Man on Trial Over Alleged Sexual Offence Involving Woman with Intellectual Disability

A man is on trial before Justice Rajiv Persaud and a nine-member jury on a charge of having sexual intercourse in February 2022 with a woman described under the Sexual Offences Act 1995 as “mentally subnormal.”

The complainant’s mother told the court her daughter has required constant care since birth, has difficulty speaking and attended a special needs school until age 20. She said the accused became a frequent visitor to their home in late 2021.

The mother testified that after returning from her husband’s funeral in early 2022, she fell asleep while the accused and her daughter were in the house. She later said the accused expressed interest in a relationship with her daughter, which she rejected.

The matter came to light after a medical visit revealed the woman was pregnant. The mother said she reported the discovery to police.

During cross-examination, defence attorney Sherfield Bowen questioned the complainant’s level of functioning and highlighted differences between the mother’s testimony and her earlier police statement.

The trial continues.
