DAILY OBSERVER- Justice Jan Drysdale has recused herself from the Barbuda Council’s legal battle with the Attorney General over land rights, leaving the case to be reassigned.
The dispute revolves around the government’s controversial land adjudication process, which challenges Barbuda’s tradition of communal land ownership.
The process, led by adjudicator Sir Clare Roberts, allows Barbudans to purchase occupied land for $1, following legislative amendments. Critics, including the Barbuda Council, view this as a potential land grab benefiting wealthy investors.

The day before the judgment Trevor was on the disturber saying how the judge was eager to give his judgment as he considered the matter important to the people of Barbuda. Trevor thought waste ah time Justin was going to be victorious for once. I was able to view the entire proceedings as Privy Council’s web portal carried it Live. Justin Simon, KC presented his argument with reluctance as though he was not convinced of his purpose for being there.
The Lords and Lady had several questions for him, some of which he responded incoherently.
When Anthony Astaphan, Crown’s Coucil presented on behalf of the government, he asked the Judicial panel if there were any questions for him. They all replied in the negative. Even though I’m not an attorney, I knew then that John Mussington and McKenzie Frank had lost the case.
I called a few of my counterparts to share my opinion. Obviously, some didn’t trust my layman’s judgment. They wanted to wait and see.
And in thirty days as promised, VOILA! the decision went against the claimants.
How can own land that was never willed to you, knowing fully that your masters, the Condrington’s rented the land from the British rule at that time?
When we became independent, the lands were bequeathed to the Crown, which is Antigua and Barbuda. Any elementary student could learn that in a nanosecond.
