Captain Javonson Willock has filed an application for an interim injunction against senior figures within the Antigua and Barbuda Defence Force (ABDF) and the Attorney General. The case was filed today.
The respondents named in the application include Lieutenant Colonel Dalton Graham, in his capacity as Commanding Officer of the First Antigua Barbuda Regiment; Brigadier General Telbert Benjamin, Chief of Defence Staff; and the Attorney General.
Captain Willock, the applicant, alleges misconduct and procedural violations by the respondents, with claims that their actions amount to abuse of process and are influenced by malice and improper motives.
The case revolves around allegations against Captain Willock for various breaches of the Defence Act 2006.
Captain Willock asserts that the charges lack legal basis and that the respondents have failed to follow proper investigative procedures as stipulated by the Defence (Amendment) Act, 2012.
This is not the first time Willock has challenged the ABDF in Court.
In his submission, Captain Willock highlights previous court findings where the respondents’ actions were deemed unlawful, yet corrective measures were not implemented.
He further argues that statutory limitations under the Defence Act prevent the respondents from pursuing charges stemming from incidents that occurred over three years ago.
The application seeks immediate judicial intervention to prevent potential disciplinary action, including termination or imprisonment, pending a substantive hearing. Captain Willock has pledged to file the substantive claim by December 13, 2024.
