Development Control Authority Clarifies Restrictive Covenants on Residential Property in Antigua and Barbuda

PUBLIC NOTICE – RESTRICTIVE COVENANTS

April 3, 2024.. St. John’s, Antigua and Barbuda… The Development Control Authority wishes to clarify claims made in a recent media report concerning restrictive covenants.

The National Housing and Urban Renewal Company is the vendor for the lands on which the residential property is being erected.

The media practitioner referenced item six on the list of restrictive covenants – “no building other than a single dwelling house either with or without garages and necessary outbuildings is to be erected upon the Lot.”

However, item six restricts apartments and commercial buildings, not a single unit in a residential area.

Item seven, the appropriate section, reads – “no dwelling house or any extension thereof shall be constructed except as a single storey building unless the topography can reasonably allow, the decision of the vendor being final.”

Furthermore, the front of the building is not depicted in the video and is well within the prescribed boundary setback.

  5. The letter claim the video only shows one side. That is a False defense claim.
    Neither did the letter say what is the legal setback from the street.
    The foundation walls are about 5 to 8 feet given the edge of the road is not clear due to the overgrowth on the side.
    A defense letter that makes them look guilty as charged

  8. The required set-back from the front is 20ft and from the side is 10ft. If there is nothing wrong why have the members of the community had reason to complain and have they received response?

  9. If the area is zoned for one story homes.Therefore,that building should not have been allowed by DCA.Rules are to be followed.I do not give one damn the owner of such.If she and or he supports the UPP and or the ABLP.It is said.That the owner is on the Board of the DCA.
