In the life of man, there were to be as many trials, as there were to be tribulations. Moreover, there were to be seen as many intrigues, as there were to be \u2018Irony and Tragedy.\u2019 What were to be held to confidentiality, trust and privacy, were never to be exposed to publicity. Looked at from the perspective of the motoring public, Law enforcers could make as many motorists \u2018Victims of Travesty, as they could influence the mind of the citizenry. Based upon their actions or omissions; their deeds or misdeeds, they could cause the gullible and those susceptible to deception, believe falsehood to be truth. Some could also make even the most intelligent feel the innocent is guilty.<\/span><\/p>\n

SPEED \u2013 FORCE \u2013 IMPACT – DEATH<\/span><\/p>

\"\"<\/a><\/div>\n

The \u2018Speed; Force; and Impact\u2019 on contact with the \u2018Wrangler Jeep,\u2019 speak to a devastating end to an apparent \u2018Charmed Life\u2019 of Police motorcyclist, \u2018Corporal Robert Dyer\u2019 [October 3, 2023]. The clearly irrefutable contributing factors reportedly left; (a) \u2018An irreparable mangled-wreck of his personal black motorcycle; and (b) The non-surgical amputation of a rather \u2018Bad-Lucked Left Foot.\u2019 Seemingly, bedeviled by motorcycling adversities, the \u2018Left Foot\u2019 was reportedly fractured in a previous vehicular traffic accident. That which was then seen by the motoring public, was an apparent indiscrete overtaking maneuver of gross recklessness that had brought painful consequences [June 9, 2021].\u00a0<\/span><\/p>

\"\"<\/a><\/div>\n

UNNATURAL DEATHS<\/span><\/p>\n

Certain deaths have not only been long anticipated by Parliament, but specifically aimed at allowing a \u2018Coroner and a 5-member Jury\u2019 to inquire into the circumstances surrounding tragic and \u2018Unnatural Deaths.\u2019 The Law has made it sufficiently clear for the student body of the \u2018Baptist Academy\u2019 to understand that in \u2018Unnatural Death,\u2019 Coroner\u2019s Inquisitions\u2019 shall be held. Without a shadow of doubt, the death of the deceased motorcyclist, \u2018Corporal of Police Robert Dyer\u2019 vividly makes the point.\u00a0<\/span><\/p>

\"\"<\/a><\/div>\n

INDEPENDENCE AND TRANSPARENCY<\/span><\/p>\n

The \u2018Coroner\u2019s Inquisition,\u2019 as opposed to the closed-door \u2018Heads of Police Service and Traffic Department\u2019 as the sole decision-makers, was often preferred for its \u2018Independence and Transparency.\u2019 This allows for more ventilation of the circumstances touching the \u2018Unnatural Death\u2019 of a person. It particularly allows for a more informed determination of either; (i) \u2018A verdict of culpability; or (b) Misadventure.\u2019 Those with a deep sense of duty and service to humanity need no advice in guiding their actions or omissions, conduct by the Oath of office.\u2019<\/span><\/p>

INQUISITION TO PROSECUTION<\/span><\/p>

\"\"<\/a><\/div>\n

A tragic vehicular accident that may have been the subject of a \u2018Coroner\u2019s Inquisition\u2019 to be presided over by the assigned \u2018District \u2018B\u2019 Coroner,\u2019 appeared to have turned unexpectedly bizarre. To all, apparent evil intent and purposes, it took a mysterious U-turn to criminal \u2018Prosecution.\u2019 When the female motorist was slapped with the offence; \u2018Causing Death By Dangerous Driving,\u2019 such offence completely wrested a statutory-imposed duty from the \u2018Her Worship, District Coroner Nagio Emmanuel-Edwards\u2019 in holding a \u2018Coroners Inquisition.\u2019 Though not necessarily for want of procedural knowledge, bearing her own \u2018Cross,\u2019 and given certain developments, \u2018Her Worship,\u2019 appears well-positioned to take a deep sigh of relief.<\/span><\/p>\n

ELEMENTS OF OFFENCE<\/span><\/p>\n

The \u2018Vehicles and Road Traffic Act\u2019 states; \u2018Any person who drives a motor vehicle on a road; (i) \u2018Recklessly: or (ii) At a speed; or (iii) In a manner that is dangerous to the public, having regard to all the circumstances of the case, including; (a) \u2018The nature; (b) Condition; (c) Use of the road; and (d) The amount of traffic which is actually, or reasonably be expected to be on the road, commits an offence\u2019 [VRTA: Chapter 460: Section 55]. That which requires \u2018Evidence of Fact\u2019 are; (i) \u2018Manner; and (ii) Speed.\u2019 The others are inferentially subjective. Given these, it shall now be asked; \u2018Just why the motorcycling community of enthusiasts continue to show signs of decreasing?\u2019<\/span><\/p>\n

PROSECUTABLE OFFENCE<\/span><\/p>\n

Frequently, \u2018Billy-Goatish\u2019 courses of actions were taken by those with little time for reading and research and before investigations were completed. Guided by research into; (a) \u2018Coroner\u2019s Inquisitions; and (b) The \u2018Prosecutable Offence\u2019 of \u2018Causing Death By Dangerous Driving,\u2019 a procedural mindset may very well have been established as to have left an indelible impression on the minds of those concerned with the administration of justice. Those that may have been so affected include; (i) \u2018Law enforcement; (ii) Public prosecutors; (iii) The Magistracy; (iv) The Judiciary; and (v) Coroners.\u2019<\/span><\/p>\n

UNLAWFUL ARREST<\/span><\/p>\n

Though not necessarily, \u2018Billy-Goatish,\u2019 the hastily initiated arrest upon a female motorist, \u2018Cuban national, Dayneri Ferrer Vincent-Urlwin 28,\u2019 could very well be so referred. The arrest was clearly \u2018Unlawful,\u2019 as neither; (i) The Traffic Commissioner; (ii) The Senior Traffic officer; nor (iii) The Fatal accident investigator\u2019 had witnessed; (a) \u2018The manner of driving; and (b) The speed the motorcyclist and motorist were travelling, let alone witnessing the deadly vehicular accident.\u2019 This has made the point on \u2018Billy- Goatish\u2019 courses of action. Procedurally, a \u2018Warrant in the First Instance\u2019 duly issued by the \u2018Magistracy\u2019 may have sufficed.\u00a0<\/span><\/p>\n

FATAL MISTAKE<\/span><\/p>\n

Such has always been the preferred \u2018Professional Practice.\u2019 By then, the issuing \u2018Magistrate\u2019 may grill the investigator on the evidence so far obtained. Though not necessarily their responsibility, functional cooperation dictates some form of inquisitiveness. Thus, a \u2018Magistrate may also enquire whether or not the \u2018Director of Public Prosecutions (DPP) has seen or perused the \u2018Case File.\u2019 When a junior officer was assigned to conduct investigation into the tragic death of \u2018Corporal Robert Dyer,\u2019 that in, and of itself appeared to have been \u2018Fatal,\u2019 but only to the extent, it may have been a \u2018Mistake.\u2019\u00a0\u00a0<\/span><\/p>\n

PROSECUTORIAL TORMENT<\/span><\/p>\n

Given the investigators, first experience, there was reported to have been grave \u2018Procedural Confusion.\u2019 It reportedly started with a voluntary requested-visitation to the \u2018Parham Police Station\u2019 [October 11, 2023]. Thorough investigation by the astute \u2018Fatal Accident Investigators,\u2019 may assist in ascertaining just who may have been driving recklessly or dangerously at the time of the fatal vehicular accident. Instructively, one day after the deceased motorcyclist, \u2018Robert Dyer\u2019 was peacefully laid to rest, before the unfortunate, but distressed motorist could say; \u2018May his soul rest in peace,\u2019 her own soul came under \u2018Prosecutorial Torment.<\/span><\/p>\n

BIZARRE PROSECUTION<\/span><\/p>\n

The surviving motorist was reportedly slapped with the offence; \u2018Causing Death By Dangerous Driving\u2019 offence\u2019 [Loop: October 12, 2023]. With some degree of certainty, that which shall now be said is that a mindset on such a \u2018Prosecution\u2019 appears poised to have turned \u2018Bizarre.\u2019 prosecutors.\u00a0 That which was unearthed during research states; \u2018A charge of \u2018Dangerous or Careless Driving\u2019 in which the circumstances involved the death of a person should not be tried by the Court before the inquest upon such death is completed\u2019 [V\/Lex: 1952: R v Beresford: Criminal Appeal: R 143].\u00a0<\/span><\/p>\n

FATAL MOTOR VEHICLE ACCIDENT<\/span><\/p>\n

The civic-minded educators and student body of most educational institutions now knows that; \u2018A Coroner, within whose District the dead body of a person is lying, may issue his\/her \u2018Warrant\u2019 for the purpose of inquiring into the death of that person, hold an inquest on the body, if satisfied that; \u2018The death was caused by an accident, arising out of the use of a vehicle in a street or public highway\u2019 [Coroners Act: Chapter 105: Section 12 (2) (d)]. While there may have been other intervening factors, \u2018Coroners\u2019 appeared to have been made non-functional or functionally incompetent.\u00a0<\/span><\/p>\n

INVESTIGATIVE DEATHS<\/span><\/p>\n

This was often seen as evident when Law enforcers sought to place some deaths before Courts of \u2018Criminal Jurisdiction,\u2019 while some \u2018Tragic Killings\u2019 appeared to have been conveniently left to die \u2018Investigative Deaths.\u2019 Supporting such assertions, has been the case of \u2018Bendals resident, Mannie James 43.\u2019\u00a0 In this particular case, the residents of the \u2018Grays\/Green\u2019 community have witnessed the apparent cold-blooded gunning down of the deceased. That which was known was that the deceased was hotly-pursued by persons identified with the \u2018Military and Police.\u2019\u00a0<\/span><\/p>\n

MURDER<\/span><\/p>\n

The citizenry has seen it in live and living color on social media; while nationals in the \u2018Diaspora\u2019 will have been apprised of it through various news portals. Such killing from actual professional practice and knowledge, speaks to the heinous crime of \u2018MURDER\u2019 [July 31, 2023]. For whatever reasons, criminal investigators appeared to have lost sight of the classification of such a heartless and senseless killing. The \u2018Coroners\u2019 themselves may find it inescapable from \u2018Coroner\u2019s Inquisition Blame\u2019 for the static and untenable state of affairs and the spate of \u2018Suspect Police Killings.\u2019 They appeared not to have insisted on expeditious investigation and promptitude of submission of related \u2018Coroner\u2019s Inquest Files.\u2019<\/span><\/p>\n

SUDDENLY AND TRAGICALLY<\/span><\/p>\n

Compliant with \u2018Bail Conditions;\u2019(i) \u2018The sum of EC$50, 000: (ii) Two sureties; (iii) Surrendering of Travel Documents: and (iv) To report three times weekly to the \u2018Parham Police Station.\u2019 That which \u2018Fatal Accident\u2019 investigators appeared to have been in apparent woeful need, knowledge of the provisions contained in the \u2018Coroners Act.\u2019 Likened to dozens said to be pending, most appear not to know that the enactment provides for \u2018Coroner\u2019s Inquisition\u2019 into two rather gruesome and deadly vehicular accidents. The list, inexhaustive, now includes Police motorcyclists \u2018Corporals Clarence Cameron and Robert Dyer.\u2019 Incidentally, years apart, both have suddenly and tragically met their demise.\u2019\u00a0<\/span><\/p>\n

TWISTED VERSION OF EVENTS<\/span><\/p>\n

In an apparent \u2018Twisted Version of Events,\u2019 a news portal reported; \u2018Dayneri Ferrer Vincent-Urlwin is said to have been behind the wheel of a Jeep Wrangler that collided with Dyer\u2019s motorcycle, resulting in the officer\u2019s tragic death.\u2019 Then contradictorily, at a subsequent paragraph, the reporter has it; \u2018Dyer was reportedly travelling from East to West on the Sir Sidney Walling Highway when he collided with the Jeep that was travelling in the opposite direction\u2019 [Latrishka Thomas: Observer Media: Paragraph 4: October 13, 2023].\u00a0<\/span><\/p>\n

TRAVESTY OF JUSTICE<\/span><\/p>\n

Whether or not contradictory or confusing, this appeared to have been the correct version of event. Yet to \u2018Traffic Commissioner, Atlee Rodney QPM,\u2019 and assigned \u2018Head of the Traffic Department, Superintendent Elson Quammie,\u2019 they appeared to have seen the \u2018Fatal Vehicular Accident\u2019 through lenses, where the citizenry only saw \u2018Travesty of Justice.\u2019 Even as the personality of both officers speaks to an attitude of affability, as it affects rationality and logicality, they seemed not to have been properly informed of the motorcyclist\u2019s maneuverability on the public highway.\u00a0<\/span><\/p>\n

DAMNING PARAGRAPH<\/span><\/p>\n

Though none shall refer to these goodly officers as \u2018Billy-Goats,\u2019 that which appeared not to have captured the attention or imagination of \u2018Traffic Commissioner Atlee Rodney QPM and assigned Senior Traffic Officer, Superintendent Elson Quammie,\u2019 may have been an apparent \u2018Damning Paragraph\u2019 in the news report. For the benefit of information and investigation, it states; \u2018Reports further state that the female defendant (Dayneri Ferrer Vincent-Urlwin) was turning right into Lunar Park when she collided with the policeman, who had just overtaken some vehicles\u2019 [Observer Media: Paragraph 5]. Inferences might reasonably be drawn of the speed and the deceased manner of driving.<\/span><\/p>\n

CAUTION TO THE WIND<\/span><\/p>\n

The vehicle, running high on a residential concrete fence, reportedly struck a utility pole, thereby severing it in some three places. Now, some two years later, his colleague and \u2018Police Outrider, Corporal Robert Dyer,\u2019 tragically succumbed to injuries sustained in a vehicular accident on the \u2018Sir Sydney Walling Highway\u2019 [October 5, 2023]. Speaking to his personal knowledge of the deceased officer\/motorcyclist was his apparent friend and colleague,\u2019 \u2018Corporal of Police Brendan Sutherland.\u2019 He succinctly described him as; \u2018Easy-going and has a passion for motorcycling\u2019 [ANR: September 4, 2023].\u00a0<\/span><\/p>\n

SUPERSONIC CONCORD SPEED<\/span><\/p>\n

At a suspected speed capable of being likened to the transatlantic \u2018Air France-Supersonic Concord Jetliner\u2019 [June 21, 1976], his \u2018Suzuki Swift\u2019 motorcar reportedly veered off the Highway to \u2018All Saints\u2019 and surrounding communities. Striking a roadside culvert, it reportedly became airborne. The man-made flying objects that were to be lifted off the face of the Earth to fly skyward, are aircrafts. Among such are the financially-troubled; \u2018LIAT-1974: Antigua and Barbuda Defence Force Airwing; Defunct Antigua Airways; and the apparent dangerously flirtatious commercial airline called \u2018Air Peace.\u2019\u00a0<\/span><\/p>\n

JAWS OF LIFE<\/span><\/p>\n

In the case of \u2018Corporal Clarence Cameron,\u2019 he was reportedly violently thrown from the vehicle upon impact. He reportedly left behind a helpless and seriously injured female passenger. [The Caribbean Alert: August 5, 2021]. Eventually, she was extricated and rescued by the \u2018Jaws of Life.\u2019 Ironically, the lifesaving gadget was operated by his fellow-colleagues in the \u2018Antigua and Barbuda Fire and Rescue Services.\u2019 As has been well known to humans, both were sorrowfully and grievingly laid to rest peacefully beneath the \u2018Earth\u2019s fiery and dangerous surface.\u00a0<\/span><\/p>\n

THRILL OF SPEED<\/span><\/p>\n

Whether or not it was simply a fad or just fascination, two fine motorcyclists that seemed to have been deeply committed to assigned \u2018Police Outriding Duties,\u2019 tragically came to their untimely deaths. The first to have irresistibly gave up the bodily ghost, yet in \u2018Sorrowful Peace\u2019 was \u2018Corporal of Police, Clarence Cameron.\u2019 The deadly vehicular accident, left behind a seriously injured female passenger. These officers no longer exist to enjoy the apparent \u2018Thrill of Speed\u2019 or to experience the often avoidable silly, bruising and deadly spills. They shall remain in the memory of those they knew, and those that knew them, under a shining light.<\/span><\/p>\n

THE FIGURE \u20188\u2019<\/span><\/p>\n

That which reportedly left an indelible impression on the minds of the bereaved, were the circumstances of death and bodily injuries painlessly sustained That which no register, neither of \u2018Births nor Deaths\u2019 will ever reflect, are that both not only hit the road and died instantaneously. Seemingly, the bereaved family of \u2018Corporal Robert Dyer\u2019 has commemorated the crash site with two wooden crosses. One was adorned with a metal \u2018Crest\u2019 and weather-resistant flowers. Observably, there were disposable candle holders, while, assumedly, motorcycle enthusiasts have left at the immediate crash site graphics of tire impressions of the figure \u20188\u2019 [October 17, 2023]. While over time, the elements may obliterate them, their invisible presence shall still be felt.\u00a0<\/span><\/p>\n

VEIL OF SECRECY<\/span><\/p>\n

It would appear that a peculiar course of action may have been taken, respecting the \u2018Mangled remains of the crashed motorcycle of the deceased, Corporal Robert Dyer.\u2019 Instructively, defying \u2018Funeral Rites,\u2019 yet perhaps most fittingly, apparently under a \u2018Veil of Administrative Secrecy,\u2019 that which was reportedly occupying rank-and-file discussions was the accompaniment with the mortal remains of \u2018Corporal Robert Dyer.\u2019 Should it not be confirmed, then it begs two fundamental questions; (i) \u2018Where is the motorcycle; and (ii) Why was the Court-recognized \u2018Expert Motor Vehicle Examiner, Lancelot James,\u2019 not professionally-called upon to examine both vehicles?\u2019\u00a0<\/span><\/p>\n

SINISTER PLOT<\/span><\/p>\n

Not infrequently, well-positioned and well-placed personnel shall not be deemed reckless not to know. There are some things they shall not know. Organizationally, while some occurrences may speak to \u2018Sinister Plots,\u2019 some often necessitated complete secrecy.\u2019 When a handful of organizational members was observed lingering around the \u2018Public Cemetery\u2019 under cover of darkness, they could not have been waiting to see if deceased Corporal of Police, Robert Dyer\u2019 would have emerged from \u2018Tomb.\u2019 If anything, the cemetery-lingering funeral party\u2019 may simply have waited in anticipation to hear him thanking them for acceding to his last wish, and their continued pledge of continued loyalty.\u00a0<\/span><\/p>\n

PREGNANT WITH SUSPICION<\/span><\/p>\n

Privilege information and the confirmed absence of the mangled motorcycle from the area it originally occupied has not only provoked certain discussions, but also \u2018Pregnant with Suspicion.\u2019 Those with enquiring minds, appeared to have been left in a quandary. Seniors of the upper echelon of the Police Service\u2019 were either tight-lipped or ignorant. Then among the junior officers, though many may have been left dumb-founded, yet speculations were rife. So was the and imagination, said to be still running \u2018Wild with Suspicion.\u2019 It was narrowly, but scandalously whispered that mere days before the burial of the remains of \u2018Corporal Robert Dyer, the \u2018mangled remains of the motorcycle\u2019 reportedly disappeared from the \u2018American Road Police Headquarters.\u2019 Though unconfirmed, such had prompted internal curiosity.\u00a0<\/span><\/p>\n

SANCTIONED OR AUTHORIZED<\/span><\/p>\n

In all the speculations, dependent upon certain stages, advanced or otherwise, though an unlikely occurrence, such could either be \u2018Sanctioned\u2019 by; (a) \u2018The sole authority, District Coroner, Nagio Emmanuel-Edwards, and likened to the body of the deceased, having been also viewed by a 5-member Jury: or (b) Traffic Commissioner, Atlee Rodney QPM; or with the \u2018Coroner\u2019s Inquest\u2019 been wrested from the \u2018District Coroner;\u2019 then possibly, on the prosecutorial advice of; (c) Director of Public Prosecutions (DPP), Shannon Jones-Gittens.\u2019 From professional knowledge, only one of these persons may have so authorized.<\/span><\/p>\n

FLAG-DRAPED CASKET<\/span><\/p>\n

Had the mangled remains of the motorcycle been released to bereaved families, the sanctioning or authorizing body run the risk of being seen as extending favor and affection to persons known or unknown. This may then give the uncanny appearance of inconsistency, particularly, as the operable \u2018Wrangler Jeep\u2019s seizure, speaks to deprivation of its legitimate use by its owners. The funeral cortege saw an adorned \u2018Flag-Draped Casket.\u2019 Assumedly, it contained only the \u2018one-legged body remains of, \u2018and \u2018severed leg\u2019 of \u2018Corporal Robert Dyer\u2019 as the cortege slowly marched to the \u2018St. John\u2019s Public Cemetery (SJPC)\u2019 [October 10, 2023].<\/span><\/p>\n

BODY – LEG – MOTORCYCLE<\/span><\/p>\n

That which the \u2018Senior Traffic officer\u2019 had dismissed, was that the \u2018Mangled remains of the motorcycle\u2019 was buried beneath the specially-constructed tomb\u2019 [October 15, 2023]. Should, its whereabouts be officially confirmed, then \u2018Man and Motorcycle\u2019 would have been sharing \u2018one Grave and one Tomb.\u2019 Research has revealed that to the best of his knowledge and belief, \u2018Traffic Superintendent Elson Quammie\u2019 confirmed that only; (a) \u2018The Body; and (b) Detached Leg\u2019 were placed in the casket and laid to rest in the Tomb [October 10, 2023].<\/span><\/p>\n

EVIDENTIAL ELEMENTS<\/span><\/p>\n

If insisted, it may be the first time that a body will be exhumed within this jurisdiction. Such authority resides only with the assigned \u2018District Coroner.\u2019 However, buried or buried not, these clearly beloved and service-oriented \u2018Corporals of Police,\u2019 seemingly threw \u2018Caution to the Wind. In a prosecution, the two most critical \u2018Evidential Elements\u2019 that shall be \u2018factually adduced to constitute \u2018Dangerous Driving,\u2019 (i) \u2018Speed; and (ii) Manner.\u2019 Oral evidence given to the \u2018Fatal Accidents\u2019 investigators without other corroborative evidence, may prove difficult to any public prosecutor.<\/span><\/p>\n

SPIRIT OF DISCERNMENT<\/span><\/p>\n

While it shall not be said that the \u2018Traffic Commissioner and assigned Senior Traffic officer\u2019 may have harbored illusions, none shall have qualms over the citizenry\u2019s desirability for both to match their thinking with thoughts rationally guided by the \u2018Spirit of Discernment.\u2019 This shall be backed-up with professional knowledge, competence and investigative ability. Clearly, both appeared to have, instead seen the motorist \u2018crashing\u2019 into the motorcyclist. That which shall have been most evident to even the incompetent \u2018Traffic Accident Investigators,\u2019 was clearly not only the maneuver by the female motorist, but more particularly, the apparent dare-devil motorcycling exploits of the deceased motorcyclist.\u00a0<\/span><\/p>\n

ADMINISTRATIVE NEGLIGENCE<\/span><\/p>\n

Then adding to his untimely demise, may have been an apparent blatantly gross \u2018Administrative Negligence.\u2019 A local news portal provided insights into a previous serious vehicular accident. The officer, then driving a Police-assigned motorcycle reportedly attempted to overtake a \u2018Rig\u2019 reportedly hauling a 40- foot goods metal container, at the \u2018Lady Newgent Junction\u2019 [June 9, 2020]. Naturally, the motorcyclist was said to have been driving at reasonably high speed to get ahead of the \u2018Rig and Container. The news report revealed; \u2018The truck driver, making a right turn when the officer allegedly tried to overtake and collided with the truck\u2019 [Observer Media: June 9, 2021].\u00a0<\/span><\/p>\n

CHARMED LIFE<\/span><\/p>\n

The news portal reported that he was rushed to the then \u2018Mount St. John Medical Center (MSJMC), now \u2018Sir Lester Bird Medical Center (SLBMC)\u2019 [ABN: June 9, 2020]. Assumedly seized of such knowledge, it saw the apparent \u2018Charmed Life\u2019 motorcyclist being availed of prosecutorial immunity. Some three years later, the luckless officer, seemingly with an apparent affinity for motorcycle, died instantly at the immediate entrance to the \u2018Lunar Park\u2019 fenced, but an ungated community\u2019 [Loop Updated: October 13, 2023].\u00a0<\/span><\/p>\n

FLOUTING LAW WITH IMPUNITY<\/span><\/p>\n

The \u2018Left Leg\u2019 was reportedly completely \u2018Severed\u2019 from the knee. Incidentally, in the first instance, when the deceased may have been prosecutorally sanctioned for the traffic violation,\u2019 he appeared to have been given complete \u2018Immunity.\u2019 This might necessarily prompt suggestion that no sanction was to be imposed against law enforcers that have been publicly observed \u2018Flouting the law with Impunity.\u2019 Incidentally, that which had bedeviled scores of motorists had been the apparent terrifying and overly-abused \u2018Powers of Arrest,\u2019 for the \u2018Ticketable \u2018Fixed Penalty Offence,\u2019 of running the \u2018Red Traffic Signal Light.\u2019<\/span><\/p>\n

PROCEDURAL GUIDELINES<\/span><\/p>\n

It shall never be seen by the observant and curious citizen that those who enforce Law as ignoring or flouting such law by deliberately side-stepping perfectly legally-provided \u2018Procedural Guidelines,\u2019 to do special favors or to bring avoidable harm to, and upon the law-abiding and innocent. Certain courses of action by agents of the \u2018State\u2019 often speak to the \u2018Corruptible state of Affairs\u2019 in some State-run institutions. It was seen within the Judiciary, Magistracy and Law enforcement agencies.\u00a0<\/span><\/p>\n

THE OATH<\/span><\/p>\n

Parliament anticipated certain professional behavior by law enforcers. The \u2018Oath\u2019 guiding such behavior states; \u2018As a member of the Police Force of Antigua and Barbuda, I will well and truly serve Our Sovereign King without; (a) \u2018Favor or affection; (b) Malice or ill-will; and (c) To the best of my knowledge and skill, I will discharge all the duties thereof, faithfully according to Law\u2019 [Police Act: Chapter 330: Section 17]. These officers reportedly lived by this \u2018Oath.\u2019 They shall remain in the prayers, thoughts and memory of those they knew and loved them, as well as those that knew them, worked and socialized with, and wished them well.<\/span><\/p>\n

WIELDING POWER OF ABUSE<\/span><\/p>\n

Erratically, overzealous, egoistic and unsupervised, and seemingly encouraged by their \u2018Superiors and the Magistracy,\u2019 arresting officers, hiding under the guise of eliminating \u2018Dangerous Driving\u2019 from the roadway, likened to untethered raging \u2018Spanish Bulls,\u2019 went on the rampage, gouging motorists. One, include a quiet-spoken practicing attorney. For instance, in cases where the law authorized only the \u2018Traffic Commissioner to \u2018Suspend Driver\u2019s Licence,\u2019 the \u2018Magistracy\u2019 reportedly usurped such power [VRTA: Chapter 460: Section 70]. Even for minor \u2018Fender bender vehicular accidents,\u2019 many motorists reportedly felt the \u2018Wielding Power of Abuse.\u2019<\/span><\/p>\n

CORRUPT AND UNSCRUPULOUS<\/span><\/p>\n

Those familiar with \u2018Law and Justice\u2019 should know that there are knowledgeable citizens that understand the concept called \u2018Perverting the Course of Justice.\u2019 This was known to have occurred when the \u2018Corrupt and Unscrupulous\u2019 law enforcement officers chose to do the unexpected and unthinkable. Seemingly, traffic investigator \u2018Police Constable Brendon Sutherland\u2019 expected no tarnished reputation, neither of himself, nor of the \u2018Police Service\u2019 as a whole.\u00a0<\/span><\/p>\n

SENSE OF DUTY<\/span><\/p>\n

Those with a deep sense of duty, service to humanity and protection of the innocent and weak against the strong influences of society, shall guide their actions or omissions, conduct and utterances by \u2018The Oath\u2019 that states; \u2018As a member of the Police Force of Antigua and Barbuda, I will well and truly serve Our Sovereign King without; (a) \u2018Favor or affection; (b) Malice or ill-will; and (c) To the best of my knowledge and skill, I will discharge all the duties thereof, faithfully according to Law\u2019 [Police Act: Chapter 330: Section 17].\u00a0<\/span><\/p>\n

FUNDAMENTALLY TROUBLING\u00a0<\/span><\/p>\n

In the instant case, there appeared to have been some \u2018Fundamentally Troubling\u2019 issues. Foremost may have been the most important investigative questions; (i) \u2018Why were the circumstances surrounding the vehicular accidental death of \u2018Corporal Robert Dyer\u2019 not left to the independence and transparency of a \u2018Coroner\u2019s Inquest? and (ii)\u2019 Why was the originally-assigned traffic accident investigator, \u2018Constable Sutherland\u2019 requested to be relieved of the investigation?\u2019 Still, there were other fundamentals of great importance. For instance, while persons close to the investigation appear peculiarly or particularly tight-lipped, the inquisitive citizen and curious among Law enforcers have asked; (i) \u2018Why was the motorcycle \u2018Licensing and Insurance\u2019 status not regularized to legitimize and facilitate its use on the public highway.<\/span><\/p>\n

INQUEST CASE FILE<\/span><\/p>\n

\u00a0Then there will have been the question; (ii) \u2018What provisions then, and now, exist for compensatory considerations in the event of personal injuries, property damage or loss resulting from the use of such vehicle?\u2019 Given the statutory provision that all \u2018Unnatural Deaths,\u2019 no matter how tragic\u2019 shall first be reported to the \u2018District Coroner; (iii) \u2018What may have informed the decision not to submit an \u2018Inquest Case File\u2019 to the District Coroner?\u2019 Moreover; (iv) What may have informed the decision to dispose of the remains of the motorcycle before arrest and institution of the criminal prosecution for the offence; \u2018Causing Death by Dangerous Driving?\u2019\u00a0<\/span><\/p>\n

VIRTUE OF FEMALE\u2019S VIRGINITY\u00a0<\/span><\/p>\n

It was to the knowledge of \u2018Law enforcers\u2019 that only the \u2018DPP\u2019 shall consider the appropriateness in instituting criminal proceedings. Undoubtedly, it may not only have been an ill-conceived initiative, but also a most ridiculous, dastardly and apparent self-serving legislative amendment to the \u2018Police Act\u2019 [Chapter 330: Sections 22 and 31]. Likened to the \u2018Virtue of a Female\u2019s Virginity,\u2019 it effectively deprived Law enforcers, from \u2018Constable to Commissioner of Police\u2019 of their fundamental duties to initiate criminal proceedings independently against society\u2019s lawless citizens. That which remains factually known to all a sundry, has been the no parliamentary amendments for the restoration of \u2018Legislative Authority\u2019 in the \u2018Act\u2019 that defines the \u2018Duties and Functions\u2019 of members of the long established \u2018Police Service.\u2019<\/span><\/p>\n

TINKERED AMENDMENT<\/span><\/p>\n

Thus; (a) \u2018Instituting criminal proceedings; and (b) Filing of Criminal \u2018Complaints Without Oath,\u2019 though made an exception in the \u2018Tinkered Amendment\u2019 to the Criminal Prosecution Service Act (CPSA)\u2019 [No.28 of 2017], while such legislative gesture may have brought comfort to fools, but certainly not independence to members of the \u2018Police Service.\u2019 This has been the statutory enactment that has virtually stripped every Law enforcer of their independence and duties in; (a) \u2018Filing Complaints\u2019 before the Magistrate\u2019s Court; and (b) Prosecuting Summary offences\u2019 as previously provided to the \u2018Commissioner of Police\u2019 and every enlisted and currently serving member\u2019 [Police Act: Chapter 330: Sections: 6].<\/span><\/p>\n

CONCLUSION<\/span><\/p>\n

Not infrequently, the \u2018Malaise of Tardiness\u2019 and impotence observed in some public institutions as well as in some \u2018State\u2019 agencies, appears to have been taken on the appearance of an endemic. Disturbingly, this were to be seen in divers\u2019 places, including those of the administration and dispensation of justice. Law enforcers, that has a sense of \u2018Loyalty to Justice,\u2019 and not influenced by the environment, but guided by professional ethics. They too, shall be forever mindful of the lingering and expected dangers on the roadway. Those starved for scruples and guided by the corruptible influences of the environment, will be seen as unmindful of the concept, \u2018Serve and Protect.\u2019 Whether or not they may be seen as servants of the people, will be dependent upon the things they do under \u2018Phony Pretext\u2019 [Paul Quin: OMG] of rendering service to the nation.<\/span><\/p>\n
