A 33-year-old man, who used his cellular phone to post nude photos of his wife on the social media platform, WhatsApp, on Christmas Day last year, has been fined BDS$1,500 (One Barbados dollar=US$0.50 cents) or spend six months in prison.<\/p>

Jamar Thomas, 33, appeared before Acting Magistrate Anika Jackson on Tuesday on a charge that on December 25, 2018, he used a cellular phone to send a message that was indecent or obscene and he intended to cause or was reckless as to whether he caused annoyance, inconvenience or distress to his wife, Alika Thomas.<\/p>\n\n\n\n

The District \u2018A\u2019 Magistrates\u2019 Court heard that that the couple had been married for four years, and on Christmas Day last year, they had an argument about Thomas taking up his wife\u2019s phone and reading the messages.<\/p>

The prosecution said that Thomas discovered she had been carrying on a conversation with a male and nude photos of herself were placed on WhatsApp. His wife reported the matter to the police and Thomas turned himself in on January 19.<\/p>

Thomas told the court that prior to the incident, he had phoned his sister and complained that he was doing all the work and his wife got angry, started to shout and took up his tablet and told him \u201cWhat is yours is mine and what is mine is yours.\u201d<\/p>\n\n\n\n

He said in response he took up his wife\u2019s phone and said \u201cWhat is yours is mine and what is mine is yours.\u201d<\/p>

Among other things, Thomas saw some stuff on his wife\u2019s phone including nude videos with his son in the background and he was upset.<\/p>\n\n\n\n

He said he meant to show them to a woman who counsels them, but he was disoriented and instead posted them on WhatsApp. He later tried unsuccessfully to remove them and expressed remorse.<\/p>

In passing sentence the acting magistrate said that \u201cI have taken into account your early plea of guilty at the first opportunity and you have not wasted the court\u2019s time.\u201d<\/p>

But she warned him to \u201cwalk the straight and narrow way\u201d and imposed the fine, which must be paid by May 24, or he will spend six months in prison.<\/p>\n
