How can four persons be charged, jointly or not for possession of one fire arm and ammunition or is there something I missed??
@Stone: Yes, you are missing something. If after the interdiction and the firearm was found in or, near about the vicinity of the vessel; and no one claimed ownership or, was directly in possession. Then a joint ownership charge can be infer, and be preferred: as in the case of a joint enterprises or, conspiracy to be involve or, engaged- as with racketeering consortium. Thus, be mindful of the company you keep.
The gun was found on vessel. There is a strong probability every one on that vessel knows about it. Of course, chances are it belongs to only one. But generally safest thing to do is charge them all and let the courts decides.
If gun found in a bedroom, only who has asses to that bedroom will be charged.
Gun found in living room, everyone in house can be charged.
I witnessed a case in court like 20 years ago that shows why police usually charge all.
Here goes: Police stop a taxi at a road block. Taxi had one passenger in front seat. Drugs were found in bag on back seat. When asked, driver took responsibility for drugs and said that the passenger knows nothing about the drugs and he just got a job to take the tourist lady to the Airport. Police let lady passenger free and charged the driver. Acting as his own lawyer at trial, driver said “I do not know nothing about no drugs. All I know is that I got a job to take person to airport, and I helped her put bags in car. I am not gonna ask her about contents of bag or search bags. And the Police lock me up and set her free.
Case was dismissed
So, charge all, and if one wants to take all the responsibility, let him do so before a judge and jury
If none is admitting that the firearm is theirs what should the police do?
It’s not the police job to do something it’s the court . In antigua we are so foolish one man get one year for 3 firearm an admonition an the law clearly said 12 months for one firearm . Aman house was search an was found with documents of passport an nearly ten years noting them still a see how them can make the man walk free
