  1. GUNPLAY AT CEMETERY: …GUNMAN GRANTED BAIL…? …LACK OF FAMILIARITY WITH LAW

    PARAGRAPH 4 OF NEWS ITEM

Firearm Ordered Surrendered…? …WHAT THE HELL?

    PROFESSIONAL KNOWLEDGE/EXPERIENCE:

    (i) ‘…The ‘FIREARM’ has become the subject of the ‘…CRIMINAL OFFENCE:

(ii) …It shall be ‘…IMMEDIATELY SEIZED’ by the Investigator/ARRESTING OFFICER:

(iii) ‘…It has become the ‘…EXHIBIT’ to be:

    (a) ‘…TENDERED:

    (b) …ADMITTED: and

    (c) …MARKED’ by the ‘…Adjudicating Magistrate.’

    EVIDENTIALLY

In every ‘…CRIMINAL PROSECUTION’ where its ‘…UNLAFUL/JUSTIFIED USE’is concerned, it is called ‘…REAL EVIDENCE.

    *****

CLEARLY, those’…Lacking Familiarity’ with ‘…AMENDMENTS’ to the ‘…MAGISTRATE’S CODE OF PROCEDURE ACT’ [2004], could find themselves, ‘…EXCEEDING JURISDICTION’ not now residing in the ‘…MAGISTRACY.

    LEGAL/PROCEDURAL BLUNDERS

Moreover, those so found wanting of ‘…LEGAL/PROCEDURAL KNOWLEDGE,’ could make ‘…Legal and Procedural Blunders,’ as they affect ‘the ‘…GRANTING OF BAIL’ for certain ‘…SPECIFIED OFFENCES.”

    FUNERAL GUNMAN GRANTED BAIL

When this sourced bit of news by ‘…ANTIGUA NEWS ROOM,’ states that a ‘…FUNERAL GUNMAN’ was ‘…GRANTED MAGISTERIAL BAIL’ [Paragraph 3] on ‘…CONDITIONALITIES’ that include:

    (a) ‘…The Sum of EC$7, 000: with

    (b) …CASH COMPONENT OF EC$2, 000,’ readers shall know that either:

    (i) ‘…The Magistrate:

(ii) …The Director of Public Prosecutions (DPP): and

(iii) …The POLICE COURT PROSECUTOR,’ appeared not to possess the ‘…REQUISITE KNOWLEDGE’ of ‘AMENDMENTS,’ legislatively made to the ‘…MAGISTRATE’S CODE OF PROCEDURE ACT’ [Section 62: Chapter 255].

    The ‘…ÁMENDMENT’ specifically states:

‘…A Magistrate ‘…SHALL NOT GRANT BAIL’ for the offence of the ‘…UNLAWFUL USE OF FIREARM’ [Section 18: 2004], contrary to the provisions of the ‘…FIREARMS ACT’ [CHAPTER 171].

    POSITIONAL DUMMIES: …JURISDICTIONAL BLUNDER

With no intention of prompting any AGENCY” concerned with this matter, only ‘…POSITIONAL DUMMIES’ may not seek to have this ‘…JURISDICTIONAL BLUNDER’ corrected, soonest.

    WALK GOOD.

  2. Like our PM once quoted, the cemetery must be a lovely place cause people just dying to go there, meanwhile Mr. Ty Thomas volunteering to get them there speedily and tax free.

Wonder if him had extra clips…hmmmm…Wat a ting.

  3. This is both hilarious and sad. When could it ever be serious enough to not only be flinging stones but bussing gun shots at a GRAVEYARD of all places. This entire family needs to be put in time out. (Ty especially you!)

  4. GRAVEYARD BACCHANAL…? …PARAGRAPH ‘5:’ …ANR’S NEWS STORY

    NOW: …FACETIOUS QUESTION

Accepting this ‘…ANR’ news story is correctly written, it shall be …FACETIOUSLY’ asked of the ‘…INVESTIGATING/ARRESTING OFFICERS:’

    ‘…WHAT COMES BEFORE?’

    (a) ‘…The EGG or the CHICKEN?

THEN, as it relates to the ‘…GRAVEYARD BACCHANAL AND CONDUCT OF ATTENDEES:’

    (b) …What ‘SECTION’ comes before in the ‘…SMALL CHARGES ACT’ [Chapter 405]:

    ‘…SECTION 53′ or …SECTION 18?’

OBVIOUSLY, all appeared to have been ‘…STARVED FOR KNOWLEDGE.’

    LAWFUL EXCUSE

Though some ‘…ÁDJUDICATORS’ were often seen as being guided ÓNLY by the ‘…LETTER OF LAW,’ there could be a ‘…DEFENCE’ of ‘…LAWFUL EXCUSE- Quelling the disturbance.’

    NOTE

EUGENE HUMPHREYS ‘…Minister of Helps’ escaped prosecution when the ‘…DISCHARGED AND ASSISTED POLICE’ in ‘…RESTORING ORDER’ at a ‘…MOCK TRIAL’ by the ‘UPP’ at the ‘…BETHESDA TAMARIND TREE’ [2004]. Attorney Sherfield Bowen, then the ‘…JUDGE FOR JUUSTICE,’ may attest.

Truehart SMITH QPM was then the ‘…Commissioner of Police.

  5. My question is can firearm related crime be adjudicated in the magistrate court? Is it because it was a license firearm why it was not sent to the high court? Why is it that a trained law enforcement officer ( immigration officer are in that category) got a hand shake, while the system sent a 2nd former to 1735 and only because of an uproar why he was sent to a more secure confinement- still imprisoned.

  6. @ frankly speaking
It appears as though our justice system has the ability to see.
The people in these positions are not serious in the execution of their duties
If you are going to remand 16 & 17 Year olds to prison awaiting trial, then be consistent do it across the board for everyone.
At least then we can say justice is blind…..

  7. FRANKLY SPEAKING: …HANDSHAKE? OR …MAGISTERIAL JURISDICTIONAL BLUNDER?

From professional knowledge and for the ‘…Benefit of Knowledge,’ the offence charged, it is within the ‘…Jurisdiction of Magistrates,’ but for:

    (a) ‘…SUMMARY TRIAL ONLY:

    (b) …In respect to ‘…GRANTING BAIL,’ this is ‘…OUTSIDE OF MAGISTERIAL JURISDICTION.’

    JURISDICTION FOR BAIL

The ‘…Jurisdiction for Bail,’ resides ‘…ONLY IN JUDGES OF THE HIGH COURT OF JUSTICE.’

Though ‘…INEXCUSABLE,’ still to ‘…ERR IS HUMAN.’

    APPEAL RESIDES IN DPP

In the current questionable ‘…COURT DECISION’ in ‘…GRANTING BAIL,’ an ‘…APPEAL RESIDES’ IN THE OFFICE OF DPP.’

Those lacking ‘…TESTICULAR/VAGINAL FORTITUDE,’ may not wish to have the ‘…MAGISTERIAL JURISDICTIONAL BLUNDER,’ corrected.
