He al\u00adso con\u00adtend\u00aded that he (Thomas) should have been de\u00adport\u00aded by the Im\u00admi\u00adgra\u00adtion Di\u00advi\u00adsion and then ex\u00adtra\u00addit\u00aded by the DPP\u2019s Of\u00adfice to face tri\u00adal.<\/p>\n\n\n\n

In his judg\u00adment, Kokaram agreed with Ramdeen\u2019s analy\u00adsis of what should have been done.<\/p>\n\n\n\n

While Kokaram ruled that the di\u00advi\u00adsion was jus\u00adti\u00adfied in con\u00adsid\u00ader\u00ading the charges and the fact that Thomas had breached pre\u00advi\u00adous su\u00adper\u00advi\u00adsion or\u00adders, it had very lit\u00adtle choice but grant him one if it did not plan to de\u00adport him with\u00adin a rea\u00adson\u00adable time.<\/p>\n\n\n\n

\u201cHow\u00adev\u00ader, even here the ev\u00adi\u00addence demon\u00adstrates that the crim\u00adi\u00adnal courts have grant\u00aded the de\u00adtainee bail and there\u00adfore the idea of the de\u00adtainee be\u00ading a flight risk or at risk of of\u00adfend\u00ading does not on this ev\u00adi\u00addence bear the hall\u00admarks of cred\u00adi\u00adbil\u00adi\u00adty,\u201d Kokaram said.<\/p>\n\n\n\n

As part of the judg\u00adment, Kokaram gave the Im\u00admi\u00adgra\u00adtion Di\u00advi\u00adsion ad\u00advice on han\u00addling such cas\u00ades in the fu\u00adture.<\/p>\n\n\n\n

He not\u00aded that de\u00adpor\u00adta\u00adtion or\u00adders may on\u00adly be de\u00adlayed for a rea\u00adson\u00adable time in cir\u00adcum\u00adstances where the di\u00advi\u00adsion is hav\u00ading is\u00adsues in ex\u00ade\u00adcut\u00ading the or\u00adder due to ad\u00admin\u00adis\u00adtra\u00adtive is\u00adsues.<\/p>\n\n\n\n

How\u00adev\u00ader, Kokaram not\u00aded that there was leg\u00adis\u00adla\u00adtion al\u00adready in place for de\u00adpor\u00adta\u00adtion to be de\u00adlayed in cir\u00adcum\u00adstances when a per\u00adson has to serve a prison sen\u00adtence be\u00adfore.<\/p>\n\n\n\n

The ad\u00advice was ac\u00adcept\u00aded by Chief Im\u00admi\u00adgra\u00adtion Of\u00adfi\u00adcer Char\u00admaine Gand\u00adhi-An\u00addrews, who was present in court along with sev\u00ader\u00adal se\u00adnior im\u00admi\u00adgra\u00adtion of\u00adfi\u00adcers.<\/p>\n\n\n\n

Ramdeen, who is an Op\u00adpo\u00adsi\u00adtion Sen\u00ada\u00adtor, re\u00adquest\u00aded that the judge\u00adment be sent to the At\u00adtor\u00adney Gen\u00ader\u00adal\u2019s of\u00adfice as it is cur\u00adrent\u00adly draft\u00ading amend\u00adments to lo\u00adcal im\u00admi\u00adgra\u00adtion laws. Kokaram agreed and of\u00adfered to send it to the Min\u00adistry of Fi\u00adnance as one of his rec\u00adom\u00admen\u00adda\u00adtions was for prop\u00ader fund\u00ading be set aside to ef\u00adfect de\u00adpor\u00adta\u00adtions.<\/p>\n\n\n\n
