US Judge Grants Temporary Stay on Subpoenas for Antigua’s Prime Minister, WIOC and others

A US federal judge has granted a temporary stay on subpoenas issued to Antigua and Barbuda’s Prime Minister Gaston Browne, West Indies Oil Company Ltd. (WIOC), and others linked to an ongoing discovery matter initiated by Russian national Yulia Guryeva-Motlokhov.

In a ruling issued on Monday, Judge Jesse M. Furman of the Southern District of New York confirmed that the subpoenas will not be enforced while motions to quash them are being considered. The stay applies to both Browne and the group identified as the “Antiguan Movants,” as well as to WIOC, a non-party in the case.

Guryeva-Motlokhov is seeking access to documents and information under 28 U.S.C. § 1782, a statute that allows individuals to obtain evidence in the United States for use in foreign legal proceedings. The subpoenas have prompted legal resistance from both the Antiguan officials and WIOC.

Judge Furman stated that the stay was necessary because complying with the subpoenas could undermine the pending motions to quash. The applicant, Guryeva-Motlokhov, has until 21 April to file a written opposition—limited to four pages—if she believes the stay should be lifted.

The court also directed that one consolidated legal brief be filed in opposition to both motions to quash.

  1. Ok ANR I know ALP is the owner of this online newspaper, the court put the subpoena in abeyance while they challenge personal documents in court.

  2. It appears that this vessel was hidden in English harbour to avoid being seized by the United States. It was abandoned and in order to safeguard this multimillion dollar asset and avoid environmental damage to Antigua/Barbuda’s seas the Goverment stepped in and incurred significant costs in so doing.
    After the sanctions were lifted, the oligarchs stepped back into the picture to claim the vessel. White humans don’t play where their wealth is concerned. They will stop at nothing to keep their wealth. That’s why President Trump will side with President Putin against his own people in the United States despite being elected by them. These humans are oligarchs and will stop at nothing to preserve their “wealth”. Our PM knew that and besides that it was unfair for our country to preserve this multimillion dollar asset, incur all this costs and receive not a penny in return. Oligarchs don’t play where their money is concerned. But according to the elders “head make book” not the other way around.
    And so we are where we are. I do not support the Gaston Browne administration because I worked with him for years. His natural intelligence, his struggles as a child with a mentally in mother having to literally support himself, relying on the Bank to provide him a scholarship to further his studies and emerging with his degree in banking and finance, taking over the leadership of the party. His heroe is the father of the Nation and when he took over the leadership of the party, he United the party instead of dividing it. I can go on and on. Let us support our leader and country in the fight against might is right.

  5. Come on. Simple. You used an advantage to grab something that was not yours. In the process certain Antiguans were enriched with ridiculous payments for “upkeep” and hopefully the US court will ferret out the rest of the theft. I am sure the Antiguan courts will not.

    It all comes out in the wash and unfortunately the poor people, the rank and file will suffer while the politicos will run with their money.

    In two years, this Government has been involved in so many mischief, that the public can’t even keep up.

    So sit there and think that this is some great victory for your ALP, because this thing is far from over.

  8. The wood worms are finally emerging and spewing garbage. The issue here isn’t whether the vessel should have been sold but how much it was eventually sold for. You lackeys have been given your scripts after the TEN MILLION U.S DOLLAR MAN was unable to convince the populace into believing his lies. We are going to learn about more than the Alfa Nero and that’s what’s creating fear in the camp.

  9. @sharon patriot lynch: please don’t let the world know that you are not tech savvy, even your cell phone has on a satellite beacon that shows every place you have been, check your phone and it will show you all the places you travel daily, even a common generator now has gps location security that if you buy it for your property and set it up and move it to another property you have it won’t start which is a guard against theft, now the alpha Nero has many satellites transponder and devises that always functioning by satellite beacon navigation and you say it was hidden? It’s not the old wooden fishing boat you see our fishermen oaring out to sea. Don’t make our people look semi illiterate. That alpha Nero can’t move unless satellite show the water depths and wind speed weather etc, and it get it’s daily satellite correspondence, why do you think the American know it’ was in Antigua? They saw all the ships in the world on satellite with their frequency signature.

Folks, normal procedure, an interim “stay” is nearly always granted until the court decide such application, since you can not let people unsee or un-copy releases files, which is highly likely to result in irreparable harms to the party (ABLP, PM Browne, PM Browne’s family, and other defendants).

    This is not considered a win but simply procedural law taking place. The defendants could start celebrating when the judge vacate the order granting the subpoena. Here, the judge said it needs time to decide this and for that reason is putting a stop “stay” for now.

    Do I think the plaintiff, Russian, is likely to win? Or do I think PM Browne is likely to win? Keep watching for more from my way of helping

Your ranting reminds me of your notion that you are entitled to a gun license and since you can’t get your way, you turn on the party you claim you support.   14. It’s a “stay” not a “reprieve.”
    @My way of helping, you are 100% correct. Allowing the subpoenas to take effect, prior to the defendants motions to quash the subpoenas could prejudice the defendants when the case goes trial. Quashing a subpoena regarding’discovery, does not stop the defendants from been sued.
    The subpoenas were granted based on upon the evidence’s provided to the Court by the Russians legal team. There had to have been enough reasons for the subpoenas to have been issued. Similarly a Judge will issue a search warrant in a criminal investigation, if the investigators show, probable cause(fingerprint, DNA, electronic tracking to social media posts, eyewitness testimony etc.).
    All of the transactions from the very first auction, Schmitt’s withdrawal after he won the first bid, then the dispute between the second highest bidder and the Government were all thoroughly monitored by the Russians.
    This is far from over. Less We Forget too, Alfa Nero cases are still ongoing in the Caribbean and could end up at the Privy Council.
