Court Refuses Captain Willock\u2019s Injunction Application against the Chief of Defence Staff.<\/strong><\/p>

Justice Rene Williams heard and refused the application for an interim injunction filed by Captain Willock earlier today. <\/p>\n\n\n\n

Willock’s application was premised on the basis that his superiors were statute-barred and adopted an incorrect procedure before subjecting him to disciplinary charges.<\/p>

\"\"<\/a><\/div>
\"\"<\/a><\/div>\n\n\n\n

In hearing arguments from Mrs. Joy Dublin-Baptiste, Attorney-at-Law, for the Respondents, and Captain Willock, self-represented, we understand that Justice Williams took the view that the Defence Force is a disciplined institution and the Court did not have the appetite to intervene in its internal procedures at this early stage. <\/p>

\"\"<\/a><\/div>\n\n\n\n

The Judge also noted that financial compensation will be adequate to remedy the breach if Willock is successful on the substantive claim.<\/p>\n\n\n\n

While the Court did not grant the injunction, it considered that there was a serious issue to be tried and that Willock had a reasonable prospect of success. Therefore, the matter was set down for February 11, 2025, and thereafter proceed to trial without delay.<\/p>

\"\"<\/a><\/div>\n\n\n\n

In the meantime, Willock has upped his legal actions against Brigader Benjamin, suing him for misconduct (misfeasance) in Public Office. <\/p>\n\n\n\n

In the most recent claim form, Willock says that the Brigader\u2019s conduct towards him \u201camounts to misfeasance in public office as he exercised his powers in bad faith and for an improper and\/or ulterior motive.\u201d <\/p>

Willock also said his boss\u2019s action towards him \u201cwas motivated by targeted malice, specifically intended to injure the claimant.\u201d<\/p>

\"\"<\/a><\/div>\n\n\n\n

This dispute between Willock and Benjamin is approaching four continuous years. Willock had previously brought two lawsuits against Benjamin and had won in both instances. This is now the third lawsuit in three years.<\/p>\n\n\n\n

In further developments, one of Willock\u2019s colleagues has come forward and supported his claim, citing that they were pressured repeatedly by senior officials in the ABDF to implicate Willock in misconduct or their career would come to a premature end. <\/p>\n\n\n\n

We understand that the said individual is now on vacation leave pending the termination of their services in the ABDF.<\/p>\n
