The Court of Appeal has lifted an injunction which stopped work on the construction of an International Airport on Barbuda.<\/p>

\"\"<\/a><\/div>\n\n\n\n

The decision was handed down earlier today, paving the way for work to continue on the project which is said to be nearly 80 per cent complete.<\/p>\n\n\n\n

Sir Gerald Watt QC whose law firm dealt with the matter on behalf of the government, told parliament earlier today that the\u00a0appeal has been allowed.<\/p>

\"\"<\/a><\/div>\n\n\n\n

“The injunction is discharged…the court has held that the right to a hearing in sacrosanct,” the House Speaker and senior lawyer said.<\/p>

\"\"<\/a><\/div>\n\n\n\n

The action which was brought by John Mussington and Jacqueline Frank on August 2, 2018<\/g> was granted by a high court judge.<\/p>\n\n\n\n

The decision has been strongly criticised for the judge’s apparent failure to hear lawyers appearing for the Airport Authority and the Development Control Authority.<\/p>

“We thought that was thoroughly unfair, it was a breach of the rules of natural justice and the Court of Appeal agreed with our arguments,” said Dr. David Dorsette who appeared today on behalf of the government.<\/p>\n\n\n\n

Parties will return to court on September 26 to debate the substantive issue of the injunction.<\/p>
