Legal Battle For Alfa Nero Continues with Constitutional Claim

The Court of Appeal rejected Yulia Gurieva-Motlokhov’s appeal against Justice Rene Williams’ decision to deny an injunction preventing the sale of the Alfa Nero vessel.

Despite the setback, Dr. David Dorsett, representing Gurieva-Motlokhov, remains confident in the ongoing constitutional claim in Antiguan courts.

Dorsett asserts that the vessel, owned by a trust, was never abandoned, challenging claims made by the Antigua and Barbuda Attorney General and Port Manager Darwin Telemaque.

Dorsett finds Telemaque’s arguments for seizure, including environmental concerns, embarrassing, noting conflicting statements about the vessel’s condition.

He argues that the government’s refusal to engage with the owner prior to auction led to the current situation.

The legal team plans to continue advocating for the rightful owner, challenging the constitutional validity of the Port Authority (Amendment) Act.

Dorsett mentions the Court of Appeal’s recognition of a viable case against the act and contemplates appealing to the Privy Council.

Government legal team, including Anthony Astaphan, pleased with recent Alfa Nero case judgment. Court dismissed Yulia Gurieva-Motlokhov’s appeal for an injunction.

Previous rulings consistently favored the government.

Astaphan emphasizes commitment to advising on next steps after analyzing the judgment. Case involves government’s acquisition of Alfa Nero superyacht, abandoned for over a year.

Despite covering $28,000 weekly expenses, legal disputes persist, with Yulia Guryeva-Motlokhov claiming ownership as the daughter of Russian oligarch Andrey Guryev. Former Google CEO Eric Schmidt withdrew from a $67.6 million purchase due to ongoing ownership disputes.

    I am still waiting to hear that these girls get a national award & perhaps the men too who all risked their lives to place Antigua on the map..

    I can’t understand why Flagman got a national award by just showcasing a flag at various local functions…….. Ofcourse I am not saying that he does not deserve some form of accolade perhaps from one of the Gov’t ministries but certainly, I am sorry to say that he did not deserve a national award.

  3. Interesting outcome to date… not surprised for one reason.
    When I saw Dorsett at the Privy Council hearing recently, he came across like a tumbling bumbling idiot. A sorrowful example of the quality of lawyering offered in Antigua and Barbuda

  4. Too bad Schmidt just earlier this week invested his $65 million into an AI company in France, that was earmarked for the Alpha Nero.

    BTW: There is over $10 million in art work in the boat. If the local kleptomaniacs MPs have not relocated them to their homes as personal property
    They should be auctioned separately bringing in another $10 to $12 million dollars

  5. This is theft. Lawlessness. The politicians couldn’t pass up the opportunity for free money. International sanctions, my ass. Rather than steal their boat the government should have charged the owners a hefty fee for maintenance and moorage. Then if they couldn’t or wouldn’t pay seize and sell the boat for recovery of said fees.
