. Simon, a former Member of Parliament, has responded to the Speaker of the House of Representatives in Antigua, disputing the interpretation of constitutional provisions and asserting the legality of his resignation under Section 125 of the Antiguan Constitution.

In his letter, Simon acknowledges receiving an undated response from the Speaker’s office, which deemed his resignation letter, submitted in accordance with Section 125, acceptable.

Simon contests the Speaker’s reference to Section 41(1)(E), stating that it does not apply to his situation, as Section 125 does not have provisions subject to Section 41(1)(E).

Expressing concerns over potential violations of his constitutional rights, Simon accuses the Speaker of imposing political requirements beyond the scope of Section 125. He maintains that resigning from the United Progressive Party and withdrawing his allegiance, as demanded, is not a legal requirement under Section 125, asserting it infringes upon his freedom of association.

Simon concludes by urging the Speaker to reconsider their refusal to accept his resignation, affirming that he acted lawfully and fulfilled Section 125’s requirements.

The dispute over constitutional interpretation has sparked a heated debate, with far-reaching implications for Antigua and Barbuda’s political landscape and the exercise of constitutional rights.

A simple procedure having so much bacaanal the house speaker has guided you publicly any third form student would be able to understand but it’s your right to accept or decline this is so embarrassing for our nation that it has to be this way so much confusion so much bush and political experts and this they just get right

The sad thing about this while Kevin Simon resignation, it is the Speaker that has exhibited his total lack of understanding of the Constitution in particular sections 41 and 125. Their is a vast difference between both sections i.e., TENURE and RESIGNATION and the Speaker does not understand that.

  3. Well done Shuggy. The 18th candidate thinks he is the sharpest tool in the shed. Too bad he doesn’t recognize his colossal blunder here. Quoting from a section of the constitution he said to hell with to appease massa, that has no relevance to the resignation. Let’s see if he retracts his blunder and apologize to Shuggy and the folks whom he said can not comprehend the constitution. What a joke this clown council (KC) is!   7. The UPP is an organization where the blinds are leading the blinds. And in the land of the blinds One Eye is king.
    Sad situation they find themselves in. And there is no way they will ever get out of that.
    The Speaker in his letter made an invitation to Mr. Simon, to come with his lawyer and sit down with him, so that he can show them where they erred with the regulation, the law and the constitution. Instead of doing so, Mr. Simon replied by letter to say that he has received advice that he is right and the Speaker, who is a KC and has practiced law for many years, is wrong.
    Well Mr. Simon, all that is left is for you to take it to the courts. Good luck.
    Meanwhile your case, whether you were properly nominated, is still in court and that case will be heard, whether you like it or not.
