A Jolly Harbour property owner has failed in a court bid to stop the community\u2019s management company from calling him a non-payer while their dispute over fees continues.<\/p>

Cyprian Kowalczyk, owner of Parcel 573, had asked the High Court for urgent orders to prevent Caribbean Developments (Antigua) Limited (CDAL) from labelling him a debtor, using that claim in legal proceedings, or threatening to cut utilities.<\/p>\n\n\n\n

But in a ruling on April 2, the judge dismissed the application, finding it did not meet the threshold for emergency relief.<\/p>

The court said Kowalczyk refused to provide an undertaking in damages \u2014 a key requirement \u2014 and that granting the order would unfairly restrict CDAL from presenting its case.<\/p>

\"\"<\/a><\/div>\n\n\n\n

The judge also found no evidence that utilities were about to be disconnected, noting services had continued during the dispute.<\/p>\n\n\n\n

CDAL argued Kowalczyk had paid the charges up to February 2025 before stopping.<\/p>

\"\"<\/a><\/div>\n\n\n\n

The ruling does not determine whether the fees are legally owed. That question \u2014 including whether the obligation binds him as a subsequent buyer \u2014 will be decided at trial.<\/p>\n\n\n\n

Kowalczyk was ordered to pay $2,000 in costs, as the court urged both sides to ease tensions going forward.<\/p>
