
In its decision delivered on September 17th 2025, the Eastern Caribbean Court of Appeal dismissed an appeal against the decision of Justice Nicola Byer in a civil defamation case filed by Vere Bird III against Prime Minister Gaston Browne.
In the decision of Justice Byer dated 27th April 2023, the High Court ruled that the Prime Minister’s statements that Vere Bird III benefitted from an illegitimate cabinet decision to sell him Crown lands at a rate reserved for parliamentarians, was true, justified, and fair comment.
Mr. Bird sought to sue the Prime Minister on the grounds of defamation, alleging that he never actually received the lands, and that the cabinet decision was legitimate. Being dissatisfied with Justice Byer’s ruling, Mr. Bird appealed Her Ladyship’s judgment on sixteen grounds.
All sixteen grounds of appeal were dismissed unanimously by the Court of Appeal on Wednesday, September 17th 2025, and Justice Byer’s ruling was affirmed.”
Costs were awarded to Mr. Browne by the High Court and the Appeals Court. The amounts are currently being assessed.

The people has the right to call out any political leader for not doing their jobs.
So Gatson Browne, here is a lesson to you. When some accused you of wrong doing, take it and bite it as well..it’s called freedom of expression to air out ones frustration with any government.
So don’t be a hypocrite.. what goes for you, goes for all.if you can throw stones, other can throw them as well. Simple.

Why would anyone in their right mind try to take on Gaston Browne whilst he’s in office as Prime Minister on litigation issues?
This man can call on and locate those who are in high profile positions for legal advice and strategic manoeuvres against ANY opponent who just doesn’t have the same sort of clout or wherewithal. Tarl!

Boy, feelings can cost real money. Sometimes you may feel it’s a good idea to file a case or to stand up and pursue further action. But really and truly it may be best to just let this one slide.
From the looks at it, it doesn’t seem that it was a good idea to push the issue based on principle. Mr. Bird should have just fly away and hold on to his money in the earlier stages of fight.
Now he will have pay a substantial amount for how he feels about someone and thier comments.
In these times, paying out uncalled for money really hurts. I’m sure
Justice has spoken. This shows that even powerful names like Bird are not above accountability. The court made the right call.

This is a win for truth. If what was said was fair and justified, then it should not be silenced under the guise of defamation

He really should have accepted the High Court’s decision instead of wasting more time and money.
It seems like defamation laws don’t really protect reputations anymore. Anyone can say something damaging and hide behind ‘fair comment
