Four legal actions have been filed over the same amount of years, \u2018challenging\u2019 the government\u2019s changes to centuries old land tenure system and introducing unsustainable and speculative development to the island, without consulting with the people of Barbuda.<\/p>\n<p>The pending cases were filed against the Government of Antigua and Barbuda from 2015 going through to Court level on Barbuda\u2019s \u2018sister isle\u2019, Antigua.<\/p><div id=\"antig-939763866\" class=\"antig-content antig-entity-placement\"><a by the government to punish Barbudans for rejecting its version of &#8216;development&#8217; plans, and to discourage return and re-establishment of the community. More recently concerns have been raised that the Government of Antigua and Barbuda have been brokering deals and allowing the lease of lands, under the new Barbuda Land Act of 2018 by allowing land to be bought and sold converting leases into freehold.<\/p>\n<p>An example of such a deal involves the Coco Point Lodge lease.\u00a0 Coco Point Lodge is the first hotel in Barbuda, and it was built in 1959.\u00a0 The lease was purportedly purchased by John Paul DeJoria, a global entrepreneur and billionaire, with his partners John B. Turbidy and Steve Adelson joined together through The Peace Love and Happiness Partnership (PLH) as the leaseholders and financial sponsors of Barbuda Ocean Club.\u00a0 They, in conjunction with the Discovery Land Company, an Arizona, USA based group, are developing the Barbuda Ocean Club, a community advertised as a private residential resort community. The images of the Bahamas recall Barbuda, the US Virgin Islands and British Virgin Islands, Dominica, St Martin, Anguilla and Puerto Rico 2 years ago. While Barbudans wait for their cases to be heard, and for their government to deliver essential services, their lands are being traded for the modern-day equivalent of beads and trinkets, without their input. Unless real action is taken by the Council, the government and the courts, justice for Barbudans\u2019 will most certainly be denied and small victories, if any, will be rendered pyrrhic. \u201c<\/p>\n<p>Mussington added, \u201cI will say this again, we as Barbudans need to be consulted and kept abreast of the government\u2019s intentions.\u00a0 We will defend our right to participate in the planning and to direct our own development.\u00a0 Given the continued dire situation in Barbuda post Irma, forced evacuation and prolonged exclusion from returning we must ask: Wealth and jobs for whom, at what cost and what consequences? The elimination of Barbudans as a people with a unique culture and history? The abolition of our communal land system and redundancy of our local government system and our Council? Destruction of our Lagoon National Park, designated RAMSAR Convention site and home to our magnificent Frigate Bird? Menial, transient jobs for some? C) Proper voting at meeting including a secret ballot. D) Period of lease restricted to 50 years in first instance. E) Only Barbudans allowed to vote. All the above rules were broken. 3.3 Judge Cottell ruled in favour of the government. This judgement was appealed. It will remain in the Eastern Caribbean Court of Appeal until the 2018 constitutional case is decided. STATUS: Stayed in the Eastern Caribbean Court of Appeal.<\/p>\n<p><strong>CASE TWO<\/strong>: ANUHCV2016\/0289 2016: Trevor Walker, Mackenzie Frank and 110 Petitioners v Attorney General and Paradise Found 2.1 This case sought declaratory relief. It was filed in June 2016 in the High Court of Antigua &amp; Barbuda and challenged constitutionality of the Paradise Found project Act 2015. Through this Act, the Government attempted to convey to Robert DeNiro and James Packer: I) A lease for 140 years 2) Additional lands totalling 555 acres 3) Circumvent the 2007 Barbuda Land act which requires the people&#8217;s consent be given before any land can be alienated. 2.2 Justice Roslyn Wilkinson ruled for the Claimants finding that:\u00a0 A) the land is owned in \u201ccommon&#8221; by the people. B) That the land is vested in the crown as a trustee for all Barbudans present and future. C) all Barbudans have an &#8220;individual&#8221; and &#8220;collective&#8221; right to lands in Barbuda. D) the government has a fiduciary responsibility to the people to protect their interest in the land. Inform them of any proposed changes and seek they consent. 2.3 The government appealed this judgement. The case is currently pending in the Eastern Caribbean Court of Appeal. STATUS: Awaiting a judgement date.<\/p>\n<p><strong>CASE THREE<\/strong>: ANU2018\/XXXX 2018: Trevor Walker, Wayde Burton, Mackenzie Frank and Barbuda Council v Attorney General 3.1 This case was filed in the High Court of Antigua &amp; Barbuda in October 2018. It challenges the repeal of the Barbuda Land Act 2007 and the Barbuda Act 2018 which replaced the 2007 act. 3.2 The provision of the 2007 land act was &#8220;to confirm that all lands in Barbuda are owned in common by the people of Barbuda&#8221; And to &#8220;vest the land in the crown on behalf of the people&#8221;. 3.3 The Barbuda Council is a part of the action because it&#8217;s powers to administer lands were taken away by the Crown Regulations Act 2018. 3.4 The hearing did not take place and Justice Olivette has left the jurisdiction. STATUS: Hearing December 5.<\/p>\n<p><strong>CASE FOUR<\/strong>: ANU2018\/0320 2018: John Mussington and Jacklyn Frank v Development Control Authority (DCA), Antigua and Barbuda Airports Authority (ABAA), The Attorney General. 4.1 Case Against an International Airport Development in Barbuda 4. 2 On 6th July 2018 the claimants sought judicial review of the Government\u2019s decision to construct the new airport, moving for immediate shut down of the development. 4.3 The legal action revealed that the Department of the Environment (DoE) warned the government of environmental risks including significant gaps in the Environmental Impact Assessment, which failed to properly assess archaeology, biodiversity, hydro-geological and geological aspects. 4.4 An injunction was granted on 2nd August 2018. The High Court of Antigua &amp; Barbuda instructed that all construction on the new airport must cease immediately. 4.5 The case was appealed by the government to the Eastern Caribbean Court of Appeal, which lifted the injunction on 11th September 2018, while the matter awaits a decision. 4.6 In October 2018 Prime Minister Gaston Browne expressed dissatisfaction with the slow pace of construction work but Barbuda residents who had been travelling to and from the island confirmed that work had stopped, claims which were supported by photographic evidence.
