Chief Justice Ivor Archie has lost his case at the Privy Council, in which he had sought to stop the Law Association of<\/g> Trinidad and Tobago (LATT) from inquiring into the allegations against him.<\/p>

The Chief Justice had maintained that there was apparent bias, bad faith\u00a0and\u00a0procedural unfairness\u00a0in the Law Association\u2019s investigation but failed to get the Court of Appeal to stop the Law Association from proceeding.<\/p>\n\n\n\n

In handing down its judgement , the Privy council unanimously dismissed Archie\u2019s appeal.<\/p>

\"\"<\/a><\/div>
\"\"<\/a><\/div>\n\n\n\n

The Privy council\u00a0\u00a0in its 16 page judgement, agreed with the Court of Appeal that the LATT\u2019s investigation cannot be equated\u00a0with a judicial or quasi-judicial determination of legal rights and liabilities to which the conventional\u00a0rules of natural justice apply.\u00a0<\/p>

\"\"<\/a><\/div>\n\n\n\n

\u201cNor was it necessary for the Board to consider the more difficult\u00a0question of the extent to which public bodies are required to be impartial in carrying out their statutory\u00a0functions,\u201d the judgement read.<\/p>\n\n\n\n

\u201cSince the local courts in\u00a0Trinidad and Tobago were far better placed than the Board to consider what the fair-minded and\u00a0informed observer in Trinidad and Tobago would make of the matters complained of, it was not for\u00a0the Board to disagree. However, even if the rules of natural justice applicable to the decisions of a\u00a0judicial or quasi-judicial body did not apply, \u201cpublic authorities do have a duty to carry out their statutory functions fairly\u201d.<\/p>

\"\"<\/a><\/div>\n\n\n\n

Earlier this year, the Chief Justice was granted conditional leave to appeal to the London-based Privy Council, as the Court of Appeal, including Acting Chief Justice, Allan Mendonca, in an unanimous decision, said that High Court judge, Nadia Kangaloo was wrong in her ruling and dismissed also Archie\u2019s application for leave to file for judicial review.<\/p>\n\n\n\n

Media reports had\u00a0\u00a0linked Archie to discussing security arrangements for judges with a personal friend and late last year, the friend, Dillian Johnson, told police that he had information on individuals who want to kill him.<\/p>

Johnson had survived a gun attack on him at his home in Gasparillo, in southern Trinidad.<\/p>

Archie was also accused of attempting to fast-track Housing Development Corporation (HDC) applications for various people. He has only responded to the allegations once and denied discussing judges\u2019 security, but admitted to recommending people for HDC housing.<\/p>\n
