Regulator partly liable in workplace injury case

A High Court judge has ruled that the Financial Services Regulatory Commission (FSRC) was partly negligent in a case brought by one of its long-serving employees.

Sherry Ann Thomas, who has worked at the FSRC for more than a decade, claimed back injuries from two separate incidents.

Justice Nicola Byer found the regulator responsible for a 2020 accident in which Thomas hurt her back while opening a filing cabinet, but dismissed a later claim that she slipped on water near her desk. CLICK HERE TO JOIN OUR WHAT’S APP GROUP

The court heard that despite moving to electronic record-keeping in 2016, staff in the Insurance Department continued to rely heavily on filing cabinets. Justice Byer said the FSRC had failed to take reasonable steps to reduce the risks associated with their use.

On the second claim, the judge accepted evidence that any water on the floor was minor and ruled that occasional slips were “a normal incident of life”.

Thomas has 45 days to apply for damages. Costs will be shared, with the employee recovering some expenses but covering half of the FSRC’s legal fees linked to the dismissed claim.

  1. Hurting back while opening a filing cabinet???…. Then slipping of water some other time???…

    So, the court’s ruling is that basically all employees should be provided with back brace etc. while handling dangerous and risky equipment like a filing cabinet?

  2. FSRC shame bad fu dis one. How you ah big government regulator but can’t even regulate ya own workplace? From since 2016 dem know everything gone digital, yet dem still have people bend down inna old filing cabinet like is the 1980s. Now staff get injure and court haffi tell dem dem wrong

  3. The FSRC really doesn’t come out looking good here. This case exposes a culture of neglect within the institution….an organization that is supposed to regulate others but apparently struggles to regulate itself.

  4. So if i understand this .. the employee injured themselves pulling files from the filing cabinet? So next we will be ruling that employee’s who build houses have occupational hazards because they have to lift blocks and bags of cement/

  5. For years they’ve known that most of their operations had gone digital, yet they still kept employees tied to outdated, heavy filing cabinets without putting proper safety measures in place.
