Dear Editor,<\/p>

According to reports in the Antigua Newsroom online newspaper of August 11<\/span>th<\/span>,\u00a0 2023, the Police have asked the government for \u201clegislation\u201d that would\u00a0 \u201cempower them to enforce a \u2018limited\u2019 state of emergency in specific areas\u2026to\u00a0 ensure public safety.\u201d This request definitely warrants public scrutiny in view of\u00a0 the fact that the Police have been touting their successes, and the laws that are\u00a0 meant to guide their decisions in the field, do not appear to be impeding their\u00a0 efforts in any way. In fact, the opposite appears to be the case.\u00a0\u00a0<\/span><\/p>\n

In the Observer of 12<\/span>th <\/span>August 2023, the Chief of Police, Atley Rodney, is quoted as\u00a0 saying that \u201cthe Criminal Investigation Department (CID) has observed a\u00a0 noticeable decrease in criminal matters, signaling a potential step forward in the\u00a0 realm of public safety.\u201d<\/span><\/p>

\"\"<\/a><\/div>\n

According to him, crime \u201cnumbers are going down\u201d and\u00a0 there are \u201csigns of improvement.\u201d To allay any suspicion that his positive outlook could be an exaggeration, the Chief of Police mentioned that \u201cabout 30 firearms\u00a0 have been confiscated\u201d and that \u201cthe cooperation of residents\u201d has helped them\u00a0 achieve that milestone. To top it off, the Chief says the Force is being \u201cproactive.\u201d\u00a0\u00a0<\/span><\/p>

\"\"<\/a><\/div>\n

All of the strategic elements are aligned in their favor. The parameters of the law that help to keep police activities within the framework of legality and that are meant to be protective of constitutional rights, have enabled the positive\u00a0 outcomes the police have had. If the police crime report is accurate, then they do\u00a0 not need a \u201climited\u201d state of emergency and certainly not the enhancement of\u00a0 their lethal arsenal, to include \u201cmace\u201d and \u201cTaser gun,\u201d to reduce crime. Are they\u00a0 aware that \u201cmace,\u201d can impair eyesight and is detrimental to asthmatics and that the \u201cTaser gun\u201d can induce kidney damage, respiratory arrest, amnesia and in some instances, even cause death? Do these likely outcomes even bother the police? It may be that the police and the government have more than crime\u00a0 fighting in mind.\u00a0<\/span><\/p>\n

Antiguans and Barbudans should be concerned that a police force which has\u00a0 already proven that it is capable of indiscriminately tear gassing peaceful\u00a0 demonstrators, as happened on August 8<\/span>th<\/span>, of 2021, and has also shown that it <\/span>can commit extra judicial killings, as the Killing of unarmed, Mr. Mannie James on\u00a0 the 31<\/span>st <\/span>of July 2023 in front of his family and residents of Grays Farm was, would\u00a0 be the same Force regimenting their lives, under a strictly enforced state of\u00a0 emergency.<\/span><\/p>

 <\/p>\n

A state of emergency allows the cessation of everyone\u2019s democratic rights. It sanctions the interruption of daily existence and puts the entire\u00a0 community under the direct supervision and management of the Defense Force\u00a0 and police. It would terminate the existing norms that govern how the police\u00a0 should interact with people and how it can procure evidence when investigating\u00a0 an alleged crime.\u00a0\u00a0<\/span><\/p>

\"\"<\/a><\/div>\n

At present, Stop and Frisk allows the searching of your person and belongings without probable cause when you are out in the public. Under a state of\u00a0 emergency, these operations would be implemented more rigorously in regimented communities. There exists the possibility that during this declared\u00a0 \u201climited\u201d state of emergency, the police will be permitted to forego the use of a search warrant to enter and search your home. State of emergencies always\u00a0 encourage official, reckless behaviors.\u00a0<\/span><\/p>

\"\"<\/a><\/div>\n

There exists no antagonisms or incongruities between working to reduce crime and maintaining the human dignity and the democratic rights of every citizen. A\u00a0 state of emergency will threaten those protections. It is the adherence to these standards, limited and precarious as they are in the Antigua and Barbuda\u00a0 Constitution, that may offer marginalized, underserved and unrepresented\u00a0 communities, like Grays Farm and Point, some modicum of protection against\u00a0 officially sanctioned violations. That is our responsibility.\u00a0\u00a0<\/span><\/p>\n

You see, the police like the state, of which it is part of, acts like the force it is above\u00a0 society. The police do not think that it is bound to have any allegiance to workers\u00a0 and everyday people. That is why they never appear to hesitate when ordered to\u00a0 carryout violence against demonstrators or seem to have evinced any sympathy when they were authorized to haul people out of their houses in the Point area, in\u00a0 April of this year. Nor did they show reluctance when they were detailed to\u00a0 supervise the forced evacuation of Barbudans from their home to Antigua in 2017, on behalf of the government .<\/span><\/p>\n

Each time the police are asked to act against the\u00a0 people, they get more accustomed to pushing them around, and the more they\u00a0 become disrespectful of the rights of certain classes of people. Antiguans and\u00a0<\/span>Barbudans should thus be fearful of any state of emergency because your police\u00a0 force has gotten accustomed to abrogating your rights in the interest of the\u00a0 government. Barbudans understand this. Antiguans are aware of it. It is a good\u00a0 thing that people are saying no to any state of emergency.\u00a0<\/span><\/p>\n
