Court Adjourns Beach Access Case; Trial Set for December if Dismissal Fails

The Magistrates’ Court has adjourned a case involving citizens charged after going to the beach, leaving the matter to be resolved in the coming months.

Defense attorney Sherfiel Bowen told George Wehner outside the courthouse Thursday that he filed an application to have the charges dismissed, arguing that the case was defective on 16 grounds. The court will hear oral arguments on the application on November 6, with the prosecution expected to respond by October 23.

“If my application prevails, and I’m very confident that it will, it will be the end of the matter,” Boeing said. If the bid fails, a trial is scheduled for December 15.

The attorney added that even if the case proceeds, it could provide a valuable public discussion. “Access to a beach is one of the fundamental rights of Antigua,” he said, suggesting that a trial might help clarify that right.

Opposition members were also present at the courthouse, declaring solidarity with the defendants and reaffirming his party’s position. “We have to continue to fight for access to our beaches,” he said, vowing to ensure that public entry remains protected and visible.

  2. Throw the damn case out! Not worth the unmerited publicity given to those UPP rebels WITHOUT a cause! Every Antiguan and Barbudan knows that ALL beaches are the inalienable PROPERTY of theirs. We don’t need a ruthless, power-hungry Opposition party to goad us into breaking the law in a pretentious passion to “uphold” another. Leave the criminals to continue to wallow in their criminal activities!

  3. They heard what sounded like a firecracker. Shortly thereafter, Constable Charles went towards his vehicle which was parked in the vicinity of Bowen’s office. He saw Bowen sitting on the steps of the building which housed his office. He saw Ms. Barthley lying on the ground not far from his motor car.
