Following finding against Chief Magistrate Walsh agrees to retire, Gov’t agrees to full benefits package

Source- Real News Antigua: Chief Magistrate Joanne Walsh reportedly is back in the good graces of the Browne Administration, which, allegedly, has accepted her retirement from the post and agreed to a benefits package – that is,
full gratuity and pension.

A finding against Walsh for 15 disciplinary charges by a tribunal appointed by the Judicial and Legal Services Commission; and her removal from the bench reportedly was recommended to Governor-General Sir Rodney Williams.

Before the disciplinary trial commenced, sources say that Walsh was advised to tender her retirement letter and, in doing so, receive her full benefits. But at the time, the sources say, she rejected the offer, declaring that she wished to clear her name.

However, after being informed that she had been found guilty of all the charges, the sources claim that Walsh quickly submitted her retirement letter to the Government, thus safeguarding her benefits package.

Walsh served as chief magistrate for a little less than 20 years, reports say, and there is speculation that Attorney-General Sir Steadroy Benjamin will find other employment for her.

Meanwhile, some of Walsh’s colleagues and others in law enforcement are not happy about what they call her “sweet deal.”

    This is how it works? You are found guilty and then you retire and get benefits?

    Shouldn’t it have been, retire first?

    This country and this government are so corrupt (in my opinion).

      (i) ‘…It is not a ‘FACT’ that the ‘Chief Magistrate’ was ‘…Found Guilty.’
      This is the term used for ‘…Criminal Trials.’

      (ii) …In the ‘Disciplinary Tribunal,’ the ‘Charges,’ whatever they were, had been reportedly
      PROVED?:

      (iii) …This would have been communicated to the ‘CM:’

      (iv) …The Tribunal had not considered ‘PUNISHMENT,’ which shall have been communicated
      to the tried Magistrate:

      (v) …Since it is a matter that may compromise ‘Public Trust,’ such ‘Punishment,’ most likely may have been a ‘…Recommendation for ‘…Removal from the Magistracy: and

      (vi) …Sent to the ‘Governor General,’ His Excellency was bound by Law to so remove.’

      The case of former ‘.Antigua and Barbuda Electoral Commission (ABEC)’ member LIONEL ‘MAX’ HURST’ makes the point.

      In the instant case, procedurally, it appear that:

      (a) ‘…No Punishment has been imposed:
      (b) …No Recommendation/s were sent to the Governor General,’ by the ‘…Judicial and
      Legal Services Commission (JLSC)’ that authoritatively:

      (i) ‘…Initiated the ‘Disciplinary actions and proceedings: and

      (ii) …In position to impose such punishment.’

      TEMPERING JUSTICE WITH MERCY

      Thus, reasonable inferences may be drawn, that the ‘JLS,’ has ‘…Tempered
      Justice with Mercy.’

      In the circumstances, who will not accept ‘Mercy?’

      That being the case, nothing will be put to the ‘…Governor General,’

      It is likened to the ‘DPP’ withdrawing ‘…an Indictment, before a ‘Judgment’ was handed down by the Court, even at half-way in a trial.

      WHAT THE HELL THE POLICE WHO ARRESTED THE ACCUSED CAN DO?’ Absolutely nothing.

      Though the debate may rage, the ‘Bridge’ (not the one for the Devil), has been crossed.

  4. Are there no penalties for a Magistrate, who’s found guilty of a crimes?
    There should be a thorough review, of ALL of the cases which she adjudicated on. PERIOD!

    Everyone who was found guilty and was convicted by this Magistrate should do whatever possible, to have their cases retried, based upon the findings against her.

    Only the #BRAND_NAMES which are referred to, as god/satan and their subsidiaries will make money from this type of behaviour!

    People in high places get caught with the most serious of crimes and they have a back door meeting and everything is cool.

    Just go home and enjoy your pay.

  6. How many persons who infringed on the COVID curfew by mere minutes were fined thousands of dollars by this magistrate who really ought to have known that 500 dollars was the maximum she could legally impose? Did they ever get their money back when this was exposed?
    Antiguan taxpayers can rest assured that the extra dollars they will be forking out for 17% ABST will contribute to funding a life of comfort and leisure for the disgraced former chief Magistrate.

    How absolutely appalling.

    300,000 Canadians have signed a petition calling for a parliamentary vote of no confidence in their current government with a view to forcing a general election. Antiguans should start their own petition and take their best shot at ousting this manifestly corrupt and inept administration.

  7. Try not to lose focus here. The lady knows a lot of stuff that some high ups do not want exposed. The offer she received must have been very lucrative. I agree she should have taken it.

    This is Antigua. Things will not be changed overnight. We have no real freedom fighters to make that happen. Until change comes, lady, ride off in the sunset and enjoy your windfall.

    Someone else will finally expose what she was paid so handsomely not to expose. For free.

  8. Jo-Ann Walsh was appointed as Chief Magistrate in 2011. Where did this 20 years come from? Now. Although I want to feel as though this whole post must be a joke let me take it seriously. The government of Antigua and Barbuda needs to be rioted against. How is it that this woman was found to be in the wrong for all the charges brought against her and the government has not launch an investigation to look further into all the fraud that has happened at her hands. What about the hundreds of thousands dollars (1000 per person per month being paid) in the traffic court the records are at the government treasury her signature and another senior officer signature on all of them, what about the petrol that was being stolen from the motor pool the gas order books show all the gas collected in containers and the staff has seen them being loaded into personal vehicles, what about the 10% being taken from the payment of child maintenance to mothers for the execution of a warrants, what about the thousand dollars being charged for the typing of liquor licenses? If I keep listing I will need to type three comments. Instead the government is rewarding the person who has contributed to its inability to find funds to pay civil servants back pay and increases by being her sugar daddy. This whole post is enraging to say the least they might as well have sponsored a world cruise and thrown in a time share for good measure. I hope that the next civil servant who steals from the government and destroys its records will be giving the full package. This case has set the precedent. Civil servants should go to work tomorrow and carry home everything that is not nailed down. At least they will get a sweet deal to.

  10. To be clear, her retirement with full pension and benefits is pretty standard WORLD WIDE. This is not a practice unique to Antigua and Barbuda in anyway. Is it morally correct? No! Is it legal? I’m afraid it is under the circumstances. Anyone familiar with the racially motivated murder of Stephen Lawrence in the UK in 1993 will know it was the subject of a botched investigation under the watch of Sir, Barron Paul Condon who was the then Commissioner of the metropolitan police. Irrespective of a very full and thorough public inquiry confirming the incompetence of him and his staff and the institutional racism that is rampant in the Met… He was retired on full salary and later given the further title of Barron. Please do not make Antigua & Barbuda or our government (whichever administration is in) to be more or less corrupt or morally bankrupt than any other. Sadly, this is how governments work all over the world people. Those of us living in the real world understand this. Wake up my people and see beyond the colours.
