It is to the knowledge, that every day people are faced with inescapable horrors of one kind or another. Some were undaunted, while some were daunted. Then there are some city streets where parking has brought ticketing and financial horrors to the unobservant motorists. There are some horror movies, such as; \u2018A Nightmare on Elm Street\u2019 [November 16, 1984]. Though in films, people were scared to death. There were some dreams in which people have told stories of \u2018Nightmares.\u2019<\/p>

TERROR ON NEVIS STREET<\/p>

\"\"<\/a><\/div>\n

While Law enforcement danced to the song \u2018Jerusalema\u2019, and likened to \u2018kites and winged ants,\u2019 some personnel continue to fly about, criminals continue to wreak havoc in communities, with law-abiding and defenceless citizens becoming terror-stricken. From a very different perspective and for a far different reason, Law enforcement personnel alleged to have committed breaches of discipline, they were said to be facing; (i) Tyranny and oppressive behavior within the Police Service; and in the city (b) Terror on Nevis Street.\u2019 These appeared to have been the apparent autocratic behavior of some senior officers within the \u2018Police Service.<\/p>\n

TOPICS OF CONTROVERSY<\/p>

\"\"<\/a><\/div>\n

These have become a \u2018Topics of Controversy.\u2019 Even so, it has been one that the constitutional governing disciplinary body- the \u2018Police Service Commission (PSC),\u2019 appeared to have fully embraced. In developing the subject as it affects \u2018Organizational Behavior,\u2019 has always been to ensuring that there is some organizational understanding of that which obtains internally, Thus, it has always been of paramount importance that there was established mediums to facilitate effective communication, the success of which has always been dependent not only upon such mediums, but also the intelligence and skills possess by its members.<\/p>\n

MEDIUM FOR COMMUNICATING<\/p>

\"\"<\/a><\/div>\n

The experts have determined that \u2018Communication\u2019 will not have taken place if there was no understanding.\u2019 Universally, Police Services have established \u2018Mediums for Communicating\u2019 with the administration and upper echelon, as well as to personnel subordinate to them. For effective communication, these mediums have been \u2018Organizationally Standardized.\u2019 Prior to the proliferation of technology, among the \u2018Mediums\u2019 were; (i) \u2018Force Orders: (ii) Special Force Orders; (iii) Force Standing Orders: (iv) Station Standing Orders; (e) Operation Orders; and (f) Force Circular.\u2019<\/p>

\"\"<\/a><\/div>\n

TECHNOLOGICALLY-OBSOLETE<\/p>\n

The first of these \u2018Orders\u2019 speaks to general information published by the \u2018Commissioner of Police\u2019 and dissemination throughout the Police Service.\u2019 The advent and proliferation of technology, appeared to have made for laziness, ignorance and incompetence seemed to have phased these \u2018Orders and Circulars\u2019 out of existence. These appear to have been made \u2018Technologically-Obsolete\u2019 by Emails and WhatsApp Messages.\u2019 In the case of the national Police Service, the \u2018Royal Police Force of Antigua,\u2019 the pertinent information, were to be collated by Heads of; (a) Departments; (b) Branches; (c) Police stations; and (d) Units\u2019 and sent to the Police Headquarters for that which was then called the \u2018Monthly Returns.\u2019<\/p>\n

REASONABLENESS OF TIME<\/p>\n

The \u2018Special Order\u2019 was a publication with specific information, such as that affecting the \u2018Rank Status\u2019 of personnel, particularly of recent; (a) \u2018Promotion: or (b) Reversion of personnel to their substantive rank; or (c) Internal transfers of personnel.\u2019 When \u2018Inspector Junie Huggins\u2019 was ordered by \u2018Commissioner of Police Atlee Rodney QPM\u2019 to attend a \u2018Disciplinary Tribunal\u2019 as fixtured by \u2018Chairman of the Police Service Commission (PSC),\u2019 both Heads of their respective agencies, appeared not to have looked at; (i) \u2018The \u2018Reasonableness of Time;\u2019 and (ii) The lawfulness of the \u2018Instructions\u2019 given to then \u2018Divisional Inspector.\u2019<\/p>\n

BREACH OF DISCIPLINE<\/p>\n

Seemingly, more out of professional and organizational ignorance of existing \u2018Standing Orders\u2019 for reporting, on the part of the; (a) Police Administration: (b) The delegated investigator; and (c) The alleged offending officer,\u2019 than of the disciplinary-sanctioning body the \u2018PSC,\u2019 resulted in the Inspector; (a) \u2018Admitted committing a \u2018Breach of Discipline;\u2019 and (b) Forfeiture of two months Increment\u2019 (EC$ 475 x 2 = 950). This reportedly resulted from an order by \u2018Assistant Superintendent of Police, Cordel O\u2019Garro\u2019 to the then \u2018Divisional Inspector of Police.\u2019 Such order has raised issues of lawfulness or unlawfulness.<\/p>\n

HARROWING EXPERIENCE<\/p>\n

Those with eligibility, include; (a) \u2018Constables: (b) Corporals: (c) Sergeants: (d) Senior Sergeants; and (e) Inspectors.\u2019 Such speaks to the \u2018Harrowing Experience\u2019 of a disciplinary hearing in which, out of apparent ignorance, he pleaded guilty to an unreasonable and unlawful instruction. This was reportedly, compounded by insults and abuse. Anticipating much more than these, \u2018Parliament not only provided punishments, but also for those in whom authority resides to act with reasonability. Given his \u2018Christian belief and practice, \u2018Inspector Huggins\u2019 may joyfully sing the gospel songs; \u2018Ride Out Your Storm; God is Standing By\u2019 [George Nooks].<\/p>\n

DEMORALIZING ISSUES<\/p>\n

Viewed from another perspective, such order has prompted discussions on the \u2018Demoralizing Issues\u2019 of; (a) \u2018Oppressive conduct toward a subordinate; or (b) Actions seen so tyrannical, as to have impacted negatively upon the subordinate\u2019s morale.\u2019 In a disciplinary prosecution, as in \u2018criminal prosecutions, the officer presenting the Case to the \u2018PSC,\u2019 shall be well aufait with the \u2018Facts.\u2019 Such shall be viewed from the prosecutorial term \u2018Prima Facie Evidence,\u2019 the veracity of which shall eliminate feelings of doubt. That which appeared to have been missing from the \u2018Inspector Junie Huggins Tribunal Hearing\u2019 may have been the time immemorial and well established \u2018Standing Order\u2019 for reporting \u2018Police Stations and Districts.\u2019<\/p>\n

THE MORNING STATE<\/p>\n

Every currently-serving officer, including three \u2018Police Retirees\u2019 on the \u2018PSC\u2019 knows that \u2018Daily Reporting\u2019 covers a standing \u201924-hour Period\u2019 from \u201906: 00 hours to 06: 00 hours.\u2019 Confirmation of this, might be seen from the internal organization communication called the \u2018Morning State.\u2019 From leadership and professional knowledge, as may or may not exist today, this documentation provides the \u2018Commissioner of Police\u2019 with; (a) \u2018Up-dated matters of Crime; (b) Occurrences of serious incidents; (c) Administrative concerns; and (d) Operations conducted during the given period.\u2019<\/p>\n

AUTHORITY AND REASONABILITY<\/p>\n

Prosecutorally, the instruction, reportedly given to the \u2018Divisional Inspector\u2019 by then \u2018Divisional officer, Assistant Superintendent Cordel O\u2019Garro,\u2019 clearly appeared starved for; \u2018Authority and Reasonability.\u2019 \u00a0In fact, the people that shall have seen the \u2018unlawful instruction\u2019 that ran counter to the \u2018Standing Order\u2019 for reporting; include; (i) \u2018The Commissioner of Police: (ii) Head of Professional Standards: (iii) The delegated investigating officer; (iv) The Case presenter; PSC Commissioners (v) James Hill; (vi) Cosmas Marcell; and (vii) Claudette Brathwaite-Mason; and (viii) The former acting Judge and currently practicing attorney -at-law and PSC Chairman Kelvin John.\u2019<\/p>\n

TYRANNICALLY BRUTAL\/STUPID<\/p>\n

That which can be uncontradictably said, is that in the recent disciplinary tribunal hearing against \u2018Inspector of Police Junie Huggins,\u2019 three of the six-member \u2018Police Service Commissioners\u2019 have neither been subjected to; (a) \u2018Reporting tyranny; nor (b) Deprivation of their incentivized increments. Moreover, that which appeared to have defied \u2018Reasonability,\u2019 and seemed \u2018Tyrannically Brutal and Stupid,\u2019 was the instructional time said to have been \u2018between 4: 30 am and 4: 45 am daily.\u2019 Logic dictates that to commence reporting at that time, it meant that the \u2018Divisional Inspector\u2019 would be required to be awakened at \u20184 am.\u2019<\/p>\n

FRUSTRATING REMINDER<\/p>\n

Such reporting time speaks to the \u2018Frustrating Reminder\u2019 of the degrading treatment of \u2018Human Slavery.\u2019 This was the time when the wicked \u2018Slave Drivers\u2019 reportedly perpetrated all kinds of atrocities against the \u2018African Slaves\u2019 in the guise of readiness for toiling in the cotton and sugarcane fields, under the blazing sun. Then there were the merciless whipping and flogging of the frequently sick and weary slaves. Such has been the apparent hangover legacy of \u2018Colonial Mentality\u2019 of the overzealous and misguided \u2018Gazetted officers,\u2019 along with a \u2018Police Service Commission (PSC)\u2019 with a membership that seemingly starved for organizational understanding and administrative and operational knowledge.<\/p>\n

LAST 24-HOURS<\/p>\n

When the \u2018Divisional officer Cordel O\u2019Garro\u2019 reportedly instructed his subordinate to report the \u2018State of Affairs\u2019 at the assigned \u2018B Division,\u2019 it then comprised two \u2018Divisional Headquarters; (i) \u2018Coolidge; and (ii) Parham; and two sub-stations (iii) Willikies; and (iv) Freetown.\u2019 This necessarily meant, quietly easing away from the comforting presence of his lawful-wedded wife. Then, he shall then call around to the \u2018Divisional Stations\u2019 to be informed on incidence of crime and other significant incidents for the \u2018Last 24-Hours.\u2019 A quick-witted \u2018Divisional Inspector\u2019 may have wished to irritate an inconsiderate \u2018Divisional officer\u2019 by calling him an hour earlier. Thus, he may have called him at \u20183: 30 am\u2019 to report the \u2018State of Affairs.\u2019<\/p>\n

PARAGON OF VIRTUE<\/p>\n

The apparent inconsiderate, heartless behavior of some pension-drawing retirees, and monthly stipend-earners,\u2019 have been well-known former superiors and colleagues. Some were known for their respectability, allegiance and unwavering loyalty and dedication to the Police Service. As in most organizations, none may claim to be the \u2018Paragon of Virtue.\u2019 Those so acting, have reportedly been considered a threat to the professional career of the deeply committed and professionally-efficient, competent personnel.<\/p>\n

MERITORIOUSLY AND POSITIONALLY<\/p>\n

None shall deny the constitutionality of the body called the \u2018Police Service Commission (PSC)\u2019 [CO: 1981: Section 104]. It has also been the observation, that \u2018Positionally,\u2019 some for reasons of either the dominating; (a) \u2018Environmental influences; or (b) Organizational affiliations,\u2019 were accorded administrative tenure. In recent years, this august body appears to have attracted persons that were seen more for their; (a) \u2018Numerical and debilitating axe-grinding value; and (b) Mostly for their victimizing concurring-decisional-votes.\u2019 From a functional perspective, \u2018Meritoriously,\u2019 some members would have failed the litmus test of functionality.<\/p>\n

POLICE RETIREES ON \u2018PSC\u2019<\/p>\n

Still, it shall be said that it comprises a membership of some of the finest men and one woman. The members, from all walks of life, came from various disciplines. Among the current membership of the \u2018Police Service Commission (PSC),\u2019 are \u2018Police Retirees,\u2019 identified as; (i) \u2018Suspended former Inspector of Police, Claudette Brathwaite-Mason; (ii) Former Superintendent of Police, Cosmas Marcell; and (iii) Former Deputy Commissioner of Police, James Hill.\u2019 Much have been expected of these retired senior officers. However, with the other three members, they have rendered collective decisions that were often seen as suspected to have been insularity-influenced.<\/p>\n

ORGANIZATIONAL TREACHERY<\/p>\n

It shall be said that baring \u2018Organizational Treachery,’ tenure of these Commissioners could survive with the life of a ruling administration. The experiences of former Chairmen; (i) \u2018Joseph Laurent [2004]: (ii) Stefan Winter [2014]; and (iii) Chairman, Phillip Isaac\u2019 who was reportedly \u2018treacherously ousted from the constitutional, but figure-head position\u2019 [2017], make the point. Though the trio alone does not constitute the \u2018PSC\u2019s\u2019 membership, on a disciplinary tribunal, they have been referred to as the \u2018CCJ\u2019 (Claudette: Cosmas: James).<\/p>\n

FEARFUL OF THE \u2018PSC\u2019<\/p>\n

Many demoralized and frustrated personnel, will have seen their progress, professional development and advancement been gravely retarded by acts reportedly associated with cronyism and nepotism. Today, many serving Law enforcement personnel appear to have been more \u2018Fearful of the \u2018PSC,\u2019 than they harbor fears of the \u2018terrifying hooded-gun-toting and knife-wielding hoodlums, as well as the night-time rapists and brazen uncatchable daylight robbers. The traumatic experiences of the hapless, defenceless and timid citizens, have, been attributed to the apparent aborted responsibilities. These are the ones citizens have accused of seeking to gain commercial recognition for their sky-trotting escapades.<\/p>\n

CONSCIENCE AND REASON<\/p>\n

In the harshest of economic times, and grave financial hardship, the \u2018PSC\u2019 membership has shown no mercy for the financially-challenged Inspector. Research has revealed that the sum of \u2018EC$950\u2019 to be forfeited, reportedly represents \u2018two months\u2019 of the \u2018Incentivized Increments.\u2019 Contrastingly, were the members of the \u2018Police Service Commission (PSC),\u2019 endowed with \u2018Conscience and Reason,\u2019 likened to the \u2018African Slaves\u2019 held captives on the inescapable perilous journeys called the \u2018Middle Passage,\u2019 that reportedly saw millions died in chained and cramped spaces, so too were theirs that would have been capable of being devoured by vermin.<\/p>\n

ADMINISTRATIVE COLLUSION<\/p>\n

When the unsuspecting \u2018Inspector Junie Huggins\u2019 appeared before the \u20186-member disciplinary committee, he knew not of the apparent pent-up wrath that had been \u2018Perilously Poised\u2019 to descend upon him. From professional and administrative knowledge, such incentive would have been considered well-earned. Such would have been accrued from the lowly and basic-salaried rank of constable. Then, for \u201837 Unbroken Years of Service\u2019 to the nation of \u2018Antigua and Barbuda through to the inspectorate rank, the sum of \u2018EC$475\u2019 had been incrementally and legitimately earned. Though the information may have been accessed from the \u2018Personnel File,\u2019 there appeared to have been clear \u2018Administrative Collusion\u2019 between the Police administrators and the PSC.\u2019<\/p>\n

PUNISHMENT OF EC$950<\/p>\n

In the instant disciplinary tribunal, clearly not influenced by spirituous liquor, a \u2018Punishment of \u2018EC$950\u2019 may have been improperly, if not unlawfully imposed upon veteran \u2018Inspector of Police Junie Huggins\u2019 [PSC: November 16, 2023]. This came at a time when the \u2018Eastern Caribbean Supreme Court (ECSC)\u2019 has guided the reason and conscience of criminal adjudicators through \u2018Sentencing Guidelines.\u2019 These are in respect to rationally-considered criminal punishment to be imposed upon convicted or persons pleading guilty.<\/p>\n

VINDICTIVELY PUNITIVE<\/p>\n

It was evident that in the \u2018Police Discipline Code,\u2019 Parliament\u2019 anticipated\u2019 that the membership of the \u2018Police Service Commission (PSC)\u2019 and a Commissioner of Police,\u2019 may become \u2018Vindictively Punitive.\u2019 It also anticipated that either one or both, may most likely do egregious things to members of the \u2018Police Service\u2019 as to be seen as exceedingly harsh and heartless. This may have shown manifestations with the treatment meted to \u2018Inspector Junie Huggins.\u2019 The sacrifices that he may have made, and the constant dangers being faced, saw the named Inspector derived the yearly meagre sum of fractionally over \u2018EC$ 12.\u2019 Such was due and payable only to personnel of a non-Gazetted rank.<\/p>\n

REASONABLE CONSIDERATION<\/p>\n

That which may not have been given \u2018Reasonably Consideration\u2019 states for the knowledge of every member on the \u2018PSC;\u2019 \u2018In considering which punishment shall be imposed, if any charge is found to be proved, regard shall be had to the officer\u2019s record of Police Service as shown in his personnel record\u2019 [Section 12]. When the membership appeared to have completely ignored the imposition of the statutory maximum fine of \u2018EC$200,\u2019 it could reasonably be inferred that they intended by whatever means, legitimate or illegitimate, the \u2018Inspector and his family shall spend a miserable and unenjoyable Christmas-2023.\u2019<\/p>\n

BREACH OF DISCIPLINE: \u00a0PUNISHMENTS<\/p>\n

Given the respective constitutional authority of; (i) \u2018The Police Service Commission (PSC); and (ii) The Commissioner of Police\u2019 [CO: 1981: Section 105 (i) and 1o5 (5)]. the \u2018Punishments\u2019 statutorily stipulated, it is provided for the benefit of public knowledge, and members that might be starved for such knowledge. The imposable punishments have always been dependent upon the nature and gravity of the particular \u2018Breach of Discipline.\u2019 These are listed as; (i) \u2018Dismissal from the Police Service; (ii) Requirement to resign; (a) \u2018Forthwith, or on such date as may be specified in the decision; and (b) Dismissal on refusal or failure so to do; (iii) Reduction in rank; (iv) Reduction in the officer\u2019s rate of pay for such period not exceeding one year; (v) Fine not exceeding EC$200; (vi) Reprimand; and (vii) Caution\u2019 [Section 11: Police Act: Chapter 330: Volume 12].<\/p>\n

CONCLUSION<\/p>\n

The \u2018Incentivized Increment\u2019 was graduated from the rank of \u2018Police Constable.\u2019 It was duly approved by the previous \u2018Commissioners of Police.\u2019 This also included the currently-serving Commissioner, Attley Rodney QPM.\u2019 The office-holder that has failed or in any way or negligent in paying attention to matters of administration, is likely to see the perennial plight of subordinates, gravely and exponentially increase. Such holder, not only has a statutory responsibility for superintendence, but also exclusive command and control of the \u2018Police Service\u2019 [Police Act: Chapter 330: Section 6: Chapter]. Fundamental to the successful tenure of a \u2018Commissioner,\u2019 has always been his\/her handling of administrative matters. This shall be buttressed by the knowledge and professional competence of \u2018Gazetted officers.\u2019 Thus, none shall be seen as; \u2018Square pegs in round wholes.\u2019 Most fundamental to \u2018Force Morale,\u2019 all \u2018Terror\u2019 shall cease on \u2018Nevis Street.\u2019<\/p>\n
