managing director of ConsultHIM and a specialist in industrial and labour relations, said the Court\u2019s decision in <em>Akeele Thomas v Carlisle Bay Resort<\/em> raises \u201cserious concerns\u201d and may warrant an appeal.<\/p>\n\n\n\n<p>Willock questioned whether an employer can lawfully stop scheduling an employee after a period of certified sick leave, remain silent, and later rely on job abandonment as a defence. He later went on certified sick leave for several months.<\/p><div id=\"antig-2488127622\" class=\"antig-content_2 antig-entity-placement\"><a href=\"https:\/\/www.courts.com\/antigua\/\" aria-label=\"500X500 (1)\"><img src=\"https:\/\/mlavawteztbj.i.optimole.com\/w:500\/h:500\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2026\/03\/500X500-1.jpg\" alt=\"\"  srcset=\"https:\/\/mlavawteztbj.i.optimole.com\/w:500\/h:500\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2026\/03\/500X500-1.jpg 500w, https:\/\/mlavawteztbj.i.optimole.com\/w:300\/h:300\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2026\/03\/500X500-1.jpg 300w, https:\/\/mlavawteztbj.i.optimole.com\/w:150\/h:150\/q:mauto\/f:best\/https:\/\/antiguanewsroom.com\/wp-content\/uploads\/2026\/03\/500X500-1.jpg 150w\" sizes=\"(max-width: 500px) 100vw, 500px\" width=\"500\" height=\"500\"   \/><\/a><\/div>\n\n\n\n<p>According to the Court, Thomas did not return to work after his sick leave expired, did not submit further medical certificates beyond March 2020, and did not sufficiently engage the employer to clarify his status. The Court accepted the employer\u2019s position that it was uncertain of Thomas\u2019 intentions and ultimately formed the view that he had abandoned his job.<\/p>\n\n\n\n<p>Critically, the Court found that being removed from the work roster was not, in itself, proof of dismissal. He said he was unaware of any legal precedent that requires employees to initiate contact to determine their work schedule after being certified fit to return.<\/p>\n\n\n\n<p>The consultant also criticised the Court\u2019s narrow interpretation of dismissal, arguing that termination can occur through conduct, not just formal notice. He warned that leaving an employee \u201cin limbo\u201d without scheduling or communication could, in practice, amount to dismissal.<\/p>\n\n\n\n<p>In addition, Willock took issue with the Court\u2019s refusal to fully engage with the concept of constructive dismissal, describing it as a technical approach that prioritises procedural rules over fairness.<\/p>\n\n\n\n<p>He further warned that the implications of the ruling could allow employers to avoid liability by taking no formal action \u2014 neither scheduling the employee nor issuing termination \u2014 and later asserting abandonment.<\/p>\n\n\n\n<p>\u201cIf this approach is allowed to stand, it risks undermining fundamental protections in our labour system,\u201d Willock wrote.<\/p>\n\n\n\n<p>Despite these concerns, the Court maintained that the burden of proof rested on the employee to establish that he had been dismissed.
