When \u2018Saints or Sinners\u2019 looked up at the skies, they are said to be looking at \u2018Heaven.\u2019 When they are airborne, and looked down on the \u2018Earth,\u2019 they are said to be looking at \u2018Hell.\u2019 Though it is not called \u2018Hell,\u2019 there is a place on mainland \u2018Antigua,\u2019 called \u2018Devil\u2019s Bridge.\u2019 No one knows just where\u00a0 hell is. There is the naturally-carved out \u2018Peninsula,\u2019 with fiercely rolling Atlantic waves.\u2019 Though so named, none has ever seen the devil.<\/p>

\"\"<\/a><\/div>\n

TERROR AND HORROR<\/p>

\"\"<\/a><\/div>\n

Peculiar as the name \u2019Devil\u2019s Bridge\u2019 may be, and unusual a name for a \u2018Place and Bridge,\u2019 it holds no \u2018Terror and Horror\u2019 to the non-adventurous nationals, residents and visitors. Many people are afraid of the \u2018Devil,\u2019 and the \u2018Bridge.\u2019 Still, many are not afraid, neither of him, nor the dangers posed. Non-seductive; non-enticing; and uninviting, seemingly those not so afraid, have riskily entered upon it, to see \u2018Something.\u2019<\/p>\n

UNDER THE DEVIL<\/p>

\"\"<\/a><\/div>\n

These, however, may be experienced by the \u2018Adventurous\u2019 and the \u2018Risk-Takers.\u2019 They are not afraid. These are the ones likely to attempt to cross over, or swimming near to, or \u2018Under the Devil.\u2019 Though not physically seen, he appeared always to be on top of the \u2018Bridge.\u2019 For the unsuspecting and innocent visitor, particularly him\/her pre-determined to die, it means an instant watery death. This would be \u2018an unlawful killing,\u2019 disguisedly perpetrated to give the appearance of \u2018an Accidental or Suicidal Death.\u2019<\/p>\n

PERSPECTIVE<\/p>

\"\"<\/a><\/div>\n

Criminally, those without the benefit of formal investigative training, may not necessarily harbor thinking that may guide approaches to the solving crime. The incident at the \u2018Bridge of the Devil\u2019 makes the point. This commentary looks at an apparent well-orchestrated and deeply suspicious criminal act of murder. From all indications, and in particular, the isolated locale and peculiar time \u2018between 6 am and 6. 45 am,\u2019 for an early morning visit, suggested an ideal \u2018Place and Time\u2019 for the\u00a0 perpetration of a heinous criminal act.<\/p>

\"\"<\/a><\/div>\n

DEFLECTING SUSPICION<\/p>\n

In the case of the \u2018Devil\u2019s Bridge\u2019 incident, criminal investigators shall know that in the absence of \u2018an eyewitness\u2019 account, criminal suspects are not expected to incriminate themselves in criminal wrongdoings. They shall also know that accounts will be given, either to \u2018Deflect Suspicion\u2019 or \u2018Pervert the Course of Justice.\u2019 The investigator that appeared at the \u2018Scene of Death\u2019 and does not \u2018Think Crime,\u2019 is more useful to criminals than of the population. Still, criminals shall know that no matter the disguise or sophistication, some \u2018Damning Circumstance\u2019 invariably exists to aid \u2018Detection of Crime.\u2019<\/p>\n

SURROUNDING CIRCUMSTANCES<\/p>\n

Though sometimes not readily available, working as a team, the astute and meticulous criminal investigators often look closely at a set of \u2018Surrounding Circumstances.\u2019 Then they may draw reasonable inferences in assisting in developing rationally conceptualized theories. Such \u2018Theories\u2019 often guide a functional approach, that invariably, produced desired and satisfactory investigative results.<\/p>\n

BROKEN GLASS SYNDROME<\/p>\n

Looked at from the perspective of staging the heinous criminal act of murder, the murderer often attempted to make it may appear either \u2018Accidental or Suicidal.\u2019\u00a0 It has been the professional experience that many \u2018Murder Suspects\u2019 have rarely found their way out of jeopardy and the penitentiary.\u00a0 Early in Law enforcement, it was repetitively instructed as to be inculcated in the mind this quote; \u2018\u2026Commit a crime and the world is made of glass. Most importantly, trainees were told that no matter the crime or the sophistication employed; \u2018Some damning circumstance always exists.\u2019 [\u2026.]. The \u2018Broken Glass-Syndrome,\u2019 speaks to these truths.<\/p>\n

DEAFENING SILENCE<\/p>\n

Consequent upon that which criminal investigators have informed the citizenry that was under investigation, some two weeks have passed in \u2018Deafening Silence.\u2019 Suspecting the \u2018Devil\u2019s Bridge\u2019 incident to be \u2018Drowning-related, could prove that law enforcement personnel might be starved for professional investigative training. Pointing toward a \u2018Coroner\u2019s Inquisition,\u2019 those with statutorily-imposed duties shall be gently reminded of their obligations. Moreover, they shall be mindful of perilous consequences, intended to ensure compliant with regulations and \u2018Obedience to Law.\u2019<\/p>\n

DEEPLY SUSPICIOUS DEATH<\/p>\n

That which has since become of topical interest to every law-abiding citizen and every \u2018bona fide visitor,\u2019 has been the \u2018Deeply Suspicious Deaths\u2019 of a mother and her innocent son. Parliament anticipated that deaths that have inspired public interest, and inaction that may provoke public wrath, shall be addressed by; (i) \u2018District Coroners; and (ii) The Director of Public Prosecutions (DPP).\u2019 Thus, the law provides; \u2018The \u2018DPP\u2019 may require any Coroner to hold an Inquest into; (a) \u2018The Cause of; and (b) Circumstances connected with the death of any person\u2019 [Coroners Act: Chapter 105: Section 44].<\/p>\n

TALKING OR SOLVING CRIME<\/p>\n

It has been the experience that some personnel are good at \u2018Talking\u2019 to the incidents of crime. Take not that from the \u2018Talkers.\u2019 Even as some delight in parading before television cameras, \u2018Making Belief,\u2019 as it affects criminal investigation, likened to the \u2018Old Lady\u2019 that lived in the \u2018Shoe,\u2019 many have not the \u2018Slightest Clue\u2019 as to what they shall do.<\/p>\n

DEVIL\u2019S BRIDGE INCIDENT<\/p>\n

Those lacking the requisite skill-set and capacity of the trained criminal investigators, may not see, what others have seen. These are the ones who believed that the \u2018Mother and son,\u2019 on their own volition, entered upon the \u2018Bridge of the Devil,\u2019 accidentally fell and inescapably drowned. While it may pose some\u00a0 difficulty for some personnel, the viewed from the perspective of a criminal act, this incident shall never be seen as unsolvable.<\/p>\n

NATURAL JUSTICE<\/p>\n

Some fourteen days have passed since the family of three, was struck by a \u2018Devastating Tragedy.\u2019 Incidentally, except for the assigned criminal investigators, the tragedy has perplexed the entire nation. So perplexed, that vendors at the public market have rejected the account of the \u2018husband\/father\u2019 as to the circumstances surrounding the apparent suspicious and unsuspecting \u2018Lured to Death\u2019 wife and son.\u2019 Whatever the suspicion, no judgement shall be passed against the father. Besides the \u2018Constitution Order\u2019 not only provides every suspected or criminally-charged person, the right to the presumption of innocence, and the legal principle-\u00a0 \u2018Natural Justice.\u2019<\/p>\n

WONDERS OF NATURE<\/p>\n

Something has happened to reinforce belief that \u2018Satan is Real.\u2019 Seemingly, with reckless abandon, if so accepted, they reportedly visited the \u2018Peninsula\u2019 to\u00a0 observe the \u2018Rising Sun.\u2019 This could have been observed at any part of the world, including Canada.\u2019 Clearly, heartlessly; irresponsibly and helplessly, a husband watched them succumbed to the \u2018Perils of the Sea.\u2019 This has been the early morning, when they had been clearly \u2018Lured\u2019 into traversing across the spectacle, seen as one of the many \u2018Wonders of Nature.\u2019 They both disappeared into the deep blue sea.<\/p>\n

MURDER OR MISADVENTURE<\/p>\n

Clearly not devoid of understanding, law-abiding citizens have seen that which criminal investigators have not seen. Mindbogglingly, where the lay persons saw two \u2018Suspected Murders,\u2019 law enforcers saw two \u2018Suspected Drownings.\u2019 The lay persons have seen a \u2018Crime\u2019 being perpetrated against an innocent and unsuspecting mother and son. Somewhat daftly, Law enforcement saw a \u2018Misadventure,\u2019 resulting from an accidental fall and two accidental drownings.<\/p>\n

DOUBLE-DROWNING<\/p>\n

When news broke of a \u2018Double-Drowning\u2019 at the \u2018Bridge\u2019 called \u2018Devil,\u2019 instantaneously, the nation was driven into a somber mode. Citizens, barely awaked from overnight sleep, were not only jolted off their beds, but also shocked into dismay. When it was revealed that a \u201837-year-old Canadian mother and her 5-year-old son\u2019 were the victims, all rightful thinking mothers and fathers wondered and quizzed what both mother and son were doing at the \u2018Bridge of the Devil,\u2019 between the rather unusual time; \u20186 am and 6. 45 am\u2019 [November 30, 2023].<\/p>\n

UNSWIMMABLE WATERS<\/p>\n

Most citizens in reverence with \u2018God\u2019 was horrifyingly greeted with awe. The nation, shocked into disbelief that a \u2018Mother and Child,\u2019 fell off the \u2018Bridge of the Devil,\u2019 into \u2018Unswimmable Waters. No other person was present, and no one knew of the \u2018Circumstances\u2019 surrounding; (a) \u2018Their presence at, or on the \u2018Bridge of the Devil; and (b) Their deaths, but \u2018husband and father, Satwick Misna.\u2019 Hearts, broken and saturated with sadness, the concerned mothers and fathers and husbands and wives, frantically searched for answers.<\/p>\n

EVE OF DEPARTURE<\/p>\n

That which seemingly boggled the mind of the nation, was that tragedy struck only a \u2018Mother and Child\u2019 on the \u2018Eve of Departure\u2019 from \u2018Antigua and Barbuda.\u2019 The three-member family, comprising of; (i) \u2018Husband Satwick Misna 38; (ii) Wife and mother, Mohini Misna 37; and (iii) An innocent 5-year-old son, Shray.\u2019 They reportedly found themselves on the \u2018Bridge\u2019 and over the sea, that legends associated with the \u2018Devil.\u2019<\/p>\n

CARIBBEAN SUNRISE<\/p>\n

The \u2018Misna\u2019 family, visiting from \u2018Canada,\u2019 apparently, as part of the visitor experience, they appeared to have been guided to the \u2018 Bridge of the Devil.\u2019 Reportedly, to witness a \u2018Caribbean Sunrise.\u2019 They may have truly believed that they were taken there, expectedly to see the \u2018Sun\u2019 emerging over the horizon into the eastern sky of \u2018Antigua and Barbuda.\u2019 Prior to the \u2018Fateful Visit\u2019 to the \u2018Bridge of the Devil,\u2019 no one knew of the possibility of enduring miseries for the last seven days of their lives, and the final week in the month [November- 2023].<\/p>\n

ISLAND PARADISE<\/p>\n

As an ideal tourist destination, the nation continues to be advertised as an \u2018Island Paradise.\u2019 Clearly, with its natural national attractions, among which, the spectacle of a \u2018Bridge\u2019 named the \u2018Devil.\u2019 The online information purportedly provided by the \u2018National Parks Authority (NPA),\u2019 describes it as; \u2018A rugged limestone bridge formed by crashing waves, with \u2018blowholes\u2019 [NPA: Google]. Irrespective of fantasies, these \u2018blowholes or outlets\u2019 carved by the constantly fierce-rolling Atlantic waves, are equally as dangerous to cross, as the lanes of the \u2018Friar\u2019s Hill Highway.\u2019<\/p>\n

MARVELS AND BOGGLES<\/p>\n

Though not necessarily as frequent, the crashing waves could cause a person to challenge \u2018Commissioner of Police, Atlee Rodney QPM\u2019 in flight skyward off the \u2018Bridge.\u2019 Billowing of the \u2018Atlantic Sea,\u2019 crashing waves have been sending water spouting spectacularly in the air through the \u2018blowholes.\u2019 These, to the nationals often \u2018Marvelous\u2019 the eyes and \u2018Boggles\u2019 the mind. Still, the \u2018Devil\u2019 in the \u2018Bridge\u2019 has never been seen. That which might easily be said of the \u2018Bridge\u2019 has been the rugged, uneven and sharp-pointed rocky surface.<\/p>\n

BAKKA AND CEJHA<\/p>\n

These have made it extremely difficult for even a leisurely walk from one end to the other. Since the \u2018Bridge\u2019 was called Devil,\u2019 it will have been a pathway to some place not called \u2018Heaven\u2019 or \u2018Yasco Sports Complex.\u2019 Even tempted by the \u2018Devil,\u2019 the athleticism, adroitness and agility of the two national sprinters, \u2018Daniel \u2018Bakka\u2019 Bailey and Cejha Greene,\u2019 could never have attempted a stumble-free \u20182-meter sprint across the \u2018Bridge.\u2019 Neither would they attempt a muscle-toning swim in the choppy\u00a0 and treacherous waters below.<\/p>\n

BOY SAW SOMETHING AND RAN<\/p>\n

Feeding \u2018Police and officialdom with a \u2018Pot Spoon,\u2019 the lone witness to the incident reportedly explained to \u2018Tourism Minister, Charles \u2018Max\u2019 Fernandez\u2019 in these media-quoted lines; \u2018\u2026The little boy saw something and ran; \u2026Just then, a wave came up; \u2026He grabbed his mother\u2019s legs; and they both fell into the water.\u2019 Clearly, with a sudden crashing wave no little 5-year-old\u00a0 boy has such reflexes. Even as such appeared to have been inconsistent with truth, law enforcement and \u00a0the \u2018Minister,\u2019 likened to a Duck beaking a worm, appeared to have gobbled it down [CTV: Global Affairs: December 5, 2023].<\/p>\n

REASONABLE SUSPICION<\/p>\n

Incidentally, when it was revealed that the incident was reported by the husband of the woman and father of the young child, suspicious; distraught; and outraged,\u2019 citizens called for swift and decisive action to be initiated against him. They suspected that the infrequently visited area between dusk and dawn may have been for no other reason, but for an act of criminality. It was not surprising that the overwhelming majority of the citizenry, harbored \u2018Reasonable Suspicion\u2019 that foul-play had brought about their deadly demise.<\/p>\n

ASK FRANKIE<\/p>\n

An awkward stumble or a gentle tip of the heel or nudge by the elbow, means\u00a0 a fall that will result in bodily injuries. Worst yet, a fall of the \u2018Bridge of the Devil\u2019 into the sea, also means \u2018Sudden and Unnatural Death.\u2019 Logic dictates that the adventurous person falling into waters that were neither (a) \u2018Swimmable; nor (b) Navigable,\u2019 necessarily means sorrow and grief. One might now wish to ask \u2018Frankie;\u2019\u00a0 \u2018Why would a husband allowed his wife and son to be exposed to inescapable death?\u2019<\/p>\n

UNTIMELY DEATHS<\/p>\n

None may deny that life is full of complexities. None may also deny that equally as much, have been the complex nature and unpredictable behavior of humans. These, looked at from the perspective of crime, and for whatever may be the \u2018Motivating Factors,\u2019 humans continue to inflict serious harm upon others. Not infrequently, people from every stratum of society, have had their lives snuffed out, some innocently and unsuspectingly, unaware of their demise, some were lured to \u2018Untimely Deaths.\u2019<\/p>\n

THE PATHOLOGIST<\/p>\n

In fact, if so, determined by the \u2018Pathologist,\u2019 that will only be stated as the \u2018Cause of Death.\u2019 As it affects \u2018Natural and Unnatural Deaths,\u2019 here may be several \u2018Causes.\u2019 In the instant case, the likelihood of \u2018Drowning,\u2019 shall not be ruled out. The Pathologist will make such determination. He\/she will know whether or not the deceased were killed before their bodies entered the water. From professional observations, the post mortem shall\u00a0 show a \u2018water-filled lungs.\u2019<\/p>\n

CAUSES OF DEATH<\/p>\n

Forensically and evidentially, a \u2018Coroner and Jury\u2019 shall be guided to an understanding that a deceased person was alive, and that he\/she was inhaling. There are numerous \u2018Causes of Death.\u2019 Universally, among the \u2018widely known \u2018Causes of Death,\u2019 are: (a) \u2018The shot and killed: (b) Stabbed; (c) Hacked to death\u2019 (d) Tortured; (e) Strangled; (f) Suffocated: (g) Poisoned; (h) Overdosed (Michael Jackson); (i) Starved; \u2018Surgery-related death; (j) Electrocuted; (k) Hanged; (l) Pushed to death; or (m) Burned to death; and (o) Immovably-chained captive, held in a non-oxygenated gas-filled room.\u2019 Indeed, the Sciences, often helped in crime-solving.<\/p>\n

PATHOLOGIST REPORT<\/p>\n

Those unfamiliar with the statutory provisions contained in the \u2018Coroner\u2019s Act,\u2019 appear not to know that the death of a \u2018Mother and Child,\u2019 though sudden, were not due to \u2018Natural Causes,\u2019 as in the case of a \u2018Heart Attack.\u2019 As it relates to this incident, professional criminal investigation experience, suggests an agency, heading to the \u2018Cross-Road\u2019 to nowhere. This remains so, as criminal investigators await the \u2018Pathologist\u2019s Report\u2019 to ascertain the \u2018Cause or Causes of Death.\u2019<\/p>\n

WARPED MENTALITY \u2013 CONFUSED MIND<\/p>\n

Cognizance of man\u2019s evil-filled hearts, the lay person suspected that a crime has been committed.\u00a0 Yet the thoughts of those with responsibility for preventing and detecting crime, veered off into the sea. They saw \u2018Drownings.\u2019 Theirs was a \u2018Fixation on Cause of Death.\u2019 That which shall be said is that, though criminal investigators suspected drowning, such does not account for the \u2018Circumstances\u2019 surrounding the death of a mother and child. Nothing prevents the citizenry from believing that the approach to investigation into the \u2018Devil\u2019s Bridge\u2019 incident, speaks to a \u2018Warped Mentality\u2019 and a \u2018Confused Mind.\u2019<\/p>\n

PRIMA FACIE EVIDENCE<\/p>\n

Even without the benefit of \u2018Prima Facie Evidence,\u2019 the citizens were looking at the heinous crime of murder. Instructively, law enforcement harbored no such thoughts. Naturally, their suspicions of the presence at the \u2018Devil\u2019s Bridge\u2019 between \u20186 am and 7 am,\u2019 not only suggested some gory reasons, but also for something hideous to occur. Given their visitor-status and \u2018Canadian\u2019 nationality, whatever may be the reason or criminally, the \u2018Motive,\u2019 the deaths have caused imaginable, yet immense grief to be visited upon the respective families of the living and the dead.<\/p>\n

FUNCTIONAL CONFUSION<\/p>\n

That which have been causing \u2018Functional Confusion\u2019 in the mind of criminal investigators, appears to have been an inability to understand that which is required of; (i) \u2018The Pathologist; and (ii) The investigator.\u2019 That which the statutory provisions dictate is that the \u2018Pathologist\u2019 shall; (a) \u2018Make a report as to the \u2018Cause of Death\u2019 to the District Coroner; and (b) Give an opinion as to whether further enquiry shall be made as to the \u2018Circumstances\u2019 under which the deceased person came by his\/her death\u2019 [Coroners Act: Chapter 105: Section 8].<\/p>\n

FUNCTIONAL ROLE<\/p>\n

Conversely, the \u2018Functional Role\u2019 of the \u2018Investigator is to conduct investigations to ascertain the \u2018Circumstances\u2019 respecting the death of the deceased person. Such \u2018Circumstances\u2019 given under \u2018Oath\u2019 are then ventilated before a 5-member \u2018Coroner\u2019s Jury.\u2019 Their duty is to ascertain from those \u2018Circumstances\u2019 whether or not the death was; (a) \u2018Accidental,\u2019 as to find a verdict of \u2018Misadventure; and (b) Ascertain if any person shall be held \u2018culpable.\u2019<\/p>\n

EGREGIOUSLY RECKLESS<\/p>\n

In the instant case respecting the deaths of the \u2018Canadian Visitors;\u2019 (i) \u2018Mother Holini Misna; and (ii) Her son Shray\u2019 in choppy seas at \u2018Devil\u2019s Bridge\u2019 between \u20186 am and 6. 45 am [ANR: November 30, 2023]. A Coroner shall not only be considered \u2018Grossly Negligent,\u2019 but \u2018Egregiously Reckless,\u2019 not holding a \u2018Coroner\u2019s Inquisition\u2019 into the \u2018Cause and Circumstances,\u2019 that have led to their deaths in the choppy waters at the \u2018Bride of the Devil.\u2019<\/p>\n

SUSPECTED ACT OF CRIMINALITY<\/p>\n

Though \u2018Devil\u2019s Bridge\u2019 incident speaks to grief, it also speaks to a \u2018Suspected Act of Criminality.\u2019 Researching for this commentary, a foreign news portal published an \u2018Antigua and Barbuda Defence Force (ABDF) Press Release.\u2019 The disseminated \u2018Release states; \u2018\u2026On November 30, 2023, they were informed that a \u2018Woman and Child\u2019 had fallen into rough waters\u2019 at 6. 45 am\u2019 [CTV Global Affairs: Updated: December 5].<\/p>\n

CRIMINAL LIABILITY<\/p>\n

This was suspectedly occasioned by a \u2018Perilous Push\u2019 off the \u2018Bridge of the Devil\u2019 of the \u2018Mother and Child. Should it be so found by the \u2018Circumstances\u2019 presented under \u2018Oath\u2019 as evidence, and looked at in their entirety, the \u2018Coroner\u2019s Jury\u2019 shall determine that a \u2019criminal \u2018Act or Omission\u2019 had \u2018Caused\u2019 the death of a deceased person. In respect to \u2018Criminal Liability,\u2019 the \u2018Coroner\u2019s\u2019 Jury shall consider and return a verdict of either; (i) \u2018Murder: (ii) Manslaughter.\u2019 If an infant, \u2018Infanticide;\u2019 [Coroners Act: Chapter 105: Section 32].<\/p>\n

WHERE ANGELS FEAR<\/p>\n

An investigative look at the suspicious incident, focuses on a \u2018Press Release\u2019 purportedly disseminated by the \u2018Antigua and Barbuda Defence Force (ABDF). This \u2018State Agency\u2019 had promptly dispatched its \u2018Asset\u2019 to the \u2018Bridge\u2019 called \u2018Devil.\u2019 The non-navigable waters were confirmed by a \u2018Recovery Team.\u2019 There was no hope of victims\u2019 survival and rescue from the devilish choppy waters. Though equipped with life-saving apparatus, the \u2018Maritime Responders\u2019 ventured not \u2018Where Angels Fear.\u2019<\/p>\n

RESPONDING MARINERS<\/p>\n

The Coast Guard Commander, having assessed the conditions, soberly and prudently\u2019 avoided tragedy to personnel and asset. The \u2018Press Release\u2019 further states; \u2018\u2026The asset continue to monitor the environment closely in good faith of locating the \u2018Missing Child.\u2019 Indeed, the personnel shall not only be seen only as an asset to the Miliary, but also more importantly, in perilous conditions, yet in readiness, valiantly rendering service to the nation.<\/p>\n

ABDF: PRESS RELEASE<\/p>\n

Continuing, it informs that; (a) \u2018The ABDF Coast Guard responded to the scene around 7. 30 am; and (b) But determined that surging sea condition was too unsafe to navigate.\u2019 Such, given evidence shall confirm to\u00a0 a \u2018Criminal or Coroner\u2019s Jury\u2019\u00a0 the conditions observed by the mariners.
