MISSING MONEY REPORT<\/strong><\/p>

In\nthe midst of all these, it speaks to human miseries that have seen many people\ndescended to the depths of despair. Undoubtedly, this may have been the experiences\nof fourteen educators whose liberty and freedom of movement had been restrained\nfor a crime, undignified and futile searches by police investigators have\nvindicated. When investigators converged on the premises of the All Saints\nSecondary School (ASS), it was not in response to sightings of the second \u2018…Most Dangerous; …Most Wanted; and …Most\nElusive Fugitive, Calvin \u2018…Burger James\u2019<\/strong> [Police BOLO (Be on Look Out)]. \u00a0<\/strong>They\nhad done so in consequence of a \u2018…Missing\nMoney Report,\u2019<\/strong> made by a fellow teacher [October 11, 2018]. Giving clear\nindications of an intention to increase the population of an institution,\nnotorious for its \u2018…wretchedly harsh conditions,\u2019 investigators had \u2018…corralled;\n…detained and interrogated\u2019 fourteen educators and ancillary staff members,\nwhose work-day had not ended.<\/p>

GROPING FOR WORDS<\/strong><\/p>\n\n\n\n

Now,\nwhile Police investigators sought to ascertain how some \u2018…EC$ 4, 500\u2019<\/strong> mysteriously disappeared from the handbag of a\nMusic teacher, reportedly left in the communal Staff Room, they shall also\nascertain whether or not such sum had really existed. Since man often\n\u2018…grope\u2019 for other things, it had to be something extraordinary for Director\nof Education Clare Browne to be \u2018…Groping\nFor Words\u2019<\/strong> [OMG: October 18, 2018]. Even so, it was certainly not about the\nmysterious disappearance of \u2018…an\nexisted or non-existed sum of money.\u2019<\/strong> Instead, it was over the appalling\ninvestigative approach by police investigators and the objectionable treatment\nmeted out to some fourteen teachers and ancillary Staff at the All Saints\nSecondary School. Then there seemed to be a troubling and nagging headache for\nActing Commissioner of Police Atlee Rodney. He shall provide answers to the\nstakeholders, including Principal George Edwards, who though absent, has\nresponsibilities to his Staff and student body and the Ministry of Education\nwho have reposed confidence in him as a Principal and institutional leader.<\/p>

In\ndealing with persons suspected of the commission of crimes, while the Judges\nRules [1964], guide investigators in martialling the facts or gathering\nevidence relevant to the \u2018…Fact in Issue,\u2019 in obtaining confession statements\nfrom suspects or accused persons. Though often misconstrued, the \u2018Rules\u2019\nprovide no \u2018…Exercisable Powers\u2019<\/strong>\nof arrest, detention or search. Additionally, the Judges Rules provide no\nauthority for investigators to enter private property or to conduct searches of\nthe person of another without their consent. Moreover, they provide no\nauthority to Police investigators to (a)\n\u2018…Enter onto School premises without the Principal\u2019s permission; (b)\u00a0 …Commandeer Staff Rooms;\u00a0 (c) …Set up Command and Interrogation\nCenters; (d)\u00a0 …Detain suspected\nstudents and\/or teachers; and (e) …Conduct body cavity searches.\u2019<\/strong><\/p>\n\n\n\n

THE PURSUITS<\/strong><\/p>\n\n\n\n

None may deny the unpredictable\nnature of man; and none may deny his often repugnant attitude toward his\nfellowmen. In man\u2019s psyche and endeavors, there is the pursuit of peace of\nmind, love and happiness. There has always been a burning desire to be\nfinancially empowered. Hence, the\nirrestible urge for the acquisition of wealth, whether legitimately or\nillegitimately, honestly or crookedly. This allows for financial independence\nand ultimately, the enjoyment of the finer things of life. Even so, these may\nbe achieved through honesty and by dint of hard work. However, somewhere and\nsomehow, man is confronted with challenges of all kinds. There is the\ninescapability of danger, pain and peril, as there is the inescapable\nhumiliation and degradation. Most frighteningly, there is greed, trickery and\ntreachery, as there is embarrassment and disappointment, and \u2018…likened to money, when a good name is\nfilched.\u2019<\/strong><\/p>\n\n\n\n

VAGARIES\nOF LIFE<\/strong><\/p>\n\n\n\n

These, undoubtedly, are among the\ndaily experiences of humans. These also reflect the \u2018…Vagaries of Life,\u2019 <\/strong>where even in the workplaces, when thing go\nwrong or so made to be, the innocent have been made to suffer blame or\nindignities. Other than access to the \u2018…communal Staff Room,\u2019 there appeared\nto have been \u2018…no reasonable grounds for suspecting members of Staff present\non the premises, reportedly in their occupation assisting students, while\nothers were reported to have been preparing \u2018…Lesson Plans\u2019<\/strong> for teaching sessions on the following day.\nThough the searches speak to futility, when embarrassingly not even a dollar\nwas recovered, the telling blow to their ego, reputation, honesty and\nintegrity, shall remain, not in the dark recess of their mind, but in their\nmemory under a shining light.<\/p>\n\n\n\n

CRAZIEST MOMENTS<\/strong><\/p>\n\n\n\n

In\nhis light moments, renowned social commentator Slinger Francisco, \u2018Mighty Sparrow,\u2019<\/strong> wittily, yet\nsuggestively posited two ways modern man has been searching for \u2018…Salt Fish.\u2019 <\/strong>Back then, man never\nused violence to acquire it, he simply purchased it from grocery shops.\nLyrically, Sparrow explains two accompaniments for searches provoked by anger.\nHe said that (i) \u2018…Man does pull gun to find it.\u2019 If security was\ncompromised, he went on to say that (ii) \u2018…Man does lick down man to find it\u2019\n[Song: Salt Fish: You Tube]. Such philosophical approaches shall be viewed with\nserious concern. Lest man was prepared to go to jail, there may be no need to\nbrandish guns or to drink rum to find neither \u2018…Salt Fish; …Drugs; nor Money.\u2019<\/strong> He may not have envisaged that\nin his \u2018…Craziest Moments,\u2019<\/strong> man\nhas put nooses around his neck to cease enduring miseries when he could not\nfind something \u2018…Eat; …Smoke or\nSpend.\u2019<\/strong> In the case of the police investigators, they may have seen that\nwhich could not be spent.<\/p>\n\n\n\n

VISUAL INSPECTION<\/strong><\/p>\n\n\n\n

Consequent\nupon a report of \u2018…Missing Money,\u2019<\/strong>\nthey were interrogated, urged to hand over the money, then subjected to the\nindignity of \u2018…Strip Searches,\u2019<\/strong> by\na team of inexperienced detectives that reportedly ordered improper exposure of\nbody cavities for them for \u2018…Visual\nInspection\u2019 <\/strong>of their reproductive organs. Humans, on the other hand, are\nendowed with conscience and reason. They are gifted with speech and possess\nvarying levels of intelligence, intellectuality and understanding. Even with\nbarriers, they communicate in different languages. While individuals often show\ninsensitivity to the feelings of others, it has been no less troubling that\nthose endowed with reason and conscience,\u2019and have responsibility for enforcing law, continue to be spotlighted for\nprofessional incompetence, inappropriate actions and\/or procedural ignorance.\nThe instant case speaks to these.<\/p>\n\n\n\n

CONSENSUAL SEARCH<\/strong><\/p>\n\n\n\n

The\nConstitution unambiguously states \u2018…Except\nwith his consent, no person shall be subjected to the search of his person or\nproperty, or the entry by others on his premises\u2019 [CO: 1981: Section 10].<\/strong>\nEven as the Constitution so states, there may be \u2018…no inconsistency or\ncontravention,\u2019 when done under the authority of law and with reasonableness\nand justification. For instance, in the investigative process, personnel\nequipped with professional knowledge shall know inter alia that, \u2018…An\nobjectively justifiable suspicion that is based on specific facts or\ncircumstances and justifies stopping and searching a person, may provide\nreasonable grounds to suspect that a person has committed a criminal act or\nabout to, or loitering to commit one.\u2019 From law enforcement perspective, this\nis far removed from the suggestion and advocacy of Director of Education, Clare\nBrowne [ANR: September 25, 2018].\u00a0\nWithout more, a mere report does not confirm actual or constructive\npossession of property or the existence of it. <\/p>\n\n\n\n

VICTIMS OF\nCIRCUMSTANCE<\/strong><\/p>\n\n\n\n

With\nan overall Staff of about \u2018…one hundred educators and ancillary workers at\nthe All Saints Secondary School, educators reportedly numbering about eighty\nfour completed their teaching assignments for the day [October 11, 2018]. Little\nthat fourteen knew that their status would have been changed to criminal suspects,\nof \u00a0which prima facie evidence had not\nshown were conspiratorially involved. Moreover, little they may have known that\nthey would have been the subject of criminal investigation, thereby suffered\nthe indignities of \u2018…Police Strip\nSearch\u2019<\/strong> in their communal Staff room. They may not only have considered\nthemselves \u2018…Victims of Circumstance,\u2019<\/strong>\nresulting from improper investigative procedures, but also questionable\nprofessional judgement, insensitivity and indiscretion.<\/p>\n\n\n\n

PHYSICAL AND VISUAL SEARCHES<\/strong><\/p>\n\n\n\n

Law\nenforcement training emphasized that third party reports of crime shall be\n\u2018…Well-founded.\u2019 Thus, investigating officers shall feel sure that there are\n\u2018…reasonable grounds\u2019 to conduct searches; arrest or detain persons\nimplicated in criminal activity. Respecting search of person or private\nproperty, it may be (i) \u2018…Physical\n(touching) <\/strong>or (ii) …Visual\n(viewing).\u2019<\/strong> These, when properly and justifiably applied, often assist\ninvestigators in establishing factuality of the existence of property that\nbecame the subject of criminal investigation. Rationality and good professional\njudgment also help to inform good decisions and justifiable actions. In the\ninstant case without establishing factuality, investigators wanted to see what\nthe dentist never sees.\u2019 <\/p>\n\n\n\n

CRIMINAL SUSPECTS<\/strong><\/p>\n\n\n\n

Even\nwhen there was no evidence that a crime has been committed or reasonable\ngrounds to suspect a person or to identify him\/her as the culprit, the innocent\nis sometimes categorized as \u2018…Criminal\nSuspects.\u2019<\/strong> In extraordinary circumstances this has been the case of many\npersons, including a Jamaican national Shanique Myrie, and now the case for\n\u2018…fourteen dedicated Antiguan and Barbudan teachers.\u2019 Committed to assist\nstudents by conducting extra teaching sessions, after the general student body\nhad been dismissed at 1.30 pm [October 11, 2018], and after the Principal\nGeorge Edwards, along with some seventy other educators had left the school\u2019s\npremises, \u2018…fourteen members of staff\u2019 were reportedly detained and\ninterrogated in the Staff Room by investigators, who not only appeared to have\nlacked procedural knowledge and starved of formal investigative training.<\/p>\n\n\n\n

CCJ RULING<\/strong><\/p>\n\n\n\n

When\nthe Jamaican national instituted litigation proceedings against the State of\nBarbados, she had accused Barbadian Immigration officers of conducting \u2018…an illegal cavity search on her body.\u2019<\/strong>\nThese proceedings were under the judicial considerations of the Caribbean Court\nof Justice (CCJ), sitting in its \u2018…Original\nJurisdiction.\u2019<\/strong> It was clear that those officers had been on a fishing\nexpedition to unearth evidence to satisfy, not necessarily \u2018…reasonable suspicion,\u2019<\/strong> as required by law, but also their \u2018…personal belief and curiosity.\u2019 <\/strong>Expressing\njudicial distraught, it states, \u2018…In\nperforming an illegal cavity search, a female Immigration officer …violated\nher fundamental human rights and freedoms contained in the Universal\nDeclaration of Human Rights; …the International Covenant on Civil and\nPolitical Rights; and the American Convention on Human Rights.\u2019<\/strong> Some\ninvestigators may not have learned any lessons from the \u2018…Shanique Myrie Case.\u2019<\/strong><\/p>\n\n\n\n

DONKEY BRUTALITY<\/strong><\/p>\n\n\n\n

While\nthe donkey sometimes instinctively responds with \u2018…kicks and bites\u2019 and\nsubjected to painful brutality,\u2019 it is not endowed with the \u2018…Dignity of Man,\u2019<\/strong> and has no gift of\nspeech to complain of human abuse. Though animals were created with instincts,\nmany have shown the ability in mimicking human behavior. In displaying certain\nbehavior or making distinctive sounds, humans often make interpretations as to\nwhat they might be attempting to say and accordingly respond to interpretative\nneeds. Misinterpretation often leads to \u2018…Donkey\nBrutality.\u2019<\/strong> Behaviorally, men fight for the reign of dominance or to show\nthe exercise of power, often in the most controversial, irrational and brutal\nway. Biblical teachings edifies of a peculiar occurrence, when \u2018…Balaam\u2019s Donkey\u2019 <\/strong>spoke of the\nbrutal way it was treated. Though it had acted wisely in avoiding danger and\naverting consequences to its owner, it was mercilessly beaten. Its behavior\nappeared to have been gravely misinterpreted.<\/p>\n\n\n\n

DONKEY MENTALITY<\/strong><\/p>\n\n\n\n

Inspired\nby God and at a precise moment in time, it was provided with the gift of\nspeech. In cogent and concise language, it asked \u2018…What have I done to be beaten three times [NIV: Numbers 22]?\u2019<\/strong>\nParaphrasing, its owner responded, \u2018…How dare you ask me such question? You\nare lucky I didn\u2019t have a sword to cut off your damn head.\u2019 Incidentally, and\nluckily for Balaam\u2019s Donkey, it was an Angel that he had not seen, that\npossessed a sword to remove the head of the \u2018…spiritually indiscernible;\n…irrational and brutal Balaam.\u2019 He had committed the grave act of treachery.\nApplied to humans, though endowed with reason and conscience, man continues to\nexhibit behaviors that had fallen short of the discernible instinct of \u2018Balaam\u2019s Donkey.\u2019 <\/strong><\/p>\n\n\n\n

SEMINAL JUDGMENT<\/strong><\/p>\n\n\n\n

If\nthere may have been any doubt as to what had transpired at the Staff Room at\nthe All Saints Secondary School (ASS), the Shanique Myrie Case makes the point.\nLitigating against the Barbados Government, with intervener \u2018…State of\nJamaica,\u2019 the Caribbean Court of Justice (CCJ), then under Presidency of Sir\nDennis Byron with other Justices, including current President Adrian Saunders,\ndelivered a \u2018…Seminal Judgement.\u2019<\/strong>\nThere were compensatory considerations of hundreds of thousands of dollars. Though\ntwo Barbadian Narcotics officers had played a role in causing her luggage to be\ndouble-checked for controlled drugs she had not possessed, in evidence before the\nCaribbean Court of Justice (CCJ), they denied that they had suspected her as a\n\u2018…drug trafficker.\u2019 The Court was adamant that the officers were untruthful\nand rejected their evidence. It states \u2018…The\ncavity search was conducted in what could only have been an investigation to\nassess the possibility was a drug trafficker\u2019 <\/strong>[Shanique Myrie v State of\nBarbados: Case No. OA: 002 of 2012: Para. 98].<\/p>\n\n\n\n

DRUG MULES<\/strong><\/p>\n\n\n\n

Police\ninvestigators (Antigua & Barbuda), have now developed an approach to find\nanything, including money they believed to be concealed on the human person. In\nthe Shanique Myrie Case, evidence adduced before the \u2018CCJ\u2019 showed that the 22\nyear-old Jamaican national was coerced into submitting her body to a cavity\nsearch. She had no way of knowing that no authority existed in law. She had\nbeen unreasonably suspected to be a \u2018…Drug\nMule,\u2019 <\/strong>negative only when a luggage and \u2018…Body Cavity-Search\u2019 at the\nGrantley Adams International Airport (GAIA), \u2018revealed no drugs\u2019 [March 24,\n2011]. Similarly, when \u2018…fourteen teachers and ancillary staff at the All\nSaints Secondary School (ASS)\u2019 were subjected to \u2018…coercive body cavity\nsearches,\u2019 they were deceptively made to believe that authority of law resided\nwith the investigators [October 11, 2018].<\/p>\n\n\n\n

SQUATTING POSITION<\/strong><\/p>\n\n\n\n

In\nhuman interactions, including the enforcement of laws, humans exhibit behavior\nfar removed from that exhibited by the one\u00a0\nthat had saved \u2018Balaam\u2019 from danger. Not infrequently, some men have\nbehaved in ways that had shown a consistency with \u2018…Donkey Mentality.\u2019 <\/strong>Teachers whose \u2018…honesty and integrity\u2019\nmay never have been previously questioned, had not only been subjected to\ncriminal investigation, but also by searches of their person. The ill-formed\nsuspicions and ill-advised approach had had not only led them to take peeks at the\nprivate parts of the male and female teachers rounded up on the School\u2019s\npremises, but also forcing them into a \u2018…Squatting\nPosition\u2019<\/strong> then coerced to \u2018…Cough\u2019<\/strong>\nthat anything that may have been cavity-stuffed, may have ejected to view.\nWithout the benefit of formal investigative training, apparently prematurely\ncame to three conclusions. <\/p>\n\n\n\n

VERIFIABLE FACTS<\/strong><\/p>\n\n\n\n

Reasonable\ninferences may have been drawn, that \u00a0in\nthe absence of \u2018…Verifiable Facts\u2019<\/strong>\nof actual possession of, and mysterious disappearance of the sum of EC$4, 500,\nthe investigators appeared to have (i)<\/strong>\n\u2018…Accepted as fact, the reporter had possessed such sum of money;\u2019 (ii)<\/strong> …Without reasonable suspicion,\nconcluded that the fourteen teachers and ancillary Staff, had stolen it from a\nhandbag left unattended in the Staff Room; (iii)<\/strong>\n…With clearly pre-conceived notion,\u00a0\ninvestigators unjustifiably likened the teachers to \u2018…Drug Mules,\u2019 <\/strong>thus, categorized and treated them as \u2018…Cash Mules.\u2019<\/strong> Then from a harbored\nmistaken belief, aggravatingly and humiliatingly subjected them to searches of\nbody cavities where the moon never shines and the sun neither rises nor sets,\nand sometimes husbands cannot see.<\/p>\n\n\n\n

CASH MULES<\/strong><\/p>\n\n\n\n

The\nmembers of Staff had been suspected to be \u2018…Cash\nMules,\u2019<\/strong> with possible concealment of EC$\n4, 500\u2019<\/strong> in their anatomy. These were searches that appeared to have crossed\nthe line of human dignity. The educators, subjected to a search regularly\nconducted on \u2018…Drug Couriers\u2019<\/strong> at\nthe V.C. Bird International Airport (VCBIA), had provoked national outrage and\nwide media coverage. Compounded by insensitivity, those who ordered \u2018…Stripping of Teachers\u2019<\/strong> and stood\nthere \u2018…Peeking\u2019 at their body\ncavities,\u2019<\/strong> appeared to have crossed the line of civility back over to\nincivility. Though it was not quite the dicta of eminent Justices on the\nCaribbean Court of Justice (CCJ) as it was in the \u2018…Shanique Myrie Case,\u2019\ninvestigators may have been reckless not to have taken cognizance of its recent\nJudgment, resulting from litigation proceedings instituted against the \u2018…State of Barbados.\u2019 <\/strong><\/p>\n\n\n\n

FALSE BELIEF<\/strong><\/p>\n\n\n\n

It\nwas evident that there was no credible evidence to lead investigators to\nbelieve that a crime had been committed, and that those detained had been\nreasonably suspected to be the perpetrators. The futility of the search,\nprompted by a \u2018…False Belief,\u2019<\/strong> had\nled to actions by law enforcement personnel that appeared \u2018…woefully short of\ninvestigative skills; …starved of procedural knowledge; …lacking\ninsensitivity; and showed recklessness and callous disregard for the dignity of\nthe human person. Social commentator \u2018…Singing Sandra\u2019 succinctly posits\n\u2018…They want to see the whole anatomy\u2019 [Die with My Dignity: You Tube]. Their\napproach may very well have subjected them to a spell of hypnosis, as they left\nthe School\u2019s premises, neither with honey nor money.<\/p>\n\n\n\n

CONSTRUCTIVE\nPOSSESSION<\/strong><\/p>\n\n\n\n

In\na mind clearly saturated with idealism, he urged \u2018…Speak the truth quietly.\u2019\nHe may have inadvertently overlooked human treachery, a Judas-like traitthat has brought many innocent people\nto tears, subjecting them to \u2018…cruel, inhuman and degrading treatment.\u2019 None\nmay deny that such have been the enduring experiences of \u2018…fourteen professional teachers and ancillary Staff\u2019<\/strong> at the All\nSaints Secondary School. They were suspected to have concealed on their bodies\nthe reported, but \u2018…unverified sum of\nEC$ 4, 500,\u2019<\/strong> said to have been in the \u2018…Constructive\nPossession,\u2019<\/strong> of a fellow teacher. The money was said to have been entrusted\nby a third party, a partially immobile elderly female, and held for the\nexpressed purpose of purchasing a refrigerator in downtown St. John\u2019s. <\/p>\n\n\n\n

FULL EXPOSURE<\/strong><\/p>\n\n\n\n

From\nthese perspectives, there may have been a two-pronged investigative approach-\n\u2018…one on the reporter and the other on other possible suspects.\u2019\nIncidentally, in seeking to recover reported \u2018…Missing Money,\u2019<\/strong> investigators need only to give orders for \u2018…Full Exposure\u2019<\/strong> of body cavities by\nremoving everything to expose possible areas of concealment. It is without\ndebate that trending \u2018…Conveyance and\nConcealment\u2019<\/strong> of illegal drugs and money, necessitate counter-measures of\ninterception and recovery.
