Following sale of Alfa Nero, Appeal Court will consider application for judicial review; O’Kola notified on Friday

SOURCE: REAL NEWS – While the Eastern Caribbean Supreme Court of Appeal has rejected an emergency injunction that would have prevented the sale of the Alfa Nero superyacht this morning, June 16, the Court will be considering an application for leave to appeal.

 

In addition, consideration might be given, alternatively, for leave to apply for judicial review on other grounds.

 

Therefore, the Court adjourned the matter, which will be heard on a date to be fixed by the Chief Registrar.

 

Andrew O’Kola, the attorney representing the parties challenging the Government’s ownership of the vessel, reportedly was notified of the Appeal Court’s decision by way of a notice received at 10:11 a.m.

Friday morning. Meanwhile, Deputy Chief Registrar Danielia Chambers says the formal order will be circulated to all parties.

 

However, in the interest of time, it was dealt with by quick notice, since the sale of the yacht was set for 10 a.m. at the Treasury Department.

 

The application filed by O’Kola on behalf of Flying Dutchman Overseas Limited, et al, against the Antigua Port Authority, et al was determined by the Court on paper.There are reports of a second, pending application for an injunction.

 

However, so far, those reports have not been confirmed nor elaborated upon.

 

In the meantime, some residents are expressing the opinion that selling the yacht before the pending court cases are resolved could have a disastrous outcome.

 

The bid on the disputed vessel has been won by an American, Eric Schmidt, reportedly a former chief executive officer of Google and a software engineer.

 

He offered US$67.6 million for the yacht, with the second-highest bid coming in at US$66 million.

 

Port Manager Darwin Telemaque is hoping that, once the Government receives payment within seven days, the new owner will remove the vessel from Falmouth Harbour as soon as is practical.

Several residents tell REAL News they are tired of this matter and are also fearful of retaliatory action.

Accordingly, for safety sake, they want the vessel gone from this country in the shortest possible time.

  1. How many months the yatch was in Antigua and no body claimed it. Even when the period was given for owners to claim, pending sale, these parties did not come forward. Now the Antigua government worked hard to lift the sanctions they now want to make claim.
    No body fearful of any white mafioso. If they had legit ownership and papers they would filed long time with US authorities to release the ship. It they want the painting buy it back from the new owner.

    • Deception and propaganda.

      The government knows the vessel must have an owner.
      The government also knows who that owner is.
      Did the government contact the owner?

      Did the government seek assistance to contact the registered owner?

      If after the fact the owners shows up, what is the right thing to do?

      Why is the government fighting the owner of the vessel to huff it and sell it?

      Why the government did not file a lawsuit against the owner for damages to the port and outstanding fees? Then allow the court to sell assets of the owner to settle judgement.

      There are at least 14 vessels decaying at CAMP BLIZZARD that was confiscated during drug interdiction and the government did not action any of them as a matter of fact most are are in a state of hazardous Robin.

      I guess you think it is ok for Gaston’s government to steal and sell people’s property. Would anyone walk away from an over $100 million yacht? This government is too arrogant and think they can find judges to give them what they want. They spread propaganda that the vessel was an environmental hazard now the port manager is saying that the vessel is in good shape and may stay in Antigua. These are crooks and liars but I doubt the government will get away with this.

  3. 1…The USA has place sanctions on Venezuela, since, 2014. To date, have Antigua, Barbuda & REDONDA confiscated any Venezuelan(S) assets and sold them at public auction?

    2…There are many companies, such as YIDA and I’m sure there are some which are USA based, that have and are still destroying our environment, therefore, why haven’t the Gaston Browne led Ruling Arm of the government proceed in similar fashion as they have done with the Alfa Nero and recoup some of its loses, due to these other investments which have done more harm and damages to Our economy?

    • @Do you remember…against the us…I cannot only, “see the problem,” I know of, live “the problem” with solutions, I might add, since, the #Hoods of the USA, raised and indoctrinated me #Bastard_Gangsta Style.

      However, I do know for a fact, it’s not where you’re at, it’s what you do with what you got.

      Antigua, Barbuda & REDONDA have to comply with the US Congress on Capitaline Hill, when they want the Antigua, Barbuda & REDONDA government to be their #pawn and foot-soldier, in their illegal and dirty wars.
