Community Activist Mary John Calls for Deportation of Berle Wallace Jr. Following Court Acquittal and Immigration Concerns

Community activist Mary John has called for the deportation of Berle Wallace Jr. to the Commonwealth of Dominica following his acquittal in court on 5 February 2025.

In a passionate post shared on social media, John expressed her frustration with Wallace’s legal outcome and highlighted concerns about his immigration status.

Wallace, who was accused in the fatal stabbing of Chris Smithers, walked free after the trial ended unexpectedly when his defence lawyer, Wendell Alexander, filed a No Case Submission after the prosecution rested its case.

John clarified that Wallace was not acquitted on the grounds of self-defence, as many have incorrectly claimed.

Instead, she explained that the judge ruled in favour of the defence, agreeing that the prosecution had failed to prove that Wallace had inflicted the fatal stab wound or left the knife in the victim’s body.

Mary John said, “Despite the court ruling, my focus now shifts to Wallace’s immigration status. He is a native of the Commonwealth of Dominica and was previously deported from the U.S. Virgin Islands before migrating to Antigua.

I am now calling on local authorities, including Steadroy Benjamin, Katrina Yearwood, and Immigration Enforcement, to take immediate action and deport Wallace back to the Commonwealth of Dominica.”

“Let’s see how many will join me in demanding the deportation of Wallace,” John said. “This is not just about his court case, but ensuring that justice is served in all aspects.”

John urged the public to hold local authorities accountable for addressing the case beyond the courtroom and to consider the broader implications of Wallace’s continued presence in Antigua.

The call for action on Wallace’s deportation comes after a tense trial and a growing demand from the community for accountability on both legal and immigration fronts.

As the case continues to stir debate, John’s appeal for deportation to the Commonwealth of Dominica has added a new dimension to the ongoing discussions.

  2. An equally important issue is the defence attorney successfully challenge the state on the basis that the prosecution had failed to prove that Wallace had inflicted the fatal stab wound or left the knife in the victim’s body.
    Another case that demonstrates the high level of incompetence under Cutie Benjamin’s watch.
    Browne, Benjamin and the Solicitor General need to leave Barbuda alone and bring a level of competence to the criminal Justice system in Antigua

  3. So Mary is telling immigration to go against the treaty that the oecs countries sign cuz she clearly say it’s not about d court case so we can’t say he committed a crime base on her article so wats d reasons for deportation then

    (iii) …THE ACCUSED WAS ‘…DISCHARGED,’ SIMPLY BECAUSE THE ‘DPP’ WHO ‘…PROSECUTED ON BEHALF OF GENERAL PUBLIC,’ THROUGH A CROWN COUNSEL, COMPETENT OR INCOMPETENT, COULD NOT ‘…ESTABLISH A PRIMA FACIE CASE:

    (iv) …THE CASE HAD NOT GONE THROUGH A FULL TRIAL WITH (a) ‘THE PROSECUTION: and (b) … THE DEFENCE/ACCUSED HIMSELF.’

    NOW:

  6. I pray for all you Antiguan’s. I have read about Nathaniel Wallace and his violent past. Not just there in Antigua but also in Dominica. He will end up taking another loved one.
    Deport him so he doesn’t hurt anymore women or men in Antigua

All I have to say is some of you’ll people are too bias, if it was your family member you wouldn’t be running your mouth… they are a lot of guilty people that got accused of doing stuff but didn’t get the full extent of the law because of who there family are and there connections… Albert Einstein one said the world would be destroyed, not by those who do evil, but by those who watch and do nothing… don’t pick choose .. the man got off on a technicality that is how the law works, we had a sex ring going on here in antigua and nobody went to jail .. remember that folks …

  8. It is worrying, the accused was deported from the Virgin Islands, but Antigua’s broken immigration services welcomed him. The outcome he murdered an Antiguan on our soil and the incompetent legal services set him free! What madness is that?

    I wholeheartedly support Mary’s application for the deportation of the murder and the immigration services should be held accountable for allowing him into the country. He has repeatedly demonstrated that he’s not a person of good character, and therefore he should be removed from the state. Antiguans should unite irrespective of political persuasion and put the interests of our homeland first and get him out of Antigua permanently.

  9. Smithers received his citizenship that day and celebrated for hours with friends on Popeshead Street. You say smitty throw the first punch, how can it be considered self-defense when the accused left the scene, returned with a knife, and stabbed Smithers in the back without him noticing? This act was premeditated and cold-blooded murder. Many people are aware of this narrative.

    Also interesting that Wallace had no visible injuries when he surrendered. There was no punch thrown. The eyewitness were incarcerated alongside Wallace, so they likely concocted their story together. From day one, news articles from 2022 never claimed that Chris threw the first punch. It’s strange how the narrative has shifted.

  10. @ CountryMan Abroad, remember that the prosecutor can only be as good as the materials they have to work with. I say this to say, how do we know that it was a case where the investigation came up short? If the investigation is lacking, the prosecutor’s hands are tied

  11. Look up janine smithers on facebook how come the police report says Chris didn’t proke nathaniel. But when he talk to his lawyers he changed his story.

  12. If he has a violent past in jurisdictions, he needs to be deported from Antigua and Barbuda. We have our own problems and treaty or not it is high time that we stop letting criminals from other countries settle here.
