The rule of law\ncan only be maintained and strengthened by ensuring public confidence in the\ntransparency and consistency of judicial approach. One of the areas of greatest\npublic interest and comment, sometimes uninformed, is sentencing. The Court of\nAppeal of Trinidad and Tobago, in the case of Aguillera v The State 2015<\/em><\/strong> has sought to guide sentencing\ncourts in the approach they should take. It is intended to achieve consistency\nof approach, not uniformity of sentencing.<\/p>

\"\"<\/a><\/div>\n\n\n\n

Within the\njurisdiction of the Eastern Caribbean Supreme Court (ECSC), judges,\nmasters and magistrates are required to give reasons for the sentences which\nthey impose. In order to assist them in the process of considering and\nexplaining sentences, Her Ladyship the Honourable Dame Janice M. Pereira DBE,\nLLD, Chief Justice, has set up a Sentencing\nAdvisory Committee(\u2018SAC\u2019), of which the Chief Justice is\nPresident, under the joint-chairmanship of Her Ladyship Madam Justice Gertel\nThom, Justice of Appeal, and His Lordship Mr. Justice Iain Morley QC, High\nCourt Judge. Its task is to draft guidelines which will be brought into effect\non dates to be appointed following public consultation. <\/p>\n\n\n\n

There will be\nspecific steps required to be taken when constructing a sentence, which are set\nout in soon to be published Rules and Practice Directions. It is intended that\nthe guidelines must be applied unless to do so would be contrary to the\ninterests of justice. The reasoning process for any sentence must be given as\nwell as for any decision not to follow a guideline.<\/p>

It is not\nintended that the guidelines will replace the discretion of the individual\njudge, master or magistrate in determining the appropriate sentence within the\napplicable range. In the case of some offences, the application of the guidelines\nmay alter sentencing practice. In the case of serious drug offences, it is\nintended to do so. The Chief Justice intends that structured and well-reasoned\nsentencing remarks will become normal practice and would encourage their\npublication. These remarks will build up a bank of authority to assist courts,\nstudents of law and the public to better understand the principles and practice\nof sentencing law.<\/p>

The ECSC is\ntherefore, inviting Legal Practitioners, Litigants, Social Workers, Mediators,\nProbation Officers, The Police, Correctional Services Officers and Members of\nthe Public in the OECS to take part in our Sentencing Guidelines Public\nConsultation. The\nEastern Caribbean Supreme Court (ECSC) was established in 1967 by the West\nIndies Associated States Supreme Court Order No. 223 of 1967. The ECSC is a\nsuperior court of record for the Organization of Eastern Caribbean States\n(OECS), including six Independent States: Antigua and Barbuda, the Commonwealth\nof Dominica, Grenada, St. Kitts and Nevis, Saint Lucia, St. Vincent and the\nGrenadines; and three British Overseas Territories: Anguilla, The Territory of\nthe Virgin Islands, and Montserrat. The Court has unlimited jurisdiction in\neach Member State and Territory.<\/p>
