The delayed swearing-in of Kelvin \u201cShugy\u201d Simon, the recently re-
\nelected representative for St. Mary\u2019s South, is as a political move by
\nthe Gaston Browne Administration, as far as attorney Leon Chaku
\nSymister is concerned.<\/p>

Simon made history by becoming the first candidate to win two
\nelections in one year, when, on October 24, he trounced the Antigua
\nLabour candidate by 174 votes, dashing Prime Minister Gaston
\nBrowne\u2019s hopes of capturing the seat.<\/p>\n

Despite the time lag, says Symister, Simon automatically became a
\nmember of the House of Representatives once the Writ of Elections
\nwas returned to the Governor-General on October 25.<\/p>

\"\"<\/a><\/div>\n

However, he notes that, based on the Standing Orders of the Lower
\nHouse, the oath of office must be taken before a new MP is allowed
\nto participate in parliamentary proceedings.<\/p>

According to Symister, the current political delay appears to be in
\nline with what took place following the January 18, 2023, General
\nElections, when the Opposition MPs were not sworn in until mid-
\nFebruary.<\/p>\n

Symister, the United Progressive Party (UPP) spokesman on legal
\nmatters, says the Party has been \u201cdancing on a stage of popularity\u201d
\nover the past several months and the people remain \u201chyped up.\u201d<\/p>

To have the swearing-in take place now, and to bring scores of
\npeople to the Parliament to witness Simon\u2019s oath-taking, would be
\nanother slap in the face for the Antigua Labour Party government, he
\nsays.<\/p>\n

Meanwhile, he explains that when a person is voted in at a by-
\nelection, the Parliament is already in place; so it is basically a matter
\nof having the new member sworn in at the earliest possible time.<\/p>

However, Symister says there is absolutely no legitimate excuse for
\nthe length of time it is taking to have Simon officially seated as an
\nMP.<\/p>

According to the attorney, this action by the Government bench
\nclearly shows that there is a need for Constitution reform \u2013 and for
\nthe establishment of a time frame in which a newly elected MP
\nshould take the oath of office.<\/p>\n

To underscore his point, he notes that senators can be selected and
\nsworn in on the same day.<\/p>\n

In this regard, the UPP spokesperson says, members of the Lower
\nHouse should be accorded greater priority, since they were elected
\nby the people and not selected by any particular entity.<\/p>\n
