Antiguan Government Dismisses Lawsuit by Dominican Businessman Challenging Arrest and Release

The Antiguan and Barbudan government is dismissing a lawsuit filed by a prominent Dominican businessman challenging his arrest and subsequent release in Antigua.

According to Lionel Max Hurst, the government’s Chief of Staff, the claims lack merit and would not hold up in court.

The lawsuit names Antigua and Barbuda’s Attorney General, Steadroy Benjamin, and Commissioner of Police, Atlee Rodnev, as defendants.

The businessman, Dowlin Alexander, who was detained in Antigua last week, is represented by Wendel Robinson. The lawsuit seeks damages for false imprisonment, wrongful arrest, and violation of freedom of movement.

Alexander’s attorney filed a Writ of Habeas Corpus and a constitutional motion, arguing that his client’s arrest was arbitrary and violated his rights.

However, Hurst asserts that Antigua and Barbuda has the authority to determine who can be considered persona non grata, citing previous experiences.

Alexander was promptly returned to Dominica after his arrival, and Hurst claims that this decision cannot be challenged in court, absolving Antigua and Barbuda of any liability.

In his sworn affidavit, Alexander describes being taken back to the immigration department by an unidentified individual after clearing immigration, where he overheard mention of a Red Notice.

He was then transported to the Criminal Investigations Department in St. Johns and held in custody.

  1. Persona non grata is an exclusive right that Cabinet has. And this right had been exercised and in past. But even where a person is deemed persona non grata does not make the police action correct. I will say no more. ..

Those questions were for laughter only.There is a Lawyer in Antigua.He did say,many young Lawyers do not know the Laws.Until he who knew everything supposedly,had to eat his words.I am now wondering how he feels eating,CROW.

  2. This position is reckless and should not have been made public.

    The government should settle this matter, if not it the repercussions will be great.

    Lawyers will be in line to claim for damages caused by inhumane treatment at SJPS.

    Which may speill over to the prison. The cost of constructing a new prison because of a litany of law suits is possible.

    Settle the matter do not allow the court to adjudicate on it.

    • He came in on the evening of the 6th of July and was detained until he left on the 8th July, slept one night at stJohns police station and part of the other night too and then immigration took over…slept at immigration control dorms at Navy Base where Alex is housed…

  6. Mr. Wendell if someone enters Antigua and we disallow them entry, what is the next step? Shouldn’t that person be deported immediately? Next question- what if we do not have any flights out , since LIAT is no more? What if they took him directly to the immigration holding area awaiting the next available flight out ? Will that be deemed as an arrest.
    I am just seeking some clarification from you Sir. You seems to be the only attorney in Antigua that is working hard and studying and applying the law these days.

    • The answers to the questions you asked would all be legal.
      Reread the story he cleared Immigration and a police officer arrested him at customs and took him to CID for processing. Immigration does not seem to feature under this situation.

      The man was in police custody not Immigration.

      The government should move swiftly to settle this matter. The OECS free movement is another violation.

  8. A judge ruled that LieNoHell is not credible. Cabinet cannot dismiss a case. What idiots do they think we are? Did this clown not say a lot of other things that are just blatant lies.
