Captain Appeals High Court Ruling in Defence Force Dispute

Captain Javonson Willock of the Antigua and Barbuda Defence Force (ABDF) has appealed against a High Court decision dismissing key elements of his legal challenge over changes to his employment status.

The case stems from the Defence Force’s decision to alter Willock’s indefinite commission to a short-term one, a move the High Court ruled unlawful last month.

The court found the modification violated principles of natural justice but rejected Willock’s claims for automatic promotion, salary increases, and judicial review of an allegedly unlawful investigation.

Willock, who has served in the ABDF since 2005, filed his appeal with the Eastern Caribbean Supreme Court on 20 December.

He argues that the High Court failed to adequately consider evidence in his affidavits and misapplied legal principles in concluding he was not entitled to incremental pay increases at his rank.

In its earlier ruling, the High Court noted procedural irregularities in how the commission change was handled, while also supporting the Defence Force’s discretion in matters of promotion and pay.
