Appeals Court Upholds Judgement in Favour Of D. Gisele Isaac

The Eastern Caribbean Supreme Court (ECSC) today upheld a decision of the Industrial Court in a matter involving the former Executive Secretary of the Board of Education D. Gisele Isaac.

The Court of Appeal held that Isaac was an employee of the Board of Education and not of the Cabinet.

As a result of this finding the Industrial Court can now to hear her case regarding her severance and unfair dismissal for 13.5 years of service to the Board of Education.

This preliminary point had stalled the hearing of the substantive case, brought in February 2015, in which Isaac was seeking compensation – by way of severance and other costs – for her constructive dismissal.

The judgement was handed down this morning via Zoom by Justices Mario Michel and Sidney Bennett, owing the COVID-19 pandemic.

Isaac is being represented in the matter by former Justin Simon, QC.
