PACE Justice Project and Eastern Caribbean Supreme Court Design Toolkit to Reduce Case Backlogs<\/strong><\/p>\n\n\n\n

Caribbean countries battling overwhelming backlogs of cases are being offered relief through the use of alternate dispute resolution. <\/p>

\"\"<\/a><\/div>\n\n\n\n

In efforts to improve access to justice across the Caribbean, the PACE Justice Project \u2013 implemented by the United Nations Development Programme with funding by the European Union \u2013 handed over a victim-offender mediation (V-OM) toolkit to the Eastern Caribbean <\/a><\/strong>Supreme Court (ECSC) on 30 May in St Lucia, which contained practical guidance on introducing V-OM across its jurisdictions, with the invitation for other countries to also utilize the manual.<\/p>

\"\"<\/a><\/div>\n\n\n\n

V-OM is a voluntary process where victims and offenders meet in a safe environment, overseen by a professional, to communicate openly and work toward resolution.<\/p>\n\n\n\n

This mediation helps direct suitable cases away from the formal court process, relieving pressure on the already strained justice system and enhancing justice outcomes for both victims and offenders.<\/p>

\"\"<\/a><\/div>\n\n\n\n

This work is embedded in the wider UNDP agenda on criminal justice reform in the Caribbean, underpinned by PACE Justice, which focuses on reducing criminal case backlogs by improving institutional capacities, enhancing inter-agency coordination, strengthening the legislative and regulatory environment and catalyzing digital innovation across the justice sector.<\/p>\n\n\n\n

Jairo Acu\u00f1a-Alfaro, Team Leader of Governance at UNDP Latin America and the Caribbean, called the toolkit \u201cone of a kind\u201d, and suggested it can directly aid in the rehabilitation of at-risk youth.<\/p>

\u201cWe have identified that there are major bottlenecks in the criminal justice chain in the Caribbean region, and this new V-OM toolkit can help us alleviate and offer alternatives to the population,\u201d he asserted. <\/p>

\"\"<\/a><\/div>\n\n\n\n

\u201cThe more that we can divert cases in the criminal justice system, the more we can reduce bottlenecks, and the more opportunities that we are giving the citizens\u2026 There are many youngsters that get trapped in that process and we need to give them alternatives to develop [a better] quality of life and contribute to development of the country.\u201d<\/p>\n\n\n\n

The ECSC as a strategic partner will be the custodian of the toolkit, adding it to their institutional offer to strengthen national capacities and support the entire OECS. <\/p>\n\n\n\n

Chief Justice (Ag.) of the ECSC, Her Ladyship, the Honourable Margaret Price Findlay, acknowledged that the court is facing increasing pressure from rising caseloads, and recognised the V-OM toolkit as a practical solution for this.<\/p>\n\n\n\n

\u201cOur acceptance of the V-OM toolkit represents a significant step towards embedding restorative justice into the heart of our criminal justice system,\u201d she remarked.<\/p>\n\n\n\n

\u201cThe ECSC welcomes this toolkit not merely as a manual, but as a manifestation of a unified vision that aligns strongly with the objectives of the Needham\u2019s Point Declaration.<\/a><\/p>\n\n\n\n

<\/a>We recognise the urgent need to alleviate case backlogs, promote meaningful dialogue and rehabilitation, and restore agency and dignity to victims.<\/p>\n\n\n\n

Restorative justice \u2013 when done well \u2013 accomplishes all these things and mediation, as outlined in this toolkit, offers us a path forward\u2026 It offers a way to resolve matters early, appropriately and with lasting outcomes.\u201d<\/p>\n\n\n\n

The toolkit reflects best practices from a pilot launched under the UNDP project \u201cBreaking the Bottlenecks: Victim-Offender Mediation (V-OM) as a Criminal Justice Tool\u201d, which successfully implemented the use of V-OM to divert appropriate cases in Saint Lucia and Belize away from the formal court process, enhancing justice outcomes for both victims and offenders. <\/p>\n\n\n\n

It supports Sustainable Development Goal 16, which promotes Peace, Justice and Strong Institutions.<\/p>\n\n\n\n
