Defence Force Captain Appeals Quantum of Damages Awarded by High Court<\/h3>\n\n\n\n

Defence Force Captain Javonson Willock has filed an appeal against the High Court’s decision to award him EC$25,000 in damages, seeking a higher amount. <\/p>

\"\"<\/a><\/div>\n\n\n\n

The appeal challenges the judgment delivered by Honorable Justice Jan Drysdale on June 27, 2024.<\/p>\n\n\n\n

Willock’s case originated from disciplinary proceedings initiated by the Antigua and Barbuda Defence Force (ABDF) in 2021, alleging misconduct. <\/p>

\"\"<\/a><\/div>\n\n\n\n

These allegations led to efforts to frustrate his rank, which the High Court later deemed invalid in 2023. <\/p>

\"\"<\/a><\/div>\n\n\n\n

While the court acknowledged the detrimental effects of the flawed disciplinary procedure, including ridicule and denial of legal representation, it awarded Willock significantly less than the EC$380,000 he sought.<\/p>\n\n\n\n

Grounds for Appeal<\/h3>\n\n\n\n

Willock contends that:<\/p>

The decision was influenced by bias.<\/p>\n\n\n\n

The general damages awarded were inordinately low.<\/p>

The court erred in not awarding exemplary and aggravated damages.<\/p>

Willock seeks to have the Court of Appeal to allow his appeal, Set aside the June 27, 2024, order and remit the matter to the High Court for retrial by another judge or increase the awarded damages through the Court of Appeal.<\/p>\n\n\n\n

This appeal highlights ongoing issues within the ABDF, with other officers also pursuing legal action to prevent detrimental changes to their ranks and benefits. <\/p>\n\n\n\n

The outcome could significantly impact future disciplinary actions within the Defence Force. It marks yet another round of legal battle for the captain.<\/p>\n\n\n\n
