Lawyer For Asot Michael Asks Chief Magistrate To Recuse Herself

Attorney for Member of Parliament Asot Michael, Hugh Marhsall Jr, has asked Chief Magistrate Joanne Walsh to recuse herself from his case.

In a letter dated September 14, 2020, Marshall Jr asks Walsh to “immediately recuse yourself from these proceedings.”

The proceedings Marshall Jr refers to is Chuka Lewis v Asot Michael which was adjourned to September 21, 2020.

Ahead of Monday’s hearing, Marshall Jr tells Walsh “it is no longer appropriate for you now to continue to exercise any judicial function in this matter going forward.

Walsh issued a bench warrant for Michael last week even though he had a letter from his doctor showing that he was ill. Michael’s lawyer argues that the Chief Magistrate had no legal authority to issue the warrant under the circumstances.

In addition, he argues that “your actions undermine the necessary objective perception of the administration of justice as independent and untainted by bias whether conscious or unconscious bias.”

    Sounds like a reasonable request/demand to me, in light of what transpired prior to the adjournment. Every citizen, however loathsome, should be guaranteed maximum protection from bias by presiding officers of the court. I certainly would want that for myself. Wouldn’t you?
