(CMC) \u2014 Guyanese singer Eddy Grant has won a copyright case against former United States President Donald Trump over the use of the 1980s dance hit<\/strong>
Electric Avenue.<\/strong><\/p>

On Friday, in a 30-page decision, the judge found Trump liable for damages in the hotly contested copyright battle.<\/p>\n\n\n\n

<\/a><\/p>\n\n\n\n

In the first legal blow, the judge found that the song was properly copyrighted. In the second, the judge threw out the only defence offered in the case \u2014 a claim that Trump had made \u201cfair use\u201d of the song.<\/p>

\u201cIt\u2019s everything we asked for,\u201d Grant\u2019s attorney Brett Van Benthysen said in an interview with Business Insider<\/em>. \u201cOne hundred per cent.\u201d<\/p>

Grant, a UK citizen who lives in Barbados, has been told of the decision, said another of his lawyers, Brian Caplan.<\/p>\n\n\n\n

\u201cGrant believes that the ruling will help other artistes and owners of copyrights defend against similar infringement,\u201d Caplan said.<\/p>

\u201cThis is a complete victory for plaintiffs as to liability. Plaintiffs will be seeking attorneys\u2019 fees in the subsequent damages phase,\u201d he added.<\/p>\n\n\n\n

It remained unclear if the parties would agree to damages among themselves or go to trial and let a jury pick a number.<\/p>

\u201cThere will either be a trial just on damages, assumedly before a jury, or we could agree to a number without a trial,\u201d Van Benthysen said.<\/p>

Grant\u2019s lawsuit demanded that Trump pay him US$300,000, although that could rise if the former president must also pay the thousands of dollars in legal fees the artiste has spent during four years of litigation.<\/p>\n\n\n\n

Both Eddy Grant and Trump were forced by subpoena to give duelling depositions in the case, and former Trump adviser Dan Scavino was also deposed.<\/p>\n\n\n\n

Grant sued Trump in 2020 over a campaign tweet \u2014 a 55-second animation that showed then-presidential candidate Joe Biden feebly puttering along a railroad track in a push cart while a high-speed \u201cTrump-Pence\u201d train zoomed past.<\/p>\n\n\n\n

About 40 seconds of Electric Avenue<\/em> plays as part of the soundtrack.<\/p>\n\n\n\n

In summarising the history of the case in his decision, US District Judge John G Koeltl revealed that it was Scavino \u2014 Trump\u2019s director of social media and deputy chief of staff for communications at the time \u2014 who uploaded the video to Trump\u2019s personal Twitter<\/em> account on August 12, 2020.<\/p>\n\n\n\n

\u201cScavino testified that he saw the video on a Trump supporter\u2019s social media page either on the same day or the day before he posted the tweet,\u201d the judge wrote Friday.<\/p>\n\n\n\n

\u201cScavino also testified that he spoke with former President Trump before posting the tweet and that former President Trump \u2018let [him] go with [his] instinct on it and post it\u2019,\u201d the judge wrote.<\/p>\n\n\n\n

The video was viewed more than 13.7 million times, was liked more than 350,000 times, and was retweeted more than 139,000 times.<\/p>\n\n\n\n

Grant\u2019s lawyers immediately sent Trump\u2019s lawyers a cease and desist letter, but it wasn\u2019t until Grant sued on September 1, 2020 that the video was taken down.<\/p>\n\n\n\n

The Business Insider<\/em> reported that in rejecting Trump\u2019s claim that Grant had never properly secured a copyright for the Electric Avenue<\/em> sound recording, the judge said it was enough that Grant held the copyright for a compilation record that included the song.<\/p>\n\n\n\n

Decisions in multiple prior legal cases support that finding, the judge said.<\/p>\n\n\n\n

Trump, meanwhile, was unable to cite a single supporting case, the judge said.<\/p>\n\n\n\n

And, in rejecting Trump\u2019s claim that the animation was a \u201cfair use\u201d of the song, the judge went methodically in his decision through the four-factor standard for fair-use exemptions to copyright.<\/p>\n\n\n\n

The first factor looks at how the copyrighted work was used. In Trump\u2019s case,
Electric Avenue<\/em> was used for a commercial purpose, not for an allowable non-profit, research, or educational purpose, the judge wrote.<\/p>\n\n\n\n

The second factor looks at whether the copyrighted work was \u201ccreative\u201d or \u201cfactual\u201d.<\/p>\n\n\n\n

\u201cIt is clear that Electric Avenue<\/em> is a creative work and therefore is closer to the core of copyright protection,\u201d the judge wrote.<\/p>\n\n\n\n

The third factor weighs how much of the copyrighted work was taken for an unauthorised use. Here the judge found that \u201cthe song plays for the majority of the animation; the excerpt is of central importance\u201d.<\/p>\n\n\n\n

The final factor asks \u201cwhether, if the challenged use becomes widespread, it will adversely affect the potential market for the copyrighted work\u201d, the judge wrote.<\/p>\n\n\n\n

\u201cIn this case, there is no public benefit as a result of the defendants\u2019 use of Electric Avenue<\/em>,\u201d the judge wrote.<\/p>\n\n\n\n

\u201cAs the plaintiffs correctly argue, the defendants \u2018could have used any song, created a new song, or used no song at all, to convey the same political message in the infringing video\u2019.\u201d<\/p>\n\n\n\n

But the damage to Grant could be significant if the copyright to his songs was not strictly enforced, the judge noted.<\/p>\n\n\n\n

\u201cWidespread, uncompensated use of Grant\u2019s music in promotional videos \u2014 political or otherwise \u2014 would embolden would-be infringers and undermine Grant\u2019s ability to obtain compensation in exchange for licensing his music,\u201d the judge wrote.<\/p>\n\n\n\n

An attorney for Trump did not immediately return a request for comment from the publication.<\/p>\n
