In the historic \u2018Judge Alone Murder Trial,\u2019 those that shall be remembered in living memory, shall be; (i) \u2018The tragically-killed \u2018David Roberts.\u2019 He was reportedly macheted, left with a gaping wound across the neck, and profusely bled-to death; (ii) Murder-accused Jeffrey Daniel 26.\u2019 He was said to have been; (a) \u2018An uninvited visitor; (b) An intruder; and (c) A persistent trespasser; (iii) The formidable team of defence attorneys, Wendell Robinson-Alexander and Wayne Marsh; (iv) The youthful, inexperienced, little known, but resolute and courageous Crown Prosecutor, Paulio Williams; and (v) The adjudicator, the esteemed \u2018Trial Judge, His Lordship, Justice Tunde Ademola Bakre.\u2019<\/p>

JUDGE ALONE TRIAL<\/p>

\"\"<\/a><\/div>\n

In specific triable cases, the \u2018Criminal Proceedings (Trial by Judge Alone) Act\u2019 has mandated \u2018Judge Alone Trials\u2019 [CPJATA: Section 4: No.8 of 2021]. Whether influentially or enticingly and optionally, for the serious felonies of \u2018Treason and Murder,\u2019 the enactment remains silent. Thus, whether or not judicially-empowered, a Judge before whom an application has been made for such trial, may so judicially order [Section 5]. The Cassada Garden resident who was indicted for \u2018Unlawfully killing David Roberts\u2019 at his \u2018Newfield residence\u2019 [May 21, 2021], now stands a \u2018Juryless Trial\u2019 before a lone Judge.\u2019<\/p>\n

PREFERRED OPTION<\/p>

\"\"<\/a><\/div>\n

Inferentially, guided by legal advice, he appeared to have \u2018Preferred\u2019 the statutory \u2018Option\u2019 in submitting to the apparent questionable jurisdictional \u2018Judge Alone Murder Trial.\u2019 To the extent that \u2018Judge Alone Trial Judges\u2019 have been jurisdictionally-empowered,\u2019 such necessarily provides legitimacy for such \u2018Mode of Trial. Notwithstanding, such submission, he shall suffer no untoward adjudicating perils. Be that as it may, he enjoys the constitutional right to the \u2018Presumption of Innocence,\u2019 as well as protection of Law [CO: 1981: Section 15].<\/p>\n

COURT ROOMS AND SANCTUARIES<\/p>

It seems little wonder that the entrances to \u2018Court Rooms,\u2019 appear not as wide as that of the \u2018Lord\u2019s Sanctuaries.\u2019 It could reasonably be said that more congregants would be attending Church, than those attending Courts. It shall cause no angst in looking at the \u2018Christian\u2019s Pathway to Heaven.\u2019 As edified by the \u2018Scriptures,\u2019 religious leaders continue to preach that the \u2018Pathway\u2019 has not been widened, as the Gateway to hell. That of the former speaks to \u2018Straightness and Narrowness.\u2019 This might be so, as more people may throng the street to a place not called \u2018Heaven.\u2019 In the context of the lawless citizens, more will be appearing at Court than attending Church for \u2018Holy Communion.\u2019<\/p>

\"\"<\/a><\/div>\n

PERSPECTIVE<\/p>\n

It has never been, and could never be said that such \u2018Mode of Trial\u2019 was optional to persons accused of committing the \u2018Capital Felonies\u2019 of; (i) Treason; and (ii) Murder.\u2019 Those mandated for \u2018Juryless Trials\u2019 shall know that neither \u2018Criminal Justice\u2019, nor the administration of justice, has ever been about \u2018Fiction.\u2019 Conversely, those that have opted to be tried by a \u2018Judge Alone,\u2019 shall harbor no \u2018Illusions.\u2019 In the case of murder-accused \u2018Jeffrey Daniel,\u2019 the facts of the case are not within the knowledge of the author. Such facts will have been adduced to the \u2018Jury\/Judge.\u2019 This commentary speaks not of the merits or demerits of the criminal indictment.\u2019 That said, murder-accused shall harbor no fear of bias nor prejudice.<\/p>\n

FIXATION ON CONVICTION<\/p>\n

That which was known in some jurisdictions, particularly within the \u2018Organization of Eastern Caribbean States (OECS,\u2019 was that some \u2018Crown Prosecutors\u2019 have developed an egoistic prosecutorial philosophy. Such philosophy speaks to the concept \u2018Reasonable Prospect of Conviction.\u2019 That which those appear so hung-up, may have little appreciation for, is the Judicial Concept\u2019 called the \u2018Administration of Justice.\u2019 Those with a \u2018Fixation on Convictions,\u2019 appear to have focused their reasoning on speculative prospect.\u2019 Clearly, such philosophy has been seen as bad for criminal justice, as it has been for those criminally victimized and \u2018Rule of Law.\u2019.<\/p>\n

MANDATED JUDGE ALONE TRIALS<\/p>\n

Many accused persons have been subjected to the Mandatory Judge Alone Trial.\u2019 Whatever may have been the reasoning, several persons then indicted and awaiting trial for offences not specified [Rape\/Murder inter alia), have opted to be so tried. The judicial records shall show every known accused person that have so opted. It will show et al; (i) \u2018Ray John, a Senior Police officer (an offence under the \u2018Larceny Act); (ii) Former Education Minister Michael Browne (an offence under the Sexual offences Act;\u201d and (iii) Jeffrey Daniel (a Common Law offence).\u2019<\/p>\n

MENTAL AGONY – INORDINATE DELAYS<\/p>\n

As it affects these pending trials, it is to be understood that there have never been \u2018Shortcuts to Justice.\u2019 The \u2018Constitution Order\u2019 anticipates that persons arrested and charged with criminal offences shall be tried within a reasonable time [CO: 1981: Section 5].\u00a0 Having so opted, and with several \u2018Fixtured Dates,\u2019 these saw lengthy trial delays for \u2018Ray John\u2019 for apparent \u2018Symbolic-Fixtured Hearings\u2019 for the years; \u20182018; 2019: 2020; 2021; 2022; and 2023.\u2019 These not only speak to \u2018Mental Agony,\u2019 but also \u2018Denial of Justice.\u2019<\/p>\n

PUNISHING TRIAL DELAYS<\/p>\n

It is to be inferred that within the \u2018Criminal Justice System,\u2019 there have been as many \u2018Prosecutorial Impediments\u2019 as there have been accused persons awaiting their trials. Among such impediments include; (a) \u2018Apparent selective prosecutions; and (b) Inordinate, unexplained and unjustified and psychologically punishing trial delays. Among such impediments include; (a) \u2018Apparent selective prosecutions; and (b) Inordinate, unexplained and unjustified and psychologically \u2018Punishing Trial Delays.\u2019<\/p>\n

JUDICIAL SCRUTINY<\/p>\n

Seemingly, when the \u2018Coronavirus-19 Pandemic\u2019 visited upon the nation, it provided opportunities for \u2018Inordinate Delays.\u2019 The Pandemic saw the enactment of a Law that provides for a two-year operational period, with a provisional \u2018Optional Mode of Trial\u2019 by a \u2018Judge Alone.\u2019 Many accused persons, either mandated or having so opted, the apparent dilly-dallying prosecutorial tactics being employed, dictate immediate \u2018Judicial Scrutiny.\u2019 Such shall take into account, the professional and prosecutorial competence of those charged with \u2018Public Prosecutions.\u2019<\/p>\n

UNEXPLAINED AND UNJUSTIFIED<\/p>\n

That which was known to numerous accused persons, was that the \u2018Corridors to Justice,\u2019 have as many obstacles, as the \u2018Many Rivers Jimmy Cliff\u2019 had to Cross\u2019 [YouTube].\u00a0 If these were not so, then one shall ask; \u2018Why have there been no prosecutorial closures to the many pending \u2018high and low-profile cases, short listed as; \u2018The Josiahs; Daniels; Quinns; Lovells; Ray Johns; and the Nigel Christian alleged killers?\u2019 Except for the alleged killers, all have been subjected to the \u2018Mandatory Judge Alone Trial.\u2019<\/p>\n

FUNDAMENTAL QUESTION<\/p>\n

Given the long wait by some indicted accused, it begs the \u2018Fundamental Question;\u2019 \u2018Just when the inordinate and vexing delay will end for Senior Police officer, \u2018Assistant Superintendent of Police, Ray John?\u2019 \u2018It shall also be asked; \u2018What impediment lies in the way in bringing prosecutorial closure to the long pending trial?\u2019 Incidentally, having; (a) \u2018Rushed to \u2018Prosecutorial Judgment; (b) Arrested and criminally charged (b) Applied immediate suspension from active Police duties; [ IWN: April 13, 2018]; (c) Caused his committal to Jury trial at the \u2018Criminal Assize- 2018\u2019 for trial by a Jury of his peers, these continue to provoke suspicion in the citizenry and distrust in Public Prosecutors.<\/p>\n

LIGHTNING SPEED<\/p>\n

Interestingly, the trial of the former Minister, whose case came up with \u2018Lightning Speed.\u2019 It saw a disposal quicker than the time taken to cook a pizza.\u00a0 It ended with a successfully argued \u2018No Case Submission\u2019 [ANR: December 13, 2021]. Contrastingly, and to all intents and purposes, the delayed trials of the several Police officers\u2019 have placed most under severe psychological stress. Research has revealed that in the case of the most senior officer, his trial appears to have been dogged by unexplained lengthy adjournments. This may also have been compounded by what may have been observed as an apparent dangerous conceptualized prosecutorial practice.<\/p>\n

ALTAR OF PROCRASTINATION<\/p>\n

Such practice has seen; (a) \u2018Criminal Justice;\u2019 and (b) Public interest,\u2019 being sacrificed on the \u2018Alter of Procrastination.\u2019 Such was said to have been the result of a self-serving selective prosecutorial philosophy of some \u2018Crown Prosecutors.\u2019 In fact, the overwhelming majority continue to make mockery of \u2018Public Prosecutions.\u2019 Though not prosecutable, themselves will have been guilty of \u2018Perverting the Course of Justice.\u2019 For instance, when \u2018Directors of Public Prosecutions (DPP),\u2019 decided, even when criminal investigators have unearthed considerable prima facie evidence, yet have found ways for discontinuation.<\/p>\n

PRIMA FACIE EVIDENCE<\/p>\n

Though indictments had been filed, other than prosecuting, to all intents and purposes, some had found ways to either; (a) Foist their prosecutorial responsibility upon junior Crown Counsels; or (n) Nolle prosequi the indictments.\u2019 Some know not constitutionally; they are removable from office. A constitutional provision guides the understanding that; \u2018A person holding the office of Director of Public Prosecutions may be removed from office for, inter alia Misbehavior.\u2019 Procedurally, the Constitution sets out that which shall be done [CO: 1981: Section 87 (7)].<\/p>\n

PROSECUTORIAL TRAVESTY<\/p>\n

No matter the learning, even the most ignorant person knows the concepts \u2018Philosophy and Travesty\u2019 bears no harmonized relations, neither with, nor to each other. While in reality, the former may lead to the latter, except \u2018Figment of Imagination,\u2019 the latter does not. Incidentally, for reasons better known to \u2018Acting Director of Public Prosecutions (DPP), Shannon Jones-Gittens,\u2019 on the basis of seeking to make a fair assessment, when the fraudulent indictment against \u2018co-accused Yvonne Nickie\u2019 was discontinued, in her prosecutorial judgment, from available evidence, she may very well have seen \u2018Prosecutorial Travesty.\u2019<\/p>\n

PROSECUTORIAL PHILOSOPHY<\/p>\n

From a different perspective, being subordinate to the substantive holder of the office, \u2018Anthony Armstrong,\u2019 when he filed the indictments, it may have been on the strength of prima facie evidence. Guided by a \u2018Prosecutorial Philosophy,\u2019 he may have seen a \u2018Reasonable prospect of conviction.\u2019 Her non-prosecutorial decision might not only be seen as contrasting that of the more senior and experienced \u2018Public Prosecutor,\u2019 but also gives rise to public scrutiny, speculation and\/or reasonable suspicion.<\/p>\n

LANGUISHING: BAIL\/JAIL<\/p>\n

While the remaining two accused enjoyed, and continue to enjoy their liberties and full monthly salaries, horrifyingly, they continue to \u2018Languish on Bail.\u2019\u00a0 Their unique privileged financial positions, have accorded them the comfort in discharging their financial obligations. Thus, their experiences appear more advantageous to the indigent accused persons. This appears particularly so, as those that have been perennially \u2018Languishing in Jail,\u2019 anxiously awaiting their individual or joint-trials.<\/p>\n

INDEPENDENT AND IMPARTIAL<\/p>\n

Every accused person is equal before the law, and is to be given equal treatment before the Courts. These were long declared in the \u2018Universal Declaration of Human Rights\u2019 states; Everyone is entitled in full equality to a fair and public hearing by \u2018an Independent and Impartial\u2019 tribunal in determination of any criminal charge against him\u2019 [1948: UDHR: Article 10]. Whether or not in; (a) \u2018Judge and Jury; or (b) Judge Alone Trials,\u2019 it is to be reasonably assumed that Trial Judge, His Lordship Justice Tunde Ademola Bakre\u2019 has familiarity with these concepts to the Judiciary.\u2019<\/p>\n

HISTORIC OCCURRENCES<\/p>\n

As has been the knowledge, the annals of history shall show the \u2018Historic Occurrences\u2019 of yester-year. One such occurrence shall be the \u2018Historic Judge Alone Murder Trial.\u2019 It marked the first such trial ever to have been conducted at the \u2018Criminal Assize-October 2023\u2019 in the \u2018Antigua and Barbuda Circuit.\u2019 Instructively, the trial, the very first within the \u2018Organization of Eastern Caribbean States (OECS),\u2019 was conducted by recently appointed \u2018Judicial officer, Nigerian-born national, \u2018His Lordship, Justice Tunde Ademola Bakre\u2019 [October 31, 2023].<\/p>\n

FAME AND EXCELLENCE<\/p>\n

Consequent upon \u2018His Lordship\u2019s elevation to a \u2018Judicial Bench,\u2019 an overjoyed nation and proudness of a people saw a national news portal describing the achievement as having; \u2018Brought \u2018Fame and Excellence\u2019 to Nigeria\u2019 [Penpushing.com: August 13, 2023]. While such has been so gladly and profoundly expressed, in many respects the appointment allowed \u2018His Lordship\u2019 to venture where other regional \u2018Criminal Assize Justices\u2019 may have been too timid to tread. Such saw \u2018His Lordship\u2019 take on a trial of great significance. This has been a trial in which a \u2018Judicial officer became the \u2018All-in-one \u2018Judge and Jury.\u2019<\/p>\n

JUDICIAL STINTS<\/p>\n

A \u2018Stint of Adjudication\u2019 on any \u2018Judicial Bench,\u2019 does not necessarily mean criminal adjudication. Such is supported by \u2018Judicial Stints\u2019 of former temporary acting Judges with the \u2018Eastern Caribbean Supreme Court (ECSC).\u2019 The \u2018Judicial and Legal Service Commission (JLSC), will lend attestations to their appointments as \u2018Acting Judges.\u2019 Research has identified the several former judicial officers as; (i) \u2018Justices Kelvin John [BVI]; (ii) Charlesworth Tabor [BVI]; and (iii) Septimus Rhudd\u2019 [Grenada]. The trio are currently practicing attorneys in \u2018Antigua and Barbuda.\u2019<\/p>\n

BENCH EXPERIENCE<\/p>\n

Though research has shown that \u2018His Lordship, Justice Tunde Ademola Bakre\u2019 had a \u2018Judicial Stint\u2019 with \u2018Ogun State, Nigeria,\u2019 it revealed no \u2018Bench Experience in \u2018Criminal Jurisdiction.\u2019 Still, his appointment to the Judiciary, could reasonably be inferred that the \u2018Learned Justice\u2019 possesses the requisite knowledge and adjudicating competence. These may have been among other compelling reasons for which much confidence may have been reposed in his ability, by the \u2018Judicial and Legal Service Commission (JLSC).\u2019 That which speaks to professional bravery, was his apparent first undertaking of the historic \u2018Judge Alone Murder Trial\u2019 [Criminal Assize: October- 2023].<\/p>\n

IMPEDIMENT TO TRIAL<\/p>\n

Now, \u2018Impediment to Trial\u2019 is one thing. The shattered life of a family is another. A husband\/father has been tragically killed. He allegedly sustained a vicious wound to the neck. Most unfortunately, the \u2018Bell\u2019 has been \u2018Tolled\u2019 for Newfield resident \u2018David Roberts.\u2019 The indicted murder-accused was identified as \u2018Cassada Garden\u2019s resident, Jeffrey Daniel 29.\u2019\u00a0 His liberty, future and fate hang in the balance. Encountering no impediments, he was given an early \u2018Trial Fixture.\u2019 Then under instructions and guided by legal counsel, prudently or imprudently, he reportedly aborted trial by a \u2018Jury of his Peers.\u2019<\/p>\n

FATE \u2013 LIBERTY – FUTURE<\/p>\n

A murder-accused, runs the risk of having a dual-role \u2018Judicial officer,\u2019 determine; (a) \u2018His Fate: (b) Possible deprivation of liberty; and (c) Future that could be placed in jeopardy.\u2019 By such \u2018Mode of Trial,\u2019 a \u2018Judge functions as; (i) \u2018Jury\u2019 as \u2018Sole judge of \u2018FACTS; and (ii) As adjudicator, \u2018Sole Judge of LAW.\u2019 Clearly, roles and functions, positioned \u2018His Lordship, Justice Tunde Ademola Bakre\u2019 to inter alia; (a) \u2018Hear the evidence; (b) Assess witnesses\u2019 credibility, (c) Observe their demeanor; Assess evidence; (d) Make rulings on admissibility and inadmissibility; (e) Make findings of fact; and finally (f) Make determination of innocence or guilt.\u2019<\/p>\n

MANSLAUGHTER<\/p>\n

At the end of the trial, those within the \u2018Halls of Justice,\u2019 shall be the first to hear the verdict of \u2018His Lordship.\u2019 Those with vested interest and foremost, would undoubtedly be the criminal defence attorneys. If acquitted of the greater offence, and the alternative verdict- Manslaughter\u2019 is returned, the short-cut \u2018Judge Alone Trial,\u2019 shall show that the murder-accused \u2018Jeffrey Daniel, is poised to see perilous judicial consequences, visited upon him.<\/p>\n

WONDERS \u2013 WHISPERS \u2013 WAILING – WEEPING<\/p>\n

Even without the knowledge of a Seismologist and the expertise of \u2018Meteorologist Dale Destin,\u2019 as the \u2018Judge Alone Murder Trial\u2019 in which \u2018His Lordship, Justice Tunde Ademola Bakre\u2019 ended, there may be \u2018Wonders; Whispers; Wailing; and Weeping.\u2019 From clear blue skies, the sun, shining in its glorious brilliance, may not be too tolerable by humans. Though it may not necessarily be as hot as that in reserve at another place, by mid-morning, there may be soaring temperature with a discomforting humidity and anxiety.<\/p>\n

RUMBLING SOUNDS<\/p>\n

Eerie \u2018Rumbling Sounds\u2019 may be heard, as those being reportedly heard by residents of the \u2018Northern Leeward Islands\u2019 [ANR: November 19, 2023]. Chances are, man\u2019s heart may bear and flatter to a sudden stop. It would be a day when \u2018Thunder\u2019 may roll at the \u2018Criminal Assize Court,\u2019 marking the end of a three-week \u2018Juryless Murder Trial.\u2019 Frighteningly, the earth may quake with an intensity never before experienced by humans. The reverberating and riveting sounds will most likely be heard throughout this nation, rest of the Leeward and Windward islands.\u2019<\/p>\n

DRUM BEATS OF AFRICA<\/p>\n

Such sounds will be dissimilar to the ritual and cultural \u2018Drum Beats of Africa.\u2019 The only person that shall harbor no fear of impending disaster, would be \u2018His Lordship, Justice Tunde Bakre.\u2019 That which will stand irrefutably true, is a verdict in a \u2018Trial without a Jury,\u2019 with the most intriguing information. Judiciary. Such information shall not only be for historical remembrance of the prosecutorial intrigues of a \u2018Juryless Murder Trial,\u2019 but also for the knowledge of posterity. They shall know that out of expediency, a statutory enactment enabled an indicted person to so opt [Criminal Proceedings (Trial by Judge Alone) Act)\u2019 [No. 8 of 2021].<\/p>\n

JUDICIAL DISCRETION<\/p>\n

That which is to be delivered by \u2018His Lordship, Justice Tunde Ademola Bakre,\u2019 is a \u2018Decision\u2019 [CPTJA: Section 8]. Contrastingly, that which was judicially known, was that in \u2018Jury Trials,\u2019 no matter the time taken for the completion of trial, upon retirement to consider their verdict; (a) \u2018Guilty; or (b) Not Guilty,\u2019 members of the Jury have some 2 hours so to do. Notwithstanding such allotted time, a \u2018Judicial Discretion\u2019 resides with \u2018Trial Judges.\u2019 The administration of justice, dictates that adequate and reasonable time be extended, thereby allowing a Jury to arrive at an informed verdict.<\/p>\n

DECISION IN 14 DAYS<\/p>\n

Advantageously, to the extent that additional time serves the \u2018Administration of Justice,\u2019 the trial Judge is judicially-bound to so favor. If a Jury was \u2018Hung,\u2019 then they shall be forthwith retired. Contrastingly, the enacted \u2018Criminal Proceedings (Trial by Judge Alone) Act,\u2019 has made it clear of the time adjudicators shall deliver their decisions. It states; \u2018The Judge shall, as soon as reasonably practicable, and in any event before the expiration of 14 days deliver his decision, and he shall give a written judgement, stating his reasons for; (a) \u2018Conviction; or (b) Acquittal\u2019 [CPTJA: No. 8 of 2021: Section 8].<\/p>\n

CELEBRATION OR INCARCERATION<\/p>\n

Thus, in the next 14 days, the murder-accused shall know if there will be cause for \u2018Celebration\u2019 or regret over \u2018Incarceration.\u2019\u00a0 Suffice to say, that in a \u2018Juryless\u2019 trial for murder, \u2018Woe be unto the accused, so opted. Undoubtedly, the \u2018Judge Alone Murder Trial,\u2019 was judicially-dictated. Given her reported non-participation, it could reasonably be said that \u2018Acting Director of Public Prosecutions (DPP), Shannon Jones-Gittens\u2019 may not have been concerned with the apparent \u2018Non-optional \u2018Mode of Trial.\u2019<\/p>\n

PROSECUTORIALLY MINDFUL<\/p>\n

Thus, she may have been prosecutorally-mindful that after \u2018Treason,\u2019 the second most serious felony was \u2018Murder.\u2019 There may have been no contemptuous discourse, that there shall have been the empaneling of a \u201912-member Jury.\u2019 Though so advisedly opted, she may also have respected the right of indicted persons to a preferred the optional statutorily provided \u2018Mode of Trial.\u2019 This is the juncture where it shall be said that the only thing that militates against human adventurism, is failure.<\/p>\n

CONQUERABLE CHALLENGE<\/p>\n

That which was often seen as adventurism, was invariably viewed by others as a \u2018Conquerable Challenge.\u2019 Failure, experienced and known to man, as beating nothing, but a trial. In spite of their femininity and beauty, it appears that no female attached to the office of \u2018Director of Public Prosecutions (DPP)\u2019 has shown a resolve in serving the prosecutorial interest of general public. Few \u2018Public Prosecutors\u2019 have exhibited the courage necessary in undertaking such prosecutorial assignment. Professionally, in the case of \u2018junior Crown Counsel, Paulio Williams,\u2019 he would have distinguished himself from those whose value, might now be seen as merely numerical.<\/p>\n

PROSECUTORALLY CONFIDENT<\/p>\n

Seemingly harboring no terror from the more experienced defence counsels, \u2018Robinson-Alexander and Marsh,\u2019 fearlessly the youthful \u2018Crown Prosecutor,\u2019 battled his way through the \u2018Judge Alone Murder Trial.\u2019<\/p>\n

BODYLESS AND JURYLESS TRIALS<\/p>\n

Legal luminaries, critical of the apparent abdication of responsibility, privately expressed the view that such trial shall not have replicated the case of the outsourced first \u2018Bodyless Murder Trial\u2019 [ANR: October 19, 2022]. FICTION \u2013 INTELLIGENCE – DUNCINESS<\/p>\n

The \u201818-Page Act,\u2019 inter alia, states; \u2018Where a trial is conducted without a Jury, the Judge shall have all; (i) \u2018The power; (ii) Authority; and (iii) Jurisdiction of a Jury\u2019 [Criminal Proceedings (Trial by Judge Alone: Section 7: No. 8 of 2021].<\/p>\n

OVERSIGHTS<\/p>\n

The \u2018Act\u2019 though not necessarily defective, that which seemed to have \u2018Escaped the Attention\u2019 of legal scholars, including; (i) \u2018The legal drafters; (ii) Clerk to Parliament; (iii) The Attorney General; (iv) The House Speaker: (v) Senate President; and (vi) The Governor General,\u2019 are these; (a) \u2018One-page showing \u2018No. 8 of 2021; while (b) Throughout the 18-page Act, the other pages show \u2018No. 8 of 2020.\u2019 These \u2018Oversights\u2019 speak to indecency of haste in which the \u2018Bill\u2019 was given \u2018Parliamentary approvals and Royal Assent.\u2019<\/p>\n

HIDDEN DANGERS<\/p>\n

The unprecedented \u2018One-Judge Trial for \u2018Murder,\u2019 marked a serious departure from the historically well-established practice of \u2018Trial by Jury\u2019 of accused persons by their Peers.\u2019\u00a0 Parliament anticipated that some \u2018Judges,\u2019 may misguide or misdirect themselves; (ii) Ensuring that accused persons suffered no \u2018Travesties, it provides several \u2018Legal Grounds of Appeal.\u2019 The \u2018Act\u2019 states that an accused person \u2018May, without leave of the \u2018Court of Appeal,\u2019 file an appeal against conviction on the legally-stipulated \u2018Grounds of Appeal.\u2019 The two most fundamental grounds are; (i) \u2018The Court had no jurisdiction in the Case; and (ii) The Court exceeded its jurisdiction\u2019 [CPTJA: Section 9].<\/p>\n

STINT ON THE BENCH<\/p>\n
