Attorney-at-law Leon Chaku Symister is calling on the minister of
\njustice to abide by the law and create a facility to accommodate
\njuvenile offenders.<\/p>\n

Speaking about a recent incident, Symister says that a 17-year-old
\nfemale offender was detained for seven days at His Majesty\u2019s Prison
\nbecause she violated her curfew.<\/p>

\"\"<\/a><\/div>\n

Apparently, the teenager had been taken before the Child Justice
\nBoard for driving without a licence; and, as part of her punishment,
\nthe adjudicators ordered that she should not be out of her house
\nafter a particular time.<\/p>

\"\"<\/a><\/div>\n

Having reportedly breached the order, the girl was taken back
\nbefore the Board, and then was sent to His Majesty\u2019s Prison.
\nNow, Symister notes, the Child Justice Board was set up to divert
\njuveniles from the customary criminal-justice system, when
\nappropriate.<\/p>\n

Yet, he says, the teenager spent seven days behind bars \u2013 and could
\nhave stayed longer had it not been for the intervention of her
\nattorney, who filed a motion of habeas corpus in the High Court.<\/p>

\"\"<\/a><\/div>\n

The attorney says the\u00a0Child Justice Act\u00a0contains scheduled offences,
\nwhich are serious matters that cannot be diverted and must go
\nbefore either the High Court or the Magistrates Court.
\nHe points out that its sentencing provision requires that a child go to
\nprison if the Court is satisfied it is the only alternative.<\/p>\n

Thus, even juveniles who are convicted in the High Court are not
\nsent to prison unless the circumstances are dire \u2013 such as in the case
\nof murder \u2013 and the Court determines that no other punishment
\nwould act as a deterrent.<\/p>

\"\"<\/a><\/div>\n

Therefore, Symister says, it is unfortunate that the teenager was
\nsent to prison \u2013 given that the authorities have failed to construct a
\nfacility to house youth who run afoul of the law, as is prescribed in
\nthe Act.<\/p>

\"\"<\/a><\/div>\n

He recounts another incident in which a 13-year-old was charged
\nfor stealing over $6,000 worth of electronic items and was placed on
\ncurfew.<\/p>\n

This teenager also violated the Order and was taken back before the
\nBoard, which sent him to prison, also. However, the boy remained
\nthere for a much longer time \u2013 more than six months, Symister
\nreports.<\/p>\n

In contrast, the attorney referenced yet another case in which two
\nyoung men charged with rape were found guilty in the High Court
\nbut not sent to prison.<\/p>\n

Meanwhile, Symister says that an area at the old US Naval Base
\nwhere juveniles used to be housed is no longer in use.<\/p>\n

Accordingly, he is calling on newly knighted Attorney-General
\nSteadroy \u201cCutie\u201d Benjamin to construct a residential facility to house
\nchildren who are in conflict with the law.<\/p>\n
