Prosecutions,\u2019 newly appointed \u2018Director of Public Prosecutions (DPP) Adlai Smith,\u2019 may still find the road to travel challengingly long and difficult.\u2019 While he may not necessarily have invited the administrative wrath of \u2018Attorney General, Garth Wilkins,\u2019 none may feel overly-elated for criminalizing privilege-positioned people of the Federation of the twin-island nation of \u2018St. Kitts and Nevis\u2019 [Winnfm: September 29, 2023].<\/p><div id=\"antig-1441058704\" class=\"antig-content_4 antig-entity-placement\"><a None may also deny the need for \u2018Public officials\u2019 to remain \u2018squeaky clean\u2019 while in public office. Few understood that \u2018Public office is public trust.\u2019 Many that had accepted certain positions in governmental institutions, had entered \u2018spotless.\u2019 It has never been beyond public perceptions, that many had come out with more blemishes on their character, honesty and integrity, than \u2018spots\u2019 on a leopard. \u2018Integrity in Public Life Act,\u2019 was; (i) \u2018Passed by the Federal National Assembly of St. Kitts and Nevis [September 9, 2013]; (ii) Given the Legislative No: 18\u2019 [2013]; (iii) Five years later, it came into force\u2019 [July 11, 2018]; and (iv) Six years later; (a) \u2018Given effective compliant attention by a \u2018Pitbull of Prosecutions; and (c) Attacking from ordinary-privilege-positioned \u2018Public officials\u2019 to the Magistracy.\u2019<\/p>\n<p>DICTATES OF THE DPP<\/p>\n<p>No matter the language in which it was couched, \u2018DPP Adlai Smith\u2019 through the media had made it publicly clear that he had submitted\u00a0 \u2018Recommendations\u2019 to the \u2018St. Kitts\/Nevis Integrity Commissions (SKNIC).\u2019 It was also clear that the \u2018Chairperson, an eminent Retired Justice, Pearlette Lanns,\u2019 had subjected herself and the Commissioners to the \u2018Dictates of the \u2018DPP.\u2019 Since there has been no expressions of displeasure, it could reasonably be inferred that the \u2018Commissions\u2019 may have been receptive to either; (a) \u2018The Solicited; or (b) Unsolicited Recommendations.\u2019 Dedicated to the venerable \u2018Dr. Denzil Douglas\u2019 for his foxlike cunningness, wit and intellect.<\/p>\n<p>SADDLED AS A DONKEY<\/p>\n<p>Be it mistaken or unmistaken, there has been the appearance that both \u2018Chairpersons\u2019 of the \u2018St. Kitts and Nevis \u2018Integrity Commissions,\u2019 may have sought, and foisted their responsibilities\u2019 upon newly-appointed \u2018Director of Public Prosecutions (DPP), Adlai Smith.\u2019 Though he shall be encouraged, he may not even have suspected that he may have been \u2018Saddled as a \u2018Donkey\u2019 for a race in a \u2018Horse Derby.\u2019 Seemingly, finding the media glitz irresistible, in delight, the exuberant \u2018DPP,\u2019 spoke glowingly of his prosecutorial plans for \u2018Public officials.\u2019<\/p>\n<p>STATE FUNCTIONARIES<\/p>\n<p>None may find difficulty understanding the \u2018Functional Roles\u2019 of; (i) \u2018Director of Public Prosecutions (DPP), Adlai Smith; and (ii) Chairpersons of the \u2018St. Kitts and Nevis Integrity Commissions (SKNIPLC), Pearletta Lanns (Retired Justice (OECS); and Recaldo Caines.\u2019 That which two of the three \u2018State Functionaries\u2019 have in common, is a \u2018Legal\u2019 background. The former appeared before the Judiciary as a \u2018Crown Prosecutor,\u2019 while the latter sat as adjudicator and\/or arbiter with the \u2018Eastern Caribbean Supreme Court (ECSC).<\/p>\n<p>SENSATIONAL NEWS<\/p>\n<p>When news, \u2018Sensationally\u2019 broke that newly-appointed \u2018Federation of St. Kitts and Nevis, Director of Public Prosecutions (DPP), Adlai Smith\u2019 had charged some 9-public officials,\u2019 it nether borne \u2018Fact nor Truth.\u2019 None of the identified public officials has ever been; (a) \u2018Arrested; or (b) Charged.\u2019\u00a0 This was neither so by the Police in whom; \u2018Powers of Arrest\u2019 resides at; (i) \u2018Common; and (ii) Statute Law.\u2019 The news portals scooped the news that were circulated universally. Reporters may not have heard the \u2018DPP\u2019 speaking to the issuance of summons.<\/p>\n<p>COWED INTO SUBJECTION<\/p>\n<p>That which shall be known to all a sundry, is that, neither the \u2018Integrity Commission,\u2019 nor the \u2018DPP,\u2019 enjoys \u2018Powers of Arrest.\u2019 The Process,\u2019 calls for; (i) \u2018Filing of \u2018Complaints Without Oath; (ii) Issuance of Summonses by a Magistrate; and (ii) Timely service on the named Defendants.\u2019 Such Summons shall contain the necessary particularities of the offence\/s.\u2019<\/p>\n<p>SENSATIONALISM<\/p>\n<p>Moreover, no such powers reside, neither in the \u2018Office of Director of Public Prosecutions,\u2019 nor the holder of the office. Such news was good only for \u2018Sensationalism.\u2019 Even so, something was about to happen to \u20189-public officials,\u2019 ironically, one of whom was a \u2018Sitting District Magistrate.\u2019 While it may have inspired much media and public interests, that which was reportedly underway was the preparation of \u2018Court Processes.\u2019<\/p>\n<p>PROSECUTORIAL EXPLOITS<\/p>\n<p>While the enthusiastic \u2018Public Prosecutor Senior,\u2019 then Crown Counsel, Adlai Smith\u2019 may have been a terror to \u2018former Antigua and Barbuda Director of Public Prosecutions (DPP), Anthony Armstrong,\u2019 nothing appeared to have held terror for him. None had posed a threat, neither to his \u2018Prosecutorial Exploits,\u2019 nor his ambitions or desires in heading \u2018an Office of the Director of Public Prosecutions.\u2019 Engaged to conduct \u2018Public Prosecutions\u2019 in the \u2018Federation of St. Kitts and Nevis,\u2019 clearly fulfilled his \u2018Hopes and Aspirations.\u2019 Congratulations.<\/p>\n<p>PRIVILEGE POSITIONS:<\/p>\n<p>The course of action initiated in collaboration with the \u2018Integrity Commission,\u2019 appeared capable of prompting inferences that the individuals publicly identified, were specifically targeted by an apparent environmentally-exploited and \u2018an Integrity Commission,\u2019 seemingly \u2018Cowed into Subjection,\u2019 through the \u2018Office of DPP.\u2019 That which people have long come to realize, was that those given \u2018Privilege Positions,\u2019 shall do the unthinkable. Thus, nothing shall befuddle the human mind.<\/p>\n<p>NO INTEGRITY<\/p>\n<p>It was widely known that some \u2018Integrity Commissions,\u2019 invariably gave the impression, that they have \u2018No Integrity.\u2019 It was also known that not infrequently, the membership has allowed themselves to be exploited by the environment. The experiences of a veteran Law enforcer, John Pelle 61; (i) \u2018Served for \u201843-years; (ii) Deceased with active membership at the lowly rank of \u2018Senior Sergeant\u2019 [Antigua News Room: January 7, 2024].<\/p>\n<p>MORE IRONY<\/p>\n<p>Most ironical, half the membership of the \u2018Police Service Commission (PSC)\u2019 has been Police Retirees with ranks of: (a) \u2018Inspector: (b) Superintendent; and (c) Deputy Commissioner.\u2019 Even more ironical, some appeared to have deprived the deceased office of the prestigious \u2018Queen\u2019s Police Medal (QPM). Still, \u2018More Irony,\u2019 in an apparent farcical \u2018Medal Ceremony\u2019 he was awarded a \u2018Medal for Meritorious Service\u2019 [Real News: November 5, 2021].<\/p>\n<p>TARGETED DRAGNET<\/p>\n<p>Actually, a friend, and well known to the author, the \u2018Public Prosecutor\u2019 appeared saner, than most of the membership of some \u2018Commissions.\u2019 In his prosecutorial position, that which might reasonably be inferred, may have been; (i) \u2018The way the \u2018St. Kitts\/Nevis Commissions\u2019 should run their affairs; and (ii) Devising a strategy of a \u2018Targeted Dragnet; (a) \u2018Desired results; and (b) Initiatives\u00a0 that shall have psychological impact on the hesitant or defiant non-compliant Declarants.\u2019<\/p>\n<p>PROSECUTORIAL TIGER<\/p>\n<p>It was also clear from; (a) \u2018Letters purportedly written to certain \u2018non-compliant Declarants,\u2019 a \u2018Prosecutorial Tiger,\u2019 was lurking to prey on those identified by the \u2018Commissions.\u2019 That which, in some regional jurisdictions, appeared to have prompted \u2018Serious Queries,\u2019 was; \u2018How a person taking up \u2018Public office\u2019 in \u2018October 2023,\u2019 becomes so intimately familiar with the cultural landscape of the jurisdiction within 90-days?\u2019<\/p>\n<p>MORIBUND INTEGRITY COMMISSION<\/p>\n<p>It also begs other probing questions such as; \u2018What empowers a \u2018Director of Public Prosecutions (DPP),\u2019 to take over, and perform the administrative functions of the \u2018Integrity Commission?\u2019 In spite of these \u2018Queries,\u2019 it was obvious that there may have been the need for an injection to stimulate the operational life of an apparent \u2018Moribund Integrity Commission.\u2019 Clearly not seen as an interventionist, the \u2018Commission\u2019 appeared well-positioned to overcome existed challenges.<\/p>\n<p>RADAR OF PROSECUTION<\/p>\n<p>Notwithstanding, the action taken, \u2018Declarants\u2019 shall have been circumspect, that a \u2018Prosecutorial Tiger\u2019 was about to be released upon them from the \u2018Cage of the Integrity Commission.\u2019 The \u2018non-compliant \u2018Declarants,\u2019 shall have been mindful that they may have been long kept under the \u2018Radar of Prosecution.\u2019 It may have been only a matter of time, before the \u2018Government\u2019s crazed or crazy \u2018Public Prosecutor,\u2019 done the desirable. Even so, neither of the two \u2018Chairpersons, Pearlette Lanns and Recaldo Caines\u2019 shall escape \u2018Public Scrutiny.\u2019 Neither may dissociate the \u2018Commissions,\u2019 nor themselves from the course of action initiated by the \u2018DPP.\u2019<\/p>\n<p>PROSECUTORIAL ACTIONS<\/p>\n<p>That which may have influenced him appeared mindboggling. An apparent \u2018Targeted Dragnet,\u2019 backed up by intimidatory tactics and threat of prosecution of those alleged to have been \u2018non-compliant,\u2019 have left the \u2018Magistracy,\u2019 totally embarrassed. There was no way \u2018Her Ladyship, Justice Pearletta Lanns,\u2019 now retired, may dissociate herself from the \u2018Prosecutorial Actions\u2019 initiated against \u20188-ordinary public officials and a \u2018District Magistrate, His Worship Fitzroy Eddy\u2019 [Times Caribbean Online: February 1, 2024].<\/p>\n<p>FILING PROCESS<\/p>\n<p>This view was held, in spite of the latter\u2019s public expression of displeasure with the \u2018long-winded process of filing supporting documents, that he alluded was a disadvantage to the Commission\u2019 in completing examination of the \u2018Declarations\u2019 [St. Kitts\/Nevis; (WINN): December 9, 2023]. Should the summoned non-compliant \u2018Declarants\u2019 found the process equally as cumbersome, there may be no reason why they may not cause the \u2018Chairperson Recaldo Caines\u2019 to be subpoenaed to give evidence on behalf of the defence.<\/p>\n<p>PRE-EMPTIVE ACTION<\/p>\n<p>Notwithstanding, the \u2018Pre-emptive Action,\u2019 the \u2018Chairpersons\u2019 shall have known that the office of \u2018DPP,\u2019 has no legitimate administrative functions, or responsibility in receiving and examining \u2018Filed Declarations.\u2019 \u00a0It shall be authoritatively stated, that the \u2018DPP\u2019s Reminders to \u2018Declarants,\u2019 were not only appeared inept, but starved for legitimacy and constitutional or statutory authority. In ensuring that there was clarity of understanding, the Section of law, as hereunder refers, is provided for even a \u2018Second Former at the \u2018Cayon High School and Third Former at the \u2018Gingerland Secondary School\u2019 to know.<\/p>\n<p>SATISFACTION OF BREACH: REFERRALS TO DPP<\/p>\n<p>It was not expected that \u2018Kindergarteners\u2019 to know these provisions. The statutory provision unambiguously states; \u2018A person who fails, without reasonable cause to furnish the \u2018Commission\u2019 a declaration, commits an offence under the \u2018Integrity in Public Life Act (IPLA)\u2019 [Chapter 22.18: Section 30 (1)]. Instructively, the \u2018IPLA\u2019 provides for the \u2018Commission\u2019 to make \u2018Referrals to the Director of Public Prosecutions.\u2019 For ease of reference, it states; \u2018Where the \u2018Commission\u2019 is \u2018Satisfied that a Breach\u2019 of any of the provisions of this \u2018Act\u2019 has been committed, the \u2018DPP\u2019 shall take such action as deems fit\u2019 [IPLA: Section 37 (1) (a)].<\/p>\n<p>SCHEME OF COLLUSION<\/p>\n<p>That which inferentially speaks to a well-orchestrated \u2018Scheme of Collusion\u2019 between the two \u2018Commissions (SKNIC)\u2019 and the \u2018Office of DPP,\u2019 might be discerned from this news report. Whether or not it was not so considered, it may have been a tactical communication error, when media reports quoted \u2018DPP Adlai Smith\u2019 saying; \u2018He has engaged closely with the Commission to address several pertinent issues, and submitted recommendations to ensure adherence to the legal requirements\u2019 [St. Kitts\/Nevis Observer: February 1, 2024]. Such disclosure appeared administratively unwitting.<\/p>\n<p>INTER-AGENCY COOPERATION<\/p>\n<p>Guided by the functional principle, \u2018Inter-Agency Cooperation,\u2019 the \u2018DPP\u2019 appeared to have tasked himself with assisting the \u2018Integrity Commissions\u2019 in \u2018Promoting a Culture of Integrity and Accountability\u2019 [Office: Integrity Commission]. However, it worked, let it be. Those that are familiar with \u2018Law Enforcement,\u2019 know that \u2018Magistrates and Clerks of the Courts,\u2019 are not as daft, as to cause a \u2018Summons\u2019 to be issued against a Defendant\u00a0 without a \u2018Complaint\u2019 being filed in the name of the person or authority, making such complaint.<\/p>\n<p>SHORT LIST<\/p>\n<p>The \u2018Short List of \u2018non-compliant Declarants\u2019 included; (i) \u2018Magistrate, Fitzroy Eddy: (ii) Broadcaster, Saju N\u2019Gla; (iii) Government-employed Urban Developer, Ricky Lenrick Lake; (iv) Air\/Sea Port Manager, Oral Brandy; (v) Nevlec Chairperson, Steadmon Tross; (vi) Nevlec Manager, Albert Gordon; and (vii) Nevis Tourism Authority Chairperson, Pamela Martin.\u2019 It begs this question; \u2018Where was the \u2018Attorney General and Principal Legal Adviser to his Government, to guide the understanding of the \u2018Integrity Commissions?\u2019<\/p>\n<p>INTEGRITY MATHEMATICIANS; STARTLING REVELATIONS<\/p>\n<p>It was obvious that the \u2018Commission\u2019 has among the membership \u2018Integrity Mathematicians.\u2019 Proportionately, the \u2018Math\u2019 persons ensured there was equality in numbers. Seemingly carefully \u2018Targeted,\u2019 there were three non-compliant Declarants on both \u2018St. Kitts and Nevis.\u2019 When the \u2018Dragnet\u2019 was implemented, it saw \u2018Startling Revelations.\u2019 It saw the published names and identities of those so \u2018Targeted,\u2019 be they \u2018Declarants or Non-Declarant.\u2019<\/p>\n<p>WRONG PREY<\/p>\n<p>Even sometimes, \u2018Tigers\u2019 may attack the \u2018Wrong Prey.\u2019 So too, were impotent \u2018Integrity Commissioners and overzealous Prosecutorial Tigers.\u2019 Seemingly, in indecent haste to institute criminal proceedings against non-compliant Declarants, prosecutorial exuberance saw this news portal apology; \u2018The DPP\u2019s office issued an unreserved apology to \u2018Ms. Oureika Petty,\u2019 a Coordinator with the \u2018National Office of Disaster\u2019 [Times Caribbean Online: February 1, 2024].<\/p>\n<p>GRAVE LITIGIOUS ERROR<\/p>\n<p>Since the \u2018Director of Public Prosecutions (DPP),\u2019 inferentially, may have been acting on behalf of these \u2018Chairpersons,\u2019 none could dissociate him\/herself from the \u2018Grave Litigious Error.\u2019 This may have been equally embarrassing to the named person, as it may have been for; (i) \u2018DPP Adlai Smith; (ii) Chairpersons of the of the St. Kitts and Nevis Integrity Commissions (SKNIC), Pearletta Lanns and Recaldo Caines.\u2019\u00a0 Such an \u2018Apology,\u2019 makes litigious consequences damning against both; (i) \u2018The Integrity Commissions\u2019 for misleading the DPP; and (ii) The \u2018DPP\u2019 for apparently misdirecting himself, in causing to be published \u2018False Information\u2019 on an innocent citizen.<\/p>\n<p>INDICTABLE PENALTIES<\/p>\n<p>Accepting the contents of the news report as verified facts, it has shown that people may use their intellect and egoistic ambitions, in ways that marvel; That even those that hold the positions of: (i) \u2018Integrity Commissioners; and (ii) DPP\u2019s, would go in seeking to destroying legal counterparts. In criminal prosecutions of those that were alleged to have become \u2018Offending Declarants,\u2019 each now faces \u2018Indictable Penalties,\u2019 if convicted. This includes; ( a) \u2018The imposition of Fine of EC$30, 000; or (b) In default of payment, a term of \u2018Imprisonment\u2019 that was not to exceed 5-years\u2019 [IPLA: Section 30 (1)].<\/p>\n<p>EXPLOITED COMMISSIONERS\u2019 IGNORANCE<\/p>\n<p>This, any \u2018Judge,\u2019 whether sitting or retired or other person holding positions on these \u2018Commissions,\u2019 shall know that they run the risk of being seen by the \u2018offending Declarants\u2019 as \u2018Collaborators.\u2019 Such may also have caused the \u2018Director of Public Prosecutions (DPP),\u2019 to have harbored the view that they were reckless not knowing sufficiently, the provisions respecting \u2018Integrity in Public Life.\u2019 This would have been good reasons for a \u2018DPP\u2019 to have \u2018Exploited the Commissioners\u2019 Ignorance.\u2019<\/p>\n<p>INTIMIDATORY TACTICS<\/p>\n<p>The news portal also reported; \u2018Directorate, Adlai Smith reinforced the \u2018DPP\u2019s\u00a0 \u2018Unwavering Resolve\u2019 to prosecute any violations of the Integrity in Public Life Act\u2019 [Chapter 28. 18: Laws: Federation of St. Kitts and Nevis]. The following paragraph speaks to a \u2018Prosecutorial Scheme.\u2019 Clearly using \u2018Intimidatory and Prosecutorial Tactics,\u2019 the news story continued;\u00a0 (a)\u2018Whether it be in St. Kitts or Nevis, the persons who are required to \u2018File Declarations,\u2019 I am appealing to you to file\u2019 [February 1, 2024]. This was never an administrative function of the \u2018DPP.\u2019<\/p>\n<p>THREAT OF PROSECUTION<\/p>\n<p>Ensuring that the \u2018Intimidatory Tactics\u2019 worked, the \u2018DPP\u2019 was further quoted, saying; (b) \u2018I am just letting you know, one last time, that I am very serious about it.\u2019 Saturating the minds of the \u2018non-compliant Declarants with the \u2018Threat of Prosecution,\u2019 media reports finally quoted him saying; (c) I have the charges filed; and (d) It is just to put in the information that I need administratively, to make the Summons work.\u2019 As it relates to the prosecutorial process, \u2018Complaints\u2019 may be filed in the name of the \u2018Integrity Commission.\u2019 Constitutionally, such may also be filed in the name of the \u2018DPP\u2019 [SKN: CO: No.881 of 1983: Section 65].<\/p>\n<p>BENEFIT OF KNOWLEDGE<\/p>\n<p>For the \u2018Benefit of Knowledge,\u2019 and\/or academic interest, where no formal arrests were made on the non-compliant Declarants, this process calls for\u00a0 \u2018Complaint Without Oath and Summons,\u2019 bearing particularities of the offence to be filed and issued. Still, it begs the question; \u2018What administrative information was needed\u2019 by \u2018Director of Public Prosecutions (DPP), Adlai Smith,\u2019 to complete the formalities of \u2018Filing Complaints and apply for Issuance of Defendant Summons?\u2019<\/p>\n<p>FAILING TO FURNISH DECLARATION<\/p>\n<p>In the instant cases, the accused persons may be summoned to answer the \u2018Complaints; \u2018Failing to Furnish Declarations\u2019 to the Commissions on these particularities; (a) \u2018Interest in property; (b) Income; (c) Assets; (d) Liabilities; (e) Gifts- Cash or in kind received by; (i) \u2018Him\/herself; (ii) Spouse; or (iii) Dependent children\u2019 [IPLA: Section 5]. Such information could only be ascertained by Commission-appointed Investigators [IPLA: Section 24]. This may also be an exercise, that likened to the \u2018Commission and the DPP,\u2019 they shall also find challenging in marshaling the pertinent information.<\/p>\n<p>THE DECLARANTS<\/p>\n<p>Consequent upon the post or positions held in \u2018Government,\u2019 the \u2018Act\u2019 identifies the \u2018Public Officials\u2019 as; (i) \u2018Members of the National Assembly; (ii) Speaker of the National Assembly; (iii) Ministers of Government; (iv) Parliamentary Secretaries; (v)\u00a0 Permanent Secretaries; (vi) Heads of Department in Government Ministries; (vii) Solicitor General; (viii) Legal officers above Grade K40; (ix) Heads of Diplomatic Missions; (x) Head of Armed Forces; (xi) Commissioner of Police; (xii) Superintendent of Prisons.\u2019 The \u2018Act\u2019 provides for a \u2018period for \u2018Filing Declarations\u2019 that Declarants be notified by a published \u2018Order\u2019 [Section 5 (1)].<\/p>\n<p>OTHER PUBLIC OFFICIALS<\/p>\n<p>Even without a specific date, no \u2018Declarant\u2019 shall be reckless or feign ignorance not to have informed him\/herself of the provisional requirements. Ensuring that other \u2018Public officials\u2019 were umbrellaed under the \u2018;Integrity in Public Life Act,\u2019\u00a0 the list includes; (xiii) Director of Audit; (xiv) Chairpersons of Statutory Bodies; (xv) Board members; (xvi) Directors of majority State-owned\/controlled Banks\/Other financial institutions\/companies; (xvii) Managers of such entities; (xviii) Chairperson of Political party; (xix) Executive members; and (xx) Declared political party candidates\u2019 [IPLA: Section 3].<\/p>\n<p>PUBLIC CORRUPTION<\/p>\n<p>Research has revealed that a certain internal body, with membership in association with each other to curb \u2018Public Corruption,\u2019 was recently conferenced in \u2018Guyana.\u2019 The body is called the \u2018Commonwealth Caribbean Association of Integrity Commissions, and Anti-Corruption Bodies (CCAICACB).\u2019 Except for the well-learned and those that may have been well-positioned to be informed,\u00a0 few \u2018grassroots\u2019 people may have heard of it. To those living at the \u2018Edge of Poverty,\u2019 such body has no significance to the indigent.<\/p>\n<p>CCAICACB CHALLENGES<\/p>\n<p>Chairperson of the Conference, and \u2018St. Kitts and Nevis Integrity in Public Life Commissioner, Pearletta Lanns\u2019 (Retired Judge), reportedly highlighted certain \u2018Challenges\u2019 that had faced the \u2018Commissions.\u2019 The most fundamental challenges that were highlighted included; (a) \u2018Lack of support; (b) Issues with independence; and (c) Impartiality.\u2019 These have been the shared experiences of all the nations then represented [Guyana: Communique: May 17, 2023].<\/p>\n<p>POWER OF TRUTH: ADMINISTRATIVE SUPPORT<\/p>\n<p>Speaking to the \u2018Power of Truth,\u2019 the \u2018Conference Chairperson, Pearletta Lanns\u2019 may have prompted inferences that \u2018Administrative Support\u2019 was gravely lacking. Such could only have been inferred as among the myriad of difficulties posed by the governing administrations. This distinguished and eminent \u2018Justice\u2019 shall know, or may have been reckless not to know that interference with; (a) Independence; (b) Impartiality; and (c) Integrity,\u2019 has always been part of being given \u2018Privilege Positions.\u2019<\/p>\n<p>CONCLUSION<\/p>\n<p>Given the constitutional functions of the \u2018Director of Public Prosecutions,\u2019 the \u2018Chairpersons\u2019 of the referred \u2018Integrity Commissions,\u2019 were appointed to perform the statutory and administrative functions of all \u2018Government-controlled Commissions.\u2019 Those that were well-known include; (i) \u2018The Public Service; (ii) Police Service; (iii) Electoral; and (iv) Integrity Commissions.\u2019 Consequent upon their constitutional and\/or statutory purposes for these \u2018Commissions,\u2019 only the \u2018Chairpersons shall perform the stipulated functions. They need no reminders that \u2018Truthfulness; Sincerity; and Honesty,\u2019 are all part of the concept called-Integrity.\u2019 Moreover, no matter the indiscretions, they shall always respect the dignity and worth of the human person.
