It may take just one \u2018Rogue Cop\u2019 and one act of indiscretion or criminality, then law enforcement is brought into disrepute, while discredit is brought upon the reputation of the \u2018Police Service.\u2019 Conversely, it takes one act of dishonesty or organizational thievery, in causing reputational damage, not just to one innocent member, but also, the entire membership. This has been a universal phenomenon. Hence, this is not unique to one \u2018Police Service,\u2019 and one Law enforcement jurisdiction.\u00a0<\/span><\/p>\n

RECKLESS ABANDON<\/span><\/p>

\"\"<\/a><\/div>
\"\"<\/a><\/div>\n

In recent times, outside of \u2018Police Gun Violence\u2019 against unarmed citizens, has risen the vexed and troubling issue of \u2018Unaccountability of Police Exhibits.\u2019 A Commissioner may wish to address these than, apparently with \u2018Reckless Abandon,\u2019 apprising \u2018Cabinet Members\u2019 of; (a) \u2018Illegal gun acquisition by business people; and (b) Gun Rentals by criminals for the commission of crimes\u2019 [ANR: September 6, 2023]. From a professional perspective, these are \u2018Confidential Matters\u2019 only for members of the \u2018National Security Council (NSC). Commissioner of Police, Atlee Rodney QPM,\u2019 shall be cautioned that he might be sliding down a slippery slope to destruction.<\/span><\/p>

\"\"<\/a><\/div>\n

PROCEEDS OF CRIME<\/span><\/p>\n

To understand the legally coined words \u2018Tainted Property,\u2019 is to be sufficiently acquainted with the \u2018Statute.\u2019 It provides interpretation for; (i) Every law enforcer, as well as the citizenry to familiarize themselves with the particular Law – Proceeds of Crime Act\u2019 [No.13 of 1993]. Specific to these, is that the \u2018Seized Property\u2019 shall be deposited into the possession of \u2018Custodians of Police Exhibits.\u2019 This commentary seeks to guide a procedural understanding of seized citizen\u2019s property\u2019 as \u2018Exhibits\u2019 for: (i) Evidential purposes in criminal prosecutions; or (ii) As \u2018Tainted Property\u2019 in \u2018Forfeiture\u2019 proceedings.\u2019\u00a0<\/span><\/p>

\"\"<\/a><\/div>\n

PERSPECTIVE<\/span><\/p>\n

This commentary specifically looks at; (i) \u2018Un-redressed indignities of; (a) \u2018Detention; and (b) Strip-Search of 14-Teachers, seemingly suspected without \u2018Reasonable Grounds;\u2019 and (ii) The apparent \u2018mysterious disappearance\u2019 of \u2018EC$20,000+\u2019 reportedly seized from a \u2018Contractor\u2019 as \u2018Tainted Property;\u2019 and (ii) Disappearance of some \u2018EC$18, 000; and US$1, 500\u2019 from the possession of either; (a) \u2018The arresting officer; or (b) Police Court Prosecutors; or (c) The Custodian of Police Exhibits- Criminal Records Office (CRO).\u2019 It also looks at the \u2018Criminal Exploits\u2019 of three convicted \u2018Police Felons,\u2019 then actively serving in the Police Service. These officers had not only run foul, of the \u2018Law,\u2019 but were also made prosecutorally amenable to Law.<\/span><\/p>

\"\"<\/a><\/div>\n

STAFF ROOM DETENTION: STRIP- SEARCH<\/span><\/p>

\"\"<\/a><\/div>\n

This commentary, however, begins with the indignities of; (a) \u2018Staff room detention; and (b) Strip-search\u2019 by Police officers, probing with their eyes, and observing to see if \u2018EC$4, 500\u2019 would have been dropped out from somewhere. Not infrequently, the innocent citizens have seen innumerable, but unfounded accusations made against them. Not infrequently, \u2018Suspects\u2019 were identified, and described by \u2018STRATCOM\u2019s Regurgitative Narrative\u2019 that those fell under Law enforcers radar, were seen \u2018Acting in a suspicious manner.\u2019 This could not have been said of some \u201914-Teachers, then assigned at the \u2018All Saints Secondary School (ASSS).\u2019\u00a0 Compounded the difficulties of so-called \u2018Suspects,\u2019 may have been the apparent insensitive actions of the apparent poorly trained\u00a0 and uncouth \u2018Law enforcers.\u2019\u00a0<\/span><\/p>\n

MISSING MONEY<\/span><\/p>\n

It has been the experience that though searches were often conducted for its retrieval, far from harbored belief, \u2018Money\u2019 has never gone \u2018Missing.\u2019 This appears more of a misnomer, than of fact. That which remains factual, was that the \u2018Innocent\u2019 citizen was frequently suspected and fingered in the disappearance of \u2018Money.\u2019 The case of the \u2018All Saints Secondary School Teachers, makes the point. When a female colleague reported the disappearance of some \u2018EC$ 4, 500,\u2019 from a hand bag\u2019 [October 23, 2018]. In this case of a report of \u2018Missing Money,\u2019 the innocent Teachers, under observation by the \u2018Student Body\u2019 was reportedly corralled in the \u2018Staff Room,\u2019 by Police officers that had shown scant regard to their human dignity and worth.<\/span><\/p>\n

INDIGNITIES: DETENTION\/STRIP-SEARCH<\/span><\/p>\n

Law enforcers that appeared starved for; (a) \u2018Procedural knowledge;\u2019 (b) Enshrined fundamental constitutional rights of the individual; and (c) \u2018Respect for the dignity of humans.\u2019 That which may have been most outrageous were the \u2018Indignities suffered; (a) \u2018Detention or restrained liberty; and (b) Strip-Search\u2019 at the \u2018All Saints Secondary School.\u2019 These were suffered by some of the finest and noblest educators.\u2019 They were subjected to baring their bodies and exposing their anatomies at the \u2018Staff Room\u2019 at the educational institution. Without; (a) \u2018Reasonable suspicion; and (b) Lawful authority,\u2019 but seemingly curious to see the \u2018Promise Land,\u2019 had reportedly demanded that they perform a \u2018Strip\u2019 without \u2018Teasing.\u2019<\/span><\/p>\n

PEERING AND PROBING EYES<\/span><\/p>\n

The innocent educators had no \u2018Fountains\u2019 in which \u2018Coins\u2019 may have been thrown, that Law enforcers may have visited and made \u2018Fanciful Wishes.\u2019 Somehow, the apparent deprave enforcers were hoping to see \u2018Money\u2019 dropped from the \u2018Promise Land.\u2019 The educators, acting as instructed saw nothing the Police investigators have been looking for, fell on the floor. Conscious of their \u2018Peering and Probing Eyes\u2019 surveyed the \u2018Promise Land,\u2019 many were said to have accused those conducting the search of showing scant respect to their privacy and human dignity. Acting against their will and invading their privacy, they had been reportedly forced to removed their wearing- apparel\u2019 [Observer Media: October 23, 2018].\u00a0\u00a0<\/span><\/p>\n

EDUCATORS\u2019 TREATMENT<\/span><\/p>\n

In fact, such \u2018Land\u2019 held no \u2018Promises,\u2019 neither for; (i) \u2018Commissioner of Police, Atlee Rodney QPM; (ii) Attorney General, Justice and Legal Affairs; Police Minister and \u2018Principal Legal Advisor to the Government, Steadroy \u2018Cutie\u2019 Benjamin;\u2019 nor (iii) The male and female officers conducting the illegal search. They had reportedly coerced the apparent chicken-hearted \u2018Principal\u2019 into providing accommodation for the commission of an act so depraved, that the nation became enraged. It continues to boggle minds, why law enforcers seemed to have harbored a belief that the educator\u2019s body, was the \u2018Central Bank of the \u2018Organization of Eastern Caribbean States (OECS).\u2019<\/span><\/p>\n

\u00a0BRAIN OR FOOT<\/span><\/p>\n

Except conjoin twins, the human body has, but one head and one brain. It would seem that if the body has at least one \u2018Big Foot,\u2019 that was bigger than the brain, then the \u2018Foot\u2019 may take him\/her to places where \u2018Angels\u2019 fear. This may be the time when humans begin to think with the \u2018Foot\u2019 and not the \u2018Brain.\u2019 Since the convictions and incarceration of; (i) \u2018former Corporal of Police, Alex \u2018Big Foot\u2019 Thomas 39,\u2019 who seemingly allowed his \u2018Foot\u2019 to influence an attempt at pulling off an ill-advised, but adventurous night-time city-robbery\u2019 at \u2018Paradise Casino\u2019 [ABS Tv: April 4, 2014].\u00a0<\/span><\/p>\n

DAY-BREAK RAID<\/span><\/p>\n

Then in more recent times, few other incidents involving \u2018Law enforcers\u2019 may have surprised the populace. That which may not have been seen as shocking, may have been the spectacular day-break raid on a remote farm in the \u2018Browne\u2019s Bay\u2019 area. The \u2018Day-Break Raiders,\u2019 (i) \u2018Corporal Marcus Isadore 43; and (ii) Police Constable, Peter Lugay 23,\u2019 have allegedly done the unexpected and unthinkable. The duo allegedly held two males in dense vegetation at gunpoint. With allegations of threats of other courses of action, they allegedly pistol-whipped them into submission. Then dispossessed them of a large quantity of a \u2018Vegetable Substance (Cannabis-29lbs)\u2019 [February 2017].\u00a0<\/span><\/p>\n

SEVERE PENALTIES<\/span><\/p>\n

For his conviction of \u2018Attempted Aggravated Robbery,\u2019 and those allegedly committed by the two other criminal convicts, the respective \u2018Trial Judges\u2019 dropped upon; (i) \u2018Corporal Thomas\u2019 and his \u2018Big Foot\u2019 a \u201823-year Jail Sentence; while (ii) For their convictions of; (a) \u2018Kidnapping: (b) Gun-butted Assault; (c) Corruption; and (d) Misbehavior in Public office,\u2019 Corporal Marcus Isadore\u2019 was slapped with a \u2018Severe Penalty of EC$80, 000\u2019 and a 5-year vacation; while (iii) Police Constable Peter Lugay,\u2019 was slapped with EC$30, 000,\u2019 as well as a short \u20182-year-period away from the rest of society. Both were institutionalized at the then\/now, \u2018Her\/His Majesty\u2019s Prison (HMP)\u2019 to cogitate [ANR\/Real News: May 9, 2022].<\/span><\/p>\n

PROSECUTORIAL CONSEQUENCES<\/span><\/p>\n

Both Law enforcers appeared reckless, not to have foreseen looming \u2018Prosecutorial Consequences\u2019 of; (a) \u2018The imposition of a hefty fine; and (b) A lengthy custodial sentences that may have reverberated across the nation.\u2019 These will have been borne out, when at trial at the \u2018Criminal Assizes\u2019 for; (i) \u2018Attempted Robbery; (ii) Kidnapping; (iii) Assault; and (iv) Misbehavior in Public office,\u2019 before mixed-Juries. The \u2018Jury,\u2019 satisfied with the evidence adduced, and dissatisfied with the behavior and the several acts of criminality, had been unanimous in returning \u2018Verdicts of Guilty.\u2019 The three convicted criminals were accorded institutionalized residency.\u00a0<\/span><\/p>\n

BIG FOOT CONVICTION<\/span><\/p>\n

Both were dropped off to cogitate at the then\/now, \u2018Her\/His Majesty\u2019s Prison (HMP)\u2019 [ANR\/Real News: May 9, 2022].<\/span><\/p>\n

PHILOSOPHICAL VIEW- \u2018NECESSITY\u2019<\/span><\/p>\n

Down through the pages of history, humans had done everything to acquire substantial wealth. Thus, in every sphere of life, man has done the unthinkable in acquiring \u2018Money.\u2019 This may have been understood by the reading of the \u2018Holy Scriptures.\u2019 The \u2018Cardinal Sin,\u2019 being that of \u2018Judas Iscariot.\u2019 Irrespective of nature and gravity, none may deny there are always looming consequences for acts of criminality. The philosophical view of world-renowned social commentator, \u2018Slinger Francisco, \u2018Mighty Sparrow,\u2019 has been, and irrefutably so; that which is a \u2018Necessity\u2019 to man, there is no Law\u2019 [Song: Honesty: YouTube].<\/span><\/p>\n

ACQUISITION AND POSSESSION<\/span><\/p>\n

It has been a universally accepted as an absolute financial necessity in human life and affairs. Members of society shall know that outside of human greed, humans have done that which they have considered necessity, and not necessarily that which brings pain or peril. On the issue of the \u2018Acquisition and Possession\u2019 of \u2018Money,\u2019 there comes a time when law enforcers have raised the fundamental questions of; (i) \u2018Legitimacy; and (ii) Lawfulness.\u2019 Invariably, the indigent citizens, not only appear always to have been under the radar of law enforcers, but also hounding.\u2019 Be that as it may, none may deny its monetary value and usage for human needs and survivability.\u00a0<\/span><\/p>\n

ORGANIZATIONAL THIEVERY<\/span><\/p>\n

Universally, not only depraved and roguish behavior was well known among a small minority of law enforcers, but also \u2018Organizational Thievery,\u2019 had become somewhat endemic. This was when, inferentially, Police administrators were seen to have created an environment, and haven for those prone to committing internal disciplinary indiscretions or condoned external acts of criminality. The shocking and unnerving social media revelation of the disappearance of a large sum of \u2018Seized Tainted Money,\u2019 said to have amounted to; \u2018Twenty-One Thousand \u2018EC\/US-$$$ \u2026???\u2019 from the \u2018Police Department, has placed the presumed innocent \u2018Woman Police Constable, Lenia Thomas\u2019 under administrative and public scrutiny.\u00a0<\/span><\/p>\n

INVESTIGATIVE DIRECTION<\/span><\/p>\n

In the peculiar case of, and horrifying experiences of \u2018Woman Police Constable Lenia Thomas 33,\u2019 she not only appeared to have been left in quandary and purgatory, but also in a state of agony and uncertainty. While she may also be seen as facing disciplinary jeopardy for her \u2018Unaccountability\u2019 of some EC$18, 000; and US$1, 500,\u2019 thorough investigation may show she was not the thief.\u2019\u00a0 Those with professional knowledge shall know that property seized in connection with criminal activities, shall be deposited with the \u2018Custodian of Police Exhibits. Such shall be held for \u2018Safe Keeping,\u2019 until the \u2018Fixtured Date\u2019 s\u2019 for; (a) \u2018Criminal trials; or (b) Forfeiture hearings come up.\u2019 This paragraph seeks to influence \u2018an Investigative Direction\u2019 that shall pass within the limits of the \u2018Prosecution Unit.\u2019<\/span><\/p>\n

TRIAL DELAY<\/span><\/p>\n

The lengthy adjournment appeared to have created confusion in her mind, and fear and anxiety in the heart of the arresting officer. Given a \u2018Fixtured Trial Date,\u2019 the non-production of the \u2018Monetary Exhibit\u2019 was said to have forced further trial delay. She appeared immediately dementia-stricken, as she appeared not mentally-collected as to whether or not, she had retrieved the suspected and \u2018Seized Tainted Money\u2019 from the Police Court Prosecutor,\u2019 on the first Court appearance. This shall not have been troubling if she did not.\u00a0<\/span><\/p>\n

CUSTODIAN OF EXHIBITS<\/span><\/p>\n

The \u2018Police Prosecutor\u2019 that had \u2018Actual Custody,\u2019 has a triple responsibility;\u2019 (i) \u2018Ensuring its return to the possession of the arresting officers; or (ii) Ensuring its safety, while maintaining \u2018Chain of Custody;\u2019 or (ii) Ensuring that it is returned to the \u2018Custodian of Police Exhibits.\u2019 Such Prosecutor shall be considered \u2018grossly reckless\u2019 not to have ensured its security. While those seemingly starved for knowledge, possession of large sums of money has not been defined, neither in the \u2018Proceeds of Crime Act\u2019 as a criminal offence. As much as there shall be time for; (a) \u2018Dancing to the African song \u2018Jerusalema; and (b) Hiking in the hills overlooking Falmouth Harbor,\u2019 there shall still be time for personnel to acquaint themselves with the Laws of \u2018Antigua and Barbuda.\u2019<\/span><\/p>\n

VICTIM OF IGNORANCE<\/span><\/p>\n

Clearly, those unacquainted with these provisions, \u2018Run the Risk\u2019 of having \u2018Monies\u2019 disappeared without trace. The possibilities exist for this to occur, either (i) \u2018During movement to the Court at trial; or (ii) From \u2018Custodian of Police Exhibits.\u2019 From a professional and investigative perspective, the \u2018female Police Constable Lenia Thomas,\u2019 apparent lack of procedural knowledge, suggested that she may have been a \u2018Victim of Ignorance.\u2019 Thus, unknowingly, such \u2018Ignorance\u2019 may have been exploited by her colleagues of superior ranking.\u00a0<\/span><\/p>\n

HER INNOCENCE<\/span><\/p>\n

That which was revealed by colleagues speaks to \u2018Her Innocence.\u2019 Yet inescapably, it has tarnished a character said to be of presumptive impeccability. The two sums of money, said to have been suspected to have been the \u2018Proceeds of Crime,\u2019 were to have been produced to be tendered in evidence [ANR: August 28, 2023]. The \u2018Monies,\u2019 reportedly seized from the owner\/possessor \u2018Kimani Deandre Donawa,\u2019 were duly recorded in the \u2018Register of Police Exhibits.\u2019 Incidentally, the record reportedly showed one movement, presumably to the \u2018Magistrate\u2019s Court.\u2019 The Defendant, arrested on drug-related offences of possessing some \u201929lbs of the-controlled drug- \u2018Cannabis\u2019 [February 10, 2020], reportedly appeared before \u2018District Magistrate, Nagio Emanuel\u2019 [February 12, 2020].<\/span><\/p>\n

PERILS OF FINGER\u00a0<\/span><\/p>\n

The membership of all Police Services,\u2019 exists in an environment, fraught with character assassin and \u2018Reputational Danger.\u2019 Such dangers often seem to have outnumbered those posed at sea, or in a much safer environment of swimming pools.\u00a0 The members in the wider societal environment, run the risk of, inter alia: (a) \u2018Image and reputational damage; and (b) Being subjected to inescapable public ridicule.\u2019 Likened to the citizenry, \u2018Law enforcers\u2019 are constantly challenged by \u2018Trials and Temptations.\u2019 Relate these to seized citizen property, intended to be tendered in criminal proceedings, as \u2018Police Exhibits,\u2019 without proper control mechanisms, particularly for \u2018Periodic Auditing,\u2019 such property, including \u2018Money,\u2019 would always be exposed to the \u2018Perils of the Fingers.\u2019<\/span><\/p>\n

CRIMINAL EXPLOITS<\/span><\/p>\n

It was well known that through illegitimate means, many have succeeded, as well as many have failed and jailed for their adventurism and \u2018Criminal Exploits.\u2019 Those of Law enforcers had often made good news. While society often attributed blame to human indiscretions, and attendant evils, still, none may overlook the words human needs and greed. The same is true of depraved \u2018law enforcers. In whichever the jurisdictions, no \u2018Police Administrator\u2019 shall cause the citizenry to feel dissatisfied, with the organizational behavior; nor that perceived as a sub-culture. Those tasked with responsibility for the \u2018Protection and Service\u2019 to the citizenry and nation, shall never be perceived as being in want of superintendence and behavioral and operational supervision.\u00a0<\/span><\/p>\n

CRAVING FOR MONEY<\/span><\/p>\n

While there may be no scientific linkage between humans and \u2018Money,\u2019 human needs have determined its value to humanity. Narrowed down to the individual, there has long been a \u2018Craving for Money.\u2019 This, scripturally was well-established. This was when \u2018Judas Iscariot,\u2019 brazenly and treacherously caused the indignities of flogging and torment of \u2018Crucifixion\u2019 to be visited upon \u2018Jesus Christ.\u2019 He, irresistibly suffered, and gave up the \u2018Ghost\u2019 peacefully on the \u2018Wooden Cross\u2019 [Mark: 15: 21]. Today, humans have not only become more barbarous and treacherous to each other, but also more brutal, injurious and deadly over \u2018Money.;\u00a0<\/span><\/p>\n

SURVIVAL STRATEGIES<\/span><\/p>\n

It was the experience that for many reasons, the well-known adverse social conditions, lack of opportunities for gainful employment has forced humans to do the unthinkable. The sociologists have determined that legitimate or illegitimate, humans are most likely to use their skills in divers\u2019 ways. The sociologists have described this as; \u2018Survival Strategies.\u2019 Invariably, such \u2018Strategies\u2019 were known to have negatively impacted the well-being of society. Frequently, there were reports of; (a) \u2018Robbery: (b) Thievery; (c) Skullduggery; and (d) Treachery.\u2019\u00a0<\/span><\/p>\n

TAINTED PROPERTY: MONEY<\/span><\/p>\n

Research has revealed that Law enforcers have been fiddling with \u2018Evidential Exhibits,\u2019 and have not been subjected to criminal penalties. When large sums of \u2018Money\u2019 were reported stolen from within the Police Service,\u2019 petty thieves have always found it troubling. The almost valueless items pilfered, more out of necessity, than of habitual acts of criminality, had often landed most in the penitentiary. It was revealed that between the \u2018Years 2017 and 2023,\u2019 some \u2018Forty-one Thousand US\/EC$$$\u2019 of suspected \u2018Tainted Property\u2019 remains unaccounted for, within the Police Service.\u2019 That which appears most troubling has been the deafening silence on these developments.<\/span><\/p>\n

SEARCH AND SEIZURE<\/span><\/p>\n

Firstly, when it was reported that some \u2018EC$20, 000 +,\u2019 then suspected to have been; (a) \u2018The Proceeds of Crime; and\/or (b) Money Laundering,\u2019 former \u2018Commissioner of Police, Wendell Robinson,\u2019 unhesitatingly offered confirmation to the media of its unaccountability\u2019 [ANR: August 5, 2017]. The money, then deposited at the \u2018Criminal Records office (CRO),\u2019 was said to have resulted from a \u2018Police Search and Seizure.\u2019<\/span><\/p>\n

TRANSPARENCY AND ACCOUNTABILITY<\/span><\/p>\n

Mindful of; (i) \u2018Public interest; (ii) Public trust; (iii) \u2018Transparency; (iv) Accountability; and (v) Integrity in Public Life,\u2019 the media reported that the \u2018Money\u2019 was not so \u2018Tainted.\u2019 The \u2018Commissioner,\u2019 satisfied that it was legitimately acquired and lawfully possessed, was the property of a bona fide \u2018Contractor.\u2019 The money reportedly slipped out of the \u2018Exhibit Room\u2019 and the \u2018Actual Possession of the \u2018Custodian of Police Exhibits.\u2019 He assured that the incident was to be criminally investigated.\u00a0\u00a0<\/span><\/p>\n

CORRUPT COLLEAGUES<\/span><\/p>\n

The recent troubling developments within the \u2018Police Service,\u2019 speak to a combination of certain environmental and influential factors.\u00a0 Though \u2018Woman Police Constable Lenia Thomas,\u2019 has suffered no indignities of that of some \u201814-innocent teachers at the All-Saints\u2019 Secondary School (ASSS),\u2019 the unaccountability of some \u2018EC$21, 000\u2019 shall have given her very good reasons to believe that had been dealing with \u2018Roguish\/Corrupt Colleagues.\u2019 As news circulated on social media and among organizational colleagues, she must know that both her \u2018honesty and character would not only be subjected to official and public scrutiny, but herself in disciplinary and criminal jeopardy.<\/span><\/p>\n

MAJOR DRUG-RELATED CASE<\/span><\/p>\n

Researched data suggests that, \u2018Police Constable Lenia Thomas,\u2019 may have been considered a \u2018Rookie Constable\u2019 when she was assigned a \u2018Major Drug-related and Proceeds of Crime Cases.\u2019 The \u2018Constable; (a) Born July 6, 1990; (b) Enlisted into the Police Service-July 16, 2016; (c) Underwent the basic 6-month-course of Law enforcement training; (d) Seemingly assigned or have foisted upon her, the first \u2018Major Drug\/Proceeds of Crime Case\u2019 [February 10, 2020; (e) Made seizure of; (i) A significant quantity of a controlled vegetable substance- 29lbs Cannabis; and (ii) Large sum of \u2018Money-\u2019 EC$ 18, 000; and US$1, 500.\u2019 Now assigned to the \u2018Sir Wright F. George Police Training Academy,\u2019 as \u2018Clerical Assistant,\u2019 may have given reasons to the organizational membership of an assignment of questionable administrative motive or intention.<\/span><\/p>\n

ON-THE-JOB-TRAINING<\/span><\/p>\n

Modern training techniques necessitated certain approach as it relate to \u2018On-the-Job-Training.\u2019 She may also have been tasked with handling a case not only for criminal prosecutions, but also for \u2018Forfeiture proceedings.\u2019 She, was said to have taken her work very seriously. She had reportedly shown as much courage, as she had shown great enthusiasm. Led on a drug-interdiction operation, her supervisors may have; (a) \u2018Unsuspectingly taken advantage of her innocence; and (b) Exploited her ignorance to the detriment of her trustworthiness, character and integrity.\u2019\u00a0<\/span><\/p>\n

MEDIOCRITY OR NON-EFFICIENCY<\/span><\/p>\n

From a professional and operational perspective, it may have been anything, but; (a) \u2018Merit: (b) Ability; and (c) integrity,\u2019 that this \u2018Rookie Female Police Constable,\u2019 with service that appeared marginally over \u20183 years\u2019 would have been so proficient and so acquainted with the \u2018Proceeds of Crime Act.\u2019 She appeared to have undertaken that which her superiors may have shirked. This was opposed to the \u2018Long Serving\u2019 members, particularly, those of the \u2018Gazetted Rank.\u2019 Those of such rank, also includes the \u2018Police High Command,\u2019 that clearly appeared to have been embarrassingly positioned by the \u2018PSC,\u2019 either for \u2018Mediocrity or Non-efficiency.\u2019 The enactment provides for enforcement and procedural guidance. Fearing no contradictions, most officers lacked the capacity to have guided her.<\/span><\/p>\n

OPPORTUNITY FOR ADVANCEMENT<\/span><\/p>\n

If only some members on that august constitutional body, if not the \u2018Holy Scriptures,\u2019 the constitutional principle that states; \u2018There should be \u2018Opportunity for Advancement\u2019 as contained in the \u2018Constitution Order.\u2019 The criterion sets out are that it shall be on the basis of; (a) Recognition of merit; (c) Ability; and Integrity\u2019 [CO: 1981: Principle: \u2018B\u2019]. That which may have been seen as vexing, was that several officers that were seen lined-up for photo session with \u2018Governor General, His Excellency, Sir Rodney Errey Williams KGN, MBBS\u2019 for \u2018Long Service Medals,\u2019 have not the slightest clue of that undertook by the \u2018Woman Police Constable\u2019 [Observer Media: September 6, 2018: November 5, 2021]. She shall be, considered and awarded one for \u2018Meritorious Service.\u2019<\/span><\/p>\n

ENDURE AND PERSEVERE<\/span><\/p>\n

Most of these officers will have been so demoralized, disappointed, despondent and dispirited. Yet for reasons of; (i) \u2018Patriotism; (ii) Commitment;(iii) Loyalty; and (iv) Devotion to duty,\u2019 they continue to \u2018Endure and Persevere. Most with a passion and resolve to faithfully serve the nation and citizenry. According to \u2018Scriptural Teachings,\u2019 many have been serving in the \u2018Police Service,\u2019 since \u2018Judas Iscariot\u2019 heartlessly ate his last supper and kissed \u2018Jesus Christ.\u2019 Through an act of treachery, he reportedly received monetary value of \u201930-pieces of Silver,\u2019 and caused him pain and suffering and ultimately death [KJV: Matthew 26: 14].\u00a0<\/span><\/p>\n

\u00a0MYSTERIOUS DISAPPEARANCE<\/span><\/p>\n

Given two recent developments that speak to the \u2018Mysterious Disappearance\u2019 of two large sums of \u2018Monies,\u2019 officers now seizing suspected \u2018Tainted Money\u2019 may now be at serious risk depositing such \u2018Monies\u2019 into the \u2018Strictly off-limit Police Exhibits Room.\u2019 Lest the imagination may be insidiously moved to be stretched beyond the limit of open-mindedness, or the mind drifts into a mode that speaks to \u2018Iniquitous Thinking,\u2019 this female \u2018Police officer\u2019 is virtually unknown to the author. Dedicated to the reading interest of general public, and to the knowledge of other \u2018Potential Victims\u2019 in service with the \u2018Royal Police Force of Antigua and Barbuda.\u2019<\/span><\/p>\n

EXPLOITED IGNORANCE<\/span><\/p>\n

Procedurally, she shall have; (i) \u2018Made Court appearances before the District Magistrate with the Defendant and seizures [February 12, 2020: and (ii) Applied for, and obtained \u2018Detention (Seizure) Order\u2019 [February 15, 2020]. It is true that swimmers have never \u2018swam on the beach.\u2019 Speaking to \u2018On -The-Job-Training,\u2019 it was obvious that being starved for professional knowledge and practical experience, supervisors may have \u2018Exploited her Ignorance.\u2019 The \u2018Search and Seizure,\u2019 not only speak to knowledge of procedures, but also of the Law. With reasonable understanding, the procedures might be easily discerned.<\/span><\/p>\n

FUNDAMENTAL DUTY<\/span><\/p>\n

It is contained in the \u2018Law\u2019 that; \u2018As soon as practicable after the execution of the \u2018Warrant,\u2019 but within a period of 48 hours thereafter; (i) \u2018Law enforcers shall prepare a written Report identifying the property seized; (ii) The location where the property is being detained; and (iii) Forward a Copy of the Report to the Clerk to the \u2018District Magistrate\u2019 where the property is being detained.\u2019 It also states; \u2018A Magistrate shall, on application, provide a \u2018Copy of the Report\u2019 to the person from whom the property was seized\u2019 [Section 29]. They shall know that \u2018Property\u2019 of whatever nature and description seized and entrusted to \u2018Custodians of Police Exhibits,\u2019 shall be readily available to be adduced in evidence.<\/span><\/p>\n

UNACCOUNTABILITY OF EC\/US $$$<\/span><\/p>\n

Moreover, where \u2018Exhibits\u2019 were not so tendered and admitted in evidence, they shall be restored to the legitimate owners.\u2019 Given the \u2018Unaccountability of; EC$18, 000 and US$1, 5000,\u2019 a \u2018Commissioner of Police\u2019 shall show that none is above; (i) The criminal law; (ii) The \u2018Police Discipline Code.\u2019 Thus, he\/she shall move with expedition, demonstrating a firm resolve and decisiveness in addressing such issues. He shall ensure that \u2018Disciplinary Tribunals\u2019 shall not be seen as routinely farcical; that roguish behaviors are not tolerated. Neither should the Police high command allow behavior seen as reprehensible, to go unpunished.<\/span><\/p>\n

RAT-INFESTATION PROBLEM\u00a0<\/span><\/p>\n

Extending the research, it led to a conversation with \u2018Corporal of Police Jermain Samuel.\u2019 There was a time when the \u2018City of St. John\u2019s\u2019 was said to have been over-infested by a brazen invasive species of \u2018Rats.\u2019 Bringing awareness and sensitizing; (a) \u2018City residents; (b) Business operators; (c) Health officials; and (d) former Commissioner of Police, Wendell Robinson,\u2019 the now \u2018Law-degreed 21-year-veteran Police officer and social commentator, alerted the entire nation of the \u2018Rat-infestation.\u2019 They had invaded the penitentiary; printery\u2019 [September 2007].<\/span><\/p>\n

CITY RATS: THIEF LIKE MAN<\/span><\/p>\n

These \u2018Rats\u2019 were not only \u2018Big,\u2019 vicious; and violent, but also \u2018Thief\u2019 like Man.\u2019 For instance, there were complaints by inmates and prison-reform activist \u2018Jessica Thompson\u2019 that they had invaded the penitentiary, gnawing at the toes and fingers of prisoners incarcerated for stealing from members of the society. Then they had reportedly gnawed the wire insulation of the \u2018Printing Press, forcing temporary closure. Then a \u2018Police Constable, Jermain Samuel\u2019 performed a \u2018Rat Song.\u2019 This was to the amusement of his colleagues and entertainment of scores of fans and patrons. Little the \u2018Singing Police officer,\u2019 knew that the \u2018City Rats\u2019 would have infected members of the \u2018Police Service,\u2019 particularly those with an insatiable craving for \u2018Money.\u2019<\/span><\/p>\n

MONETARY EXHIBIT- \u2018EC$20, 000+\u2019<\/span><\/p>\n

It came to light in \u20182017\u2019 that a large sum of money was seizure from a \u2018Contractor.\u2019 The destructive \u2018Rats\u2019 that invaded the \u2018Penitentiary and Printery,\u2019 also invaded \u2018Criminal Records Office (CRO). It was not sure if \u2018Big Foot\u2019 had hinted them, but some \u2018Monetary Exhibit of EC$20,00+,\u2019 seized as \u2018Proceeds of Crime\u2019 and deposited with the \u2018Custodian of Police Exhibits,\u2019 could not have been accessed by the investigator. From research, it appeared that the sum of \u2018Money\u2019 may have sneaked out from the \u2018Safety Vault\u2019 long before then \u2018Commissioner of Police Wendell Robinson\u2019s\u2019 reportedly took certain \u2018Non-Forfeiture Decision.\u2019<\/span><\/p>\n

NON-FORFEITURE DECISION<\/span><\/p>\n

That was when he ordered that the \u2018Contractors Money\u2019 shall be restored to him. He was satisfied of three things; (i) \u2018It was not Tainted: (ii) Not the Proceeds of Crime; (iii) Legitimately acquired; and (iv) Lawfully possessed.\u2019 Those with large un-deposited sums of \u2018Money,\u2019 shall always be mindful of these.\u00a0 Man-size \u2018City Rats\u2019 reportedly made claim to ownership. Giving assurance to the media, he informed that internal investigation would have been launched\u2019 [Real News? ANR: August 5, 2017]. During his troubled tenure, adversities struck. These necessitated the institution of litigious proceedings Some six (6) years later, an apparent different species of \u2018Money Rats,\u2019 would not be outdone.\u2019<\/span><\/p>\n

SINGING SUDDEN<\/span><\/p>\n

The lyrical contents speak to the serious infestation. Then performing for \u2018Police Week-2007,\u2019 under the stage name \u2018Singing Sudden,\u2019 now widely known for his humorous social commentaries, the 21-year veteran Police officer, did \u2018Sing Sudden.\u2019 Quizzed about a future social commentary, he made it clear that \u2018Singing Sudden,\u2019 not getting into \u2018Nutten\u2019 (vernacular). However, he performed the chorus for the \u2018Rat Song,\u2019 singing; \u2018There are Rats; Rats; Rats in St. John\u2019s; Some of them big like man; One of them tried to bite off me hand.\u2019 It was not clear what he may have done to that \u2018Rat.\u2019 Out of curiosity, when asked if he would sing \u2018Sudden\u2019 on the \u2018Missing Money,\u2019 he chuckled and said; \u2018Now, you want to get \u2018Singing Sudden,\u2019 in ah sudden\u2019 (vernacular).<\/span><\/p>\n

ADMINISTRATIVE\/INVESTIGATIVE SCRUTINY<\/span><\/p>\n

Instructively, \u2018Commissioner of Police, Atlee Rodney QPM,\u2019 now appears to be facing difficulties with \u2018Man-Size Rats\u2019 within the \u2018Criminal Records Office (CRO).\u2019\u00a0 Research has revealed that some \u2018EC$18, 000 and US$1, 500\u2019 remains unaccounted. The unaccountable sums, have resulted in further delay of a criminal trial in which these sums were to be produced and tendered in evidence. The disappearance was said to have been the subject of criminal investigation, a member of the Inspectorate rank. In the face of social media reports that \u2018Monies seized as \u2018Police Exhibits\u2019 remain unaccounted, there has been no official confirmation or denial.<\/span><\/p>\n

FIRST INSTANCE FORMALITIES<\/span><\/p>\n

In the \u2018First Instance;\u2019 (a) Having completed packaging and identification formalities; (b) Arresting officers\/criminal investigators shall deposit all exhibits to the Custodian. The Custodian then has \u2018Actual Possession of the exhibits. When not physical possessed, the arresting officer\/criminal investigator only has \u2018Constructive Possession.\u2019 The Police Court Prosecutors, tasked with the preparation of the \u2018Fixtured Court Cases,\u2019 know what \u2018Police Court Exhibits\u2019 that shall be retrieved from the Custodian. These were usually for; (i) \u2018Summary trial; or (ii) Committal proceedings; (ii)\u00a0<\/span><\/p>\n

SUPERVISORY NEGLIGENCE<\/span><\/p>\n

Among the difficulties known to have experienced by arresting officers with their \u2018Exhibits,\u2019 were usually; (a) \u2018Professional ignorance; (b) \u2018Supervisory Negligence:\u2019 (c) \u2018Inordinate Court Delays.\u2019 These were often compounded by thievery due to corruptible professional ethics and integrity; and (d) Driven and by Police prosecutors, yielding to the Temptations of the Devil.\u2019 It was to the knowledge in criminal investigation, professional investigative training suggests an approach that speaks to \u2018everyone as being a possible suspect.\u2019 This was to be narrowed down only by a process of elimination.<\/span><\/p>\n

DISAPPEARING ACT<\/span><\/p>\n

Theorizing what may have resulted in the \u2018Disappearing Act,\u2019 given the evidential seriousness attached to the security, safety and integrity required by the \u2018Chain of Custody,\u2019 the harbored belief among rank-and-file members, was that the \u2018EC$18, 000 and US$1, 500,\u2019 was reasonably suspected to have been performed by a \u2018Subordinate Police officer (SPO).\u2019 Such designation are those officers holding the ranks; (i) \u2018Corporal; (ii) Sergeant; and (iii) Senior Sergeant.\u2019 Procedurally, only the \u2018Exhibits Depositor,\u2019 shall retrieve the exhibits needed for the \u2018Fixtured Trial Date.\u2019<\/span><\/p>\n

MOVEMENT OF EXHIBITS<\/span><\/p>\n

Having so retrieve, the arresting officer\/criminal investigator; (i) Takes the Case-related exhibits to the Magistrate\u2019s Court; and (ii) Delivered to the Police Court Prosecutor, in whom \u2018Actual Possession is transferred. Should the Case for the prosecution be fully closed and the exhibits have all been; (a) \u2018Tendered; (b) Admitted; and (c) Marked\u2019 by the trial Magistrate, the Clerk to the Court then takes \u2018Actual Possession of them.\u2019 Where there was no closure of the Prosecution\u2019s Case, and no tendering, admittance and markings took place, the \u2018Prosecutor\u2019s duty and responsibility, dictates the immediate return of the exhibits to the arresting officer.\u00a0<\/span><\/p>\n

CHAIN OF CUSTODY -ACCOUNTABILITY<\/span><\/p>\n

Then in maintaining; (i) \u2018The \u2018Chain of Custody; and (ii) Integrity of the exhibits, the arresting officer returns the exhibits to the \u2018Custodian of Police Exhibits\u2019 until the \u2018Fixtured Date\u2019 comes up for continuation of the trial. When \u2018Exhibits\u2019 disappeared, there are, but two distinct possibilities; (i) \u2018When Police prosecutors neglected to return the exhibits to the \u2018Actual Possession\u2019 of the arresting officer; and (ii) When \u2018Police\u2019 prosecutors became negligent, leaving exhibits unattended on prosecutor\u2019s table, or envelopes with \u2018Monetary Exhibits\u2019 are concealed in \u2018Criminal Case Files.\u2019<\/span><\/p>\n

BAWLING FOR MURDER<\/span><\/p>\n

That which shall never be ruled out, was when unscrupulous prosecutors or office manager and staff going through \u2018Case Files\u2019 to ensure that witness statements or copied documents were still enclosed, un-observed, come upon contents that shall have been returned to the \u2018Custodian of Police Exhibits.\u2019 From professional knowledge of possession and safety of \u2018Polce Exhibits,\u2019 in the \u2018Defence Days\u2019 of one of the most revered, yet mischievous attorneys, deceased attorney, \u2018John Fuller,\u2019 some prosecutor may have been given reasons to \u2018Bawl for Murder.\u2019<\/span><\/p>\n

STEWARDSHIP AND ACCOUNTABILITY<\/span><\/p>\n

Then for reasons of prosecutorial \u2018Stewardship and Accountability,\u2019 some prosecutor will have been given time off by \u2018Commissioner of Police, Sir Wright Fitzhenly George KCN, CVO, QPM, CPM,\u2019 to wend their way, either to the \u2018Police Credit Union\u2019 or a \u2018City Bank\u2019 in discharging their professional responsibility. Research has revealed that trial of two drug-related offences, has been long pending before \u2018Her Worship, Magistrate Nagio Emanuel\u2019 at the \u2018District \u2018B\u2019 Magistrate\u2019s Court.\u2019 Such Court has apparent full-time \u2018Tenancy Status\u2019 at the \u2018Antigua and Barbuda Transport Board (ABTB) Headquarters\u2019 [Herberts].<\/span><\/p>\n

\u00a0QUESTION OF DISHONESTY<\/span><\/p>\n

That which shall be factored for certain developments, may not only have been the serious \u2018Questions of; (a) Supervision; but also (b) Innate behavioral Dishonesty.\u2019 In the instant Case, a possible contributory factor, may have been the disruption caused by \u2018Corona Virus-19 Pandemic\u2019 that has resulted in the lengthy adjournment that may have militated against expeditious trial. Given the procedures then obtained, whenever there was a date for trial in Cases involving \u2018Exhibits of whatever nature, only the incompetent and inefficient \u2018Police Prosecutors\u2019 may not firstly, check the \u2018Listed Exhibits\u2019 as shall have been provided in the inner side of the related \u2018Case File.\u2019 Where this becomes evident, such \u2018inefficiency\u2019 shall not be allowed to infect others.\u00a0\u00a0<\/span><\/p>\n

CONCLUSION<\/span><\/p>\n

Though not necessarily casting aspersion, and if so thought, this is intended only to keep \u2018Sticky Fingers\u2019 off \u2018Police Exhibits.\u2019 That which shall be said, is that \u2018Exhibits\u2019 could have been returned to the \u2018Custodian of Police Exhibits,\u2019 who physically accepted them, but might be negligent in posting the \u2018Exhibits Register\u2019 up-to-date.\u2019 It shall not be seen that when preparing for \u2018Criminal Trials,\u2019 only a \u2018Prosecutorial Thief,\u2019 would deny seeing or receiving from the arresting officer, tenderable \u2018Monetary Exhibits.\u2019 Should an arresting officer be absent from the precinct of the Court, and not retrieve his\/her \u2018Exhibits,\u2019 it would not only be considered irresponsible, but also reckless and grossly negligent for a \u2018Police Prosecutor\u2019 to leave whatever form of \u2018Exhibits\u2019 placed in his\/her \u2018Actual Possession,\u2019 or entrusted to him\/her. SOLUTIONS: A Commissioner of Police may now seek to review that which currently obtains at: (a) The office of the Custodian of Police Exhibits; (b) At the Magistrate\u2019s Court when Police prosecutors are entrusted with the various items of \u2018Exhibits: (c) Cause Police Prosecutors to make use of an \u2018Exhibit Register; and most importantly (d) Immediately initiate a periodic \u2018Visitational Audits\u2019 of both Exhibit Registers.\u00a0<\/span><\/p>\n
