During the month of September, officers from the Prices and Consumer Affairs Division say they will be schooling traders on misleading signs that are posted in many places of business on the island. <\/p>

They say the initiative aims to remind traders that signs displayed in their establishments stating that consumers cannot return items or get a refund, should not mislead consumers about their legal rights. <\/p>\n\n\n\n

“Signs suggesting NO REFUND or NO EXCHANGE are<\/g> contrary to the Consumer Protection and Safety Act, Cap.97 of the Revised Laws of Antigua and Barbuda, 1992, which prohibits any trade practice that misleads or confuses consumers and it is for this reason that the Division is undertaking this initiative to educate traders on how such signs could be differently worded.”<\/p>

For instance, instead of NO REFUND, the division says a correctly worded sign could read: \u201cPLEASE CHOOSE CAREFULLY! WE DO NOT GIVE REFUNDS JUST BECAUSE YOU CHANGED YOUR MIND.\u201d <\/p>

Or in the case of NO EXCHANGE<\/g> a correctly worded sign could read: \u201cPLEASE CHECK OUR STORE POLICY IF YOU ARE BUYING FOR SOMEONE ELSE.\u201d <\/p>\n\n\n\n

The Division says it has encountered instances in which traders display such signs on particular items knowing that the items are defective and they fail to inform consumers that the items are faulty in one way or another. <\/p>

\"\"<\/a><\/div>\n\n\n\n

However, upon the consumer detecting the fault, when he or she goes back to the trader to seek redress \u2013 be it a refund, an exchange or store credit \u2013 the consumer is told that they cannot receive redress on the basis of the sign or signs. Under the Sales of Goods Act, CAP.393 of the Revised Laws of Antigua and Barbuda, 1992, goods offered for sale should be of merchantable quality, fit for their intended purpose and as described to the consumer.<\/p>\n\n\n\n

According to the division, if an item is faulty, and the fault is not pointed out to the consumer before he or she makes the purchase, or the fault is identified at the time of use, the consumer is entitled to be duly compensated even if NO EXCHANGE OR NO REFUND signs were displayed.<\/p>

“We are aware that attempts to address such misleading signs have been met with criticisms from some traders in the past. However, we are hoping that both traders and their staff would receive this exercise in a positive manner as we seek to bring compliance to the law,” a press release stated.<\/p>
