REAL NEWS: The Police have launched an internal investigation into the\u2028disappearance of over $21,000 in cash that had been in the custody\u2028of a female officer.<\/p>

Reports say the money was confiscated because the Police believed\u2028it to be ill-gotten gains.<\/p>\n

As a result of the seizure, the accused person has to appear before\u2028the Court to prove that the money was obtained legally and is not\u2028the proceeds of crime.<\/p>

However, a source tells REAL News that when the forfeiture matter\u2028came up for trial last week in the All Saints Magistrates Court, the\u2028money \u2013 an exhibit in the case \u2013 could not be presented.<\/p>

It is alleged that, while giving evidence, the investigating officer\u2028could not produce the EC$18,000 and US$1,500 that had been taken\u2028from the accused.<\/p>\n

It appears that she had misplaced the funds and\u2028could not remember what she had done with the sum of money.\u2028\u00a0\u2028When she was questioned about it, the source says, the officer\u2028reportedly gave the Court various excuses and attempted to\u2028implicate the now-suspended Chief Magistrate in the matter.<\/p>

If they are not ready to proceed with a case, the Police cannot keep\u2028large sums that are exhibits without receiving permission to hold\u2028onto the money until trial. And, according to the source, in most\u2028cases a continued detention would be granted for three months at a\u2028time.<\/p>\n

Reports say the case is a District B matter; and, at one point, it had\u2028gone before Chief Magistrate Joanne Walsh since Magistrate Ngaio\u2028Emanuel was on leave. Walsh reportedly had granted the continued\u2028detention for three months.\u2028\u00a0\u2028In requesting further detention of the money, the source explains,\u2028the Court has to be satisfied with the reasons given by the Police,\u2028and the officer, therefore, would have to swear an affidavit.\u2028\u00a0\u2028This means that the money would have remained in the custody of\u2028the Police and not the Court. However, it is alleged that Magistrate\u2028Emanuel failed to take this information into account.<\/p>

Reports say the female investigator also attempted to blame two\u2028other prosecutors, one of whom was before Magistrate Conliffe\u2028Clarke when the matter first went before the All Saints Court.\u2028\u00a0\u2028It was, indeed, another prosecutor who dealt with the matter at that\u2028time, and her name is on the report that accompanies the case files.\u2028However, since the matter was adjourned, the case did not begin\u2028with that officer, and she would not have had possession of the\u2028money.\u2028\u00a0\u2028Reports say this prosecutor is currently off-island. But she allegedly\u2028has claimed she never received the money, nor does she have any\u2028knowledge of what the investigator might have done with it.\u2028\u00a0\u2028Interestingly, it is alleged that the investigator, at some point earlier,\u2028had signed out the cash from the Exhibit\u00a0Room; however, there is no\u2028record of her returning the money.\u2028\u00a0\u2028Having been notified of the baffling situation, Superintendent\u2028Lisborn Michael \u2013 the officer in charge of the Criminal Investigations\u2028Department \u2013 reportedly has initiated a probe. Sources claim he has\u2028appointed an inspector to investigate the disappearance of the\u2028money.\u2028\u00a0\u2028Meanwhile, they also allege that Magistrate Emanuel is threatening\u2028to throw out the case if the cash exhibit is not presented to the Court\u2028on the date of the next hearing. And without the exhibit the case\u2028cannot proceed.<\/p>

If the Court had ruled that the cash be forfeited to the State, it would\u2028have gone into the Treasury or Consolidated Fund.\u2028\u00a0\u2028But if the magistrate tosses the case, what is likely to happen is that\u2028the Police will have to find the cash to return to the accused person.<\/p>\n
