Kelvin C. Simon, a former Member of Parliament, has responded to the Speaker of the House of Representatives in Antigua, disputing the interpretation of constitutional provisions and asserting the legality of his resignation under Section 125 of the Antiguan Constitution.
In his letter, Simon acknowledges receiving an undated response from the Speaker’s office, which deemed his resignation letter, submitted in accordance with Section 125, acceptable.
Simon contests the Speaker’s reference to Section 41(1)(E), stating that it does not apply to his situation, as Section 125 does not have provisions subject to Section 41(1)(E).
Expressing concerns over potential violations of his constitutional rights, Simon accuses the Speaker of imposing political requirements beyond the scope of Section 125. He maintains that resigning from the United Progressive Party and withdrawing his allegiance, as demanded, is not a legal requirement under Section 125, asserting it infringes upon his freedom of association.
Simon concludes by urging the Speaker to reconsider their refusal to accept his resignation, affirming that he acted lawfully and fulfilled Section 125’s requirements.

The sad thing about this while Kevin Simon resignation, it is the Speaker that has exhibited his total lack of understanding of the Constitution in particular sections 41 and 125. Their is a vast difference between both sections i.e., TENURE and RESIGNATION and the Speaker does not understand that.

Sad situation they find themselves in. And there is no way they will ever get out of that.
The Speaker in his letter made an invitation to Mr. Simon, to come with his lawyer and sit down with him, so that he can show them where they erred with the regulation, the law and the constitution. Instead of doing so, Mr. Simon replied by letter to say that he has received advice that he is right and the Speaker, who is a KC and has practiced law for many years, is wrong.
Well Mr. Simon, all that is left is for you to take it to the courts. Good luck.
Meanwhile your case, whether you were properly nominated, is still in court and that case will be heard, whether you like it or not.
