Mother’s Prison Death Lawsuit to Proceed After Court Rejects Government’s Dismissal Attempt
The High Court in Antigua and Barbuda has ruled that a lawsuit filed by Sheryl Inigo Joseph over her son’s 2018 death in prison custody can proceed to trial, rejecting the Attorney General’s bid to have the case thrown out.
On May 9, 2025, Justice Michel dismissed arguments to strike out Joseph’s claim, citing the serious nature of the allegations and the need for proper judicial scrutiny.
Joseph is suing for negligence, breach of statutory duty, and misfeasance in public office after her son, Cordayro Joseph, reportedly died by suicide at His Majesty’s Prisons.
She alleges authorities failed to provide information about his death and that the coroner did not initiate a mandatory inquest under the Coroner’s Act.
The Attorney General had not filed a defense but instead sought to dismiss the case entirely.
Joseph is represented by attorney Wendel Alexander; Deputy Solicitor General Carla Brookes-Harris represents the Attorney General.
Justice Michel ruled the case must be heard on its merits, emphasizing that such claims “regarding a death in state custody” require full examination.

This could finally expose some of the real issues inside the prison system.
How many more people have to suffer before conditions change?
Me proud ah dat judge. Show say poor people still have voice in de court.
This is a big win for accountability. It is a huge plus and advantage for his family as well as the family of the young man who was allegedly killed in prison recently. I just hope that the prison authorities are taking steps to ensure that these things do not happen anymore to prisoners in their care. Ultimately, these issues might costs tax payers huge sums of money.
Kudos to the judge! The instructions from the judge was very profound & impartial.
Many persons have become victims of injustice & not given any accountability for their love ones who have experienced tragic incidents at these public institutions such as the police force and hospital due to negligence, breach of statutory duties, and misfeasance in public office. Many cases have been pushed under the carpet leaving the family members & victim to live with the pain & agony for the rest of their life.
