Need for Urgent Reform in Antigua and Barbuda’s Legal and Justice System

I am writing anonymously to express a pressing concern about the current state of Antigua and Barbuda’s legal and justice system, especially as it affects foreign nationals facing legal cases in the country.

There have been numerous reports from families and friends of those involved in legal battles, highlighting excessive court delays and an outdated judicial process that are causing severe distress.

One particularly distressing case involves an individual who, overwhelmed by the inefficiency of the legal process, sent a suicidal note to their loved ones.

This heartbreaking situation underscores the severe mental and emotional toll that these delays are inflicting on those awaiting justice.

There is an urgent need for a comprehensive reform of the legal system to ensure that it functions efficiently and justly, providing fair and timely resolutions for everyone, including foreign nationals.

The current situation not only impacts the lives of those directly involved but also undermines the international perception of Antigua and Barbuda’s legal framework.

  1. Whoever you are, thank you for writing this. Numerous attorneys in Antigua and Barbuda i expressed my anger that they seem to never file motions to dismiss charges based on the horrific constitutional violations against defendants by violating their rights to a speedy trial.

    It is time judges and attorneys begin appreciating this vital constitutional right. It is time the prosecutors and police understand they have the right to drop charges and make plea deals.

    Built into your office and duty is the right to use your limited resources to go after much serious crimes and your ability to exercise your judgment.

    I am calling on the Attorney General of Antigua and Barbuda and the PM to enact legislation right now that make it even clearer that the prosecutors have the right to make please deals and that particular cases must be disposed of by a certain time or it MUST be dismissed.

    Most of the kind of cases in Antigua and Barbuda should be completed/disposed of in 3 to 6 months. Instead of hanging over people’s head for years.

    I was so hurt when I spoke to another employee/attorney in Antigua within the DPP who responded by saying she does not know of any authority she have in dismissing wrong charges or making plea deals.

    When you mention the country is highly incompetent and changes should be made, they think you are speaking in bad faith, and I am. I am just tired of seeing injustice and seeing no one exist to champion the rights of citizens and for victims. But the locals are so incompetent and political, you cannot show them how incompetent their leaders are too.

    At no time this decade should any final court of appeals should be in the Caribbean when no proper justice watchdog organization exist locally or regionally. No competent person who comprehend the criminal justice system in Antigua and Barbuda would want a final court of appeals to exist locally or regionally at this stage. It would just not facilitate justice.

  2. The legal fraternity is evil. I can think of two persons who hired lawyers to represent them, but the lawyers took their money and never worked on their case.

    There have also been instances where lawyers undermined and worked against their clients. That is why, back in the 90s, Taffy Bufton attacked his lawyer, Vere Bird III.

    Let your friends and family know who the culprits are, so they can avoid doing business with them as much as possible.

  3. Lawyers only you say? No, not those alone.You get a verdict in court against someone. The person is fined, has to pay you, but there’s no follow up in the court system to see if it is carried out. When you go in to query, you are told by the bailiff, that you have to pay him again to find the culprit.
    Then, one is owed monies by the government for four, five years, and there’s no redress. How many more people have to suffer mentally and emotionally in these situations?
